Sri Lanka balance favors Tamil rebels
President Kumaratunga and Hakeem in friendlier times COLOMBO, Sri Lanka Sri Lanka's new political kingmaker is dangling his party's make-or-break votes to pressure President Chandrika Kumaratunga to resume peace talks with Tamil separatists. Rauf Hakeem, whose Sri Lanka Muslim Congress had just withdrawn support for Kumaratunga's ruling People's Alliance, said on Thursday he was still deciding whether to support a no-confidence vote against the president in July. Hakeem and six lawmakers joined the opposition on Wednesday, the same day he was sacked as transportation minister. "It will be a party decision, but we are not thinking of any knee-jerk reaction to the current situation," Hakeem said. He added that his party's votes would be cast on a "case-by-case basis." Since the ruling party does not have majority control of parliament, Hakeem holds the balance of power.

Sri Lanka parliament suspended; opposition vows protests
Kumaratunga suspended Parliament and also ordered a national referendum COLOMBO, Sri Lanka A surprise midnight suspension of Parliament by President Chandrika Kumaratunga has left Sri Lankans pondering the political future of their war-wracked country. Opposition parties pledged to protest the move. Facing a no-confidence motion, the president ordered the two-month Parliament suspension and also ordered a national referendum, seeking a mandate to govern. The suspension was seen as a political move to avoid possible defeat in the no-confidence motion that the opposition presented after Kumaratunga's 9-month-old governing coalition, the Peoples' Alliance, was reduced to a minority last month. Opposition parties promised street protests over the president's moves. "We are infuriated," said Ravi Karunanayake of the main opposition United National Party. ÊCNN.com Asia

    Sri Lanka Introduction From time immemorial the island has been subjected to many different influences, both occidental and oriental. Consequently this small island state contains an exotic mixture of languages, cultures and religions. The few thousand Veddhas who live in remote jungle areas are the descendants of the original inhabitants. The majority of the population are descendants of the Aryan tribes that came from North India over 2'000 years ago. Subsequent Dravidian invasions and Arab migrations have created a wonderful cosmopolitan society.
    The island has been known by a variety of names, a list which is as varied as its historical influences. More than 2000 years ago the famous Indian epic "Ramayana" told of misdeeds of the wicked king of Lanka. The Dravids called the isle Ilankai; to the old Greeks and the Romans it was known as Taprobane; the Arabic merchants called it Serendib; the Portuguese Ceiloa; the Dutch changed the name into Ceylan, and the British to Ceylon. The Republic of Sri Lanka was born in 1972, the prefix "Sri" is Sanskrit in origin and means resplendent.
    The British, who ruled the island from 1795 - 1948 have exerted the most lasting influences on the country and its people. The Portuguese (1505 - 1658) and the Dutch (1658 - 1795) were only able to control the coastal areas. The Portuguese were as interested in saving souls as they were interested in trade. Their evangelical mission has had a lasting influence, and they gave many Sri Lankans their names:

    Nestling off the southern tip of India, the tropical island of Sri Lanka has beguiled travellers for centuries with its palm-fringed beaches, diverse landscapes and historical monuments.
    But for nearly two decades, the island was scarred by a bitter civil war arising out of ethnic tensions. OVERVIEW
    FACTS
    LEADERS MEDIA Known as "Serendip" to Arab geographers, it was to fall under Portuguese and Dutch influence and finally came under British rule when it was called Ceylon. The island has a long-established Tamil minority in the north and east. The British also brought in Tamil labourers to work the coffee and tea plantations in the central highlands, making the island a major tea producer. But the majority Buddhist Sinhalese community resented what they saw as favouritism towards the mainly-Hindu Tamils under British administration. The growth of a more assertive Sinhala nationalism after independence fanned the flames of ethnic division until civil war erupted in the 1980s between Tamils pressing for self-rule and the government.

    Norway brokered a ceasefire in February 2002 which is still in place Sri Lanka's Tamil Tiger rebels say they have reached an agreement to revive stalled talks with the government.
    The negotiations would be the first since the rebels walked out of talks a year ago, demanding more autonomy in the north and east. The announcement came after the Norwegian deputy foreign minister travelled to the rebel-held town of Kilinochchi on Thursday. The government said earlier that talks would start before the end of July. The BBC's Frances Harrison in Colombo says that the negotiations will be extremely difficult and a settlement to the island's conflict is still a long way off. 'Big gulf' Our correspondent says that it looks as if the new government has had to make concessions to the rebels that it bitterly criticised when in opposition. She says the fact that the Tigers say they have agreed on most of the main issues relating to the resumption of talks is something of an achievement, because it looked as if there was a big gulf between the two sides.

    Diplomatic Assurances No Safeguard Against Torture

    Individuals suspected of terrorism should never be returned to a country where they risk torture and ill-treatment. Promises of fair treatment by states with well-known records of torture are inherently unreliable, and governments that justify returns through such promises, known as “diplomatic assurances,” are violating the absolute prohibition against torture and eroding a fundamental principle of international law. The death penalty, however reprehensible, is legal and usually carried out publicly. But torture is illegal and practiced in secret. Governments routinely lie about whether they’re torturing people or not, and in some situations they may not even have adequate control to guarantee security. This 39-page report documents cases where governments returned or considered returning suspects on the basis of such formal guarantees, and raises concern that in some cases, those returned were, in fact, tortured or ill-treated.

    The Constitution recognizes and guarantees a broad range of fundamental rights including: freedom of thought and conscience; religious freedom; freedom from discrimination on the basis of race, religion, sex, or caste; freedom of speech; basic legal protection including freedom from arbitrary arrest or detention; freedom to engage in any lawful occupation; and freedom of movement and travel. These rights are guaranteed to stateless persons resident in Sri Lanka for ten years following promulgation of the Constitution. Exercise of the fundamental rights, however, can be restricted in situations where national security is at risk or when the otherwise legal actions of persons (such as speech or publication) detract from racial or religious harmony or endanger "public health and morality." The Constitution contains a section devoted to directive principles of state policy. These encompass a broad range of policy goals, including the establishment of a "democratic socialist society" and a just distribution of wealth; economic development; and the raising of cultural and educational standards. The directive principles also include a commitment to decentralizing the country's administration and promoting national unity by eliminating all forms of discrimination. The duties of citizens (including the fostering of national unity) are also enumerated. Amendment of the Constitution requires the vote of two-thirds of Parliament. In addition, measures that affect "the independent, unitary, and democratic nature of the state," the Buddhist religion, fundamental rights, or the length of the term of office of president or Parliament must be approved by a popular referendum. Bills judged "inconsistent with the Constitution" cannot become law unless two-thirds of Parliament approve, but such bills can be repealed by a simple majority vote.

    Government Labor Policies
    During the nineteenth century, labor legislation dealt with the large plantations, and more general labor laws were passed only in the closing years of colonial rule. In 1941 the government enacted the Wages Boards Ordinance, the first comprehensive piece of legislation regarding the payment of wages, the regulation of working hours, and sick and annual leave; the ordinance also empowered the government to establish wages boards for any trade. The boards are composed of an equal number of representatives of workers and employers and three appointees proposed by the commissioner of labor. Ordinances of 1942 and 1946 required all factories to be registered and established minimum standards for health and safety. The laws also gave the commissioner the right to send inspectors to the factories and to judge whether a plant was meeting minimum standards. The Shops and Offices Employees Act of 1954 extended the provisions of the factories legislation to small shops. The Maternity Benefits Ordinance, as amended in 1957, entitled a woman who worked in a factory, mine, or estate to full compensation for a period of two weeks before her confinement and for six weeks afterward. The employee must have worked for the employer 150 days before her confinement to be eligible to receive the benefits.

    ESTIMATED 2000 POPULATION: Sri Lanka is an island located in the Indian Ocean and separated from India by the Palk Strait. The country has two geographical regions. (1.) A rolling plain which comprises 80% of the land area as well as the entire northern half of the island and continues around the coast to the southern half. (2.) The south central region which is hilly and mountainous with two plateaux, the Hatton and Kandy, that rise abruptly from the Ura Basin. The country has sixteen rivers of which the Mahaweli Ganga and the Aruvi Aru are the longest. Major Cities (pop. est.); Colombo 615,000, Dehiwala 196,000, Moratuwa 170,000, Jaffna 129,000 (1990). Land Use; forested 33%, pastures 7%, agricultural-cultivated 29%, other 31% (1993). CLIMATE: Sri Lanka has a tropical climate with little seasonal variation in conditions and humidity, which is frequently around 90%. The island experiences the SW Monsoon in May and the NE Monsoon in November. Average annual precipitation varies between 1,270 mm and 1,900 mm (50 and 75 inches) on the southeast plains to between 2,540 mm and 5,080 mm (100 and 200 inches) on the southwest plains. Average temperature ranges in Colombo are from 23 to 31 degrees Celsius (73 to 88 degrees Fahrenheit) and from 14 to 24 degrees Celsius (57 to 75 degrees Fahrenheit) in the highlands.
