SPECIAL EDUCATION

The department’s special education consultants provide technical assistance to schools and other organizations to help ensure that schools understand and comply with federal and state laws and regulations related to providing special education services. In addition, the special education division offers a due process procedure to parents who have concerns about the services offered to their children.
Under the federal Individuals with Disabilities Education Act, or IDEA, Vermont is required to identify and evaluate students who have disabilities and to offer them individualized education programs (IEP) for special education and related services. Decisions regarding the services that are included in an IEP are made by a team using a process specified in the law. An IEP team includes a student’s classroom teacher, special educator, parent(s) and a representative of the school district who is empowered to commit resources such as staff time or funding. At that time, provisions were added to address nonpoint source pollution, pollution from diffuse sources such as runoff of fertilizers and pesticides, stormwater runoff, and sediment. Total Maximum Daily Load (TMDL) regulations continue to be a key issue for states and the federal government. First proposed in July 2000 by the Environmental Protection Agency (EPA), the TMDL regulation would require states to monitor more than 20,000 bodies of water, calculate the pollution "budget" for each, pinpoint specific levels of a given pollutant contributed by a party or group of parties, then develop a cleanup plan to reduce the parties' contributions. The Safe Drinking Water Act was reauthorized and amended in 1996. The amendments added several new responsibilities for states, including the recognition of sourcewater protection and operator training. At the same time, the amendments added a new state revolving loan fund for local water system improvements.
