Though there are some limited resources available to these individuals upon arrival, social services and assistance are limited in quantity and duration. Like many Native Americans and even members of mainstream society, new arrivals must meet the challenges of daily survival in a culture for which they are not prepared. For refugees and immigrants, the added factor of having to assimilate a new language may present the biggest hurdle. They need to learn about opportunities and services to develop or enhance skills that will help them cope effectively with their "new" cultural environment. In this way, they can make positive contributions to the community and lead more productive and satisfying lives.

Defendant South Dakota High School Activities Association (hereinafter "SDHSAA" or "the Association") is a voluntary, non-profit association whose membership is composed of approximately 194 South Dakota public and private secondary schools and whose headquarters is located in Pierre, South Dakota. The Association governs interscholastic athletics and activities in and among member schools, and has controlling authority over sanctioning, operating, providing, and regulating interscholastic athletics and activities in and among its member schools. The Association has approximately 169 members who are public schools that receive federal financial assistance.

The Todd County School District serves 2200 youth on the Rosebud Reservation, of which 1900 are Native American. Dr. Bordeaux is a member of various organizations including National Indian Education Association, South Dakota Indian Education Association and the Association for Supervision and Curriculum Development. He is currently the secretary for National Indian Impact School Association and treasurer for the Impact Aid Schools of South Dakota. Receiving his college education at the University of South Dakota, Vermillion, Dr. Bordeaux graduated from St. Francis Mission School, St. Francis, South Dakota. "My heart lies with St. Francis, but my mind is with Todd County," says Dr. Bordeaux.

Registration/Licensing/Accreditation: Recordkeeping/Reports: Discrimination: Special Education: Health: The Department of Health and Environmental Control has the authority to inspect private school lunchrooms and sanitary facilities. 1982 Op. Atty. Gen., No. 82-10, p. 12. Safety: Transportation: Home Schooling: Parents or guardians may teach their children at home if the instruction is approved by the district board of trustees in the district in which the child resides. Home school programs that meet the following standards will be approved:
  • The parent holds at least a high school diploma or the equivalent GED certificate and attains a passing score on the basic skills examination or has earned a baccalaureate degree; The instructional day is at least four and one-half hours, excluding lunch and recesses, and the instructional year is at least 180 days; The curriculum includes, but is not limited to, the basic instructional areas of reading, writing, mathematics, science, and social studies and, in grades 7 through 12, composition and literature; As evidence that a student is receiving regular instruction, the parent shall maintain the following records for inspection upon reasonable notice by a representative of the school district: a plan book, diary, or other written record indicating subjects taught and activities in which the parent and student engage; a portfolio of samples of the student?s work; and a record of evaluations of the student?s academic progress;

    The South Dakota Board of Education adopted challenging content standards in K-12 reading/language arts and mathematics on l5 December 1998. These standards meet the requirements of 1111(b)(1).
