Course content must relate to patient care in physical therapy whether the subject is research, treatment, documentation, education, or management.

Fourth Circuit Upholds South Carolina’s Abortion Clinic Regulations Against Second Challenge South Carolina, September 20 - Yesterday, the Fourth Circuit Court of Appeals, once again, affirmed the constitutionality of South Carolina’s comprehensive abortion clinic regulations. “This is a tremendous victory for women’s health,” said Denise Burke, staff counsel with Americans United for Life. “Despite repeated attempts by pro-abortion advocates to derail these regulations, the Fourth Circuit has recognized, yet again, the right of individual states to ensure that women are not receiving substandard medical care at abortion clinics.” This was the second time that the Fourth Circuit was asked to review South Carolina’s regulations. In August 2000, the appellate court upheld the regulations against claims that they “unduly burdened” a woman’s right to choose an abortion and that they violated constitutional guarantees of equal protection. The U.S. Supreme Court declined to review the case, tacitly affirming the Fourth Circuit’s decision, in February 2001. The case was then returned to the federal district court in Greenville, South Carolina where abortion providers sought and received rulings on remaining challenges to the regulations. After a second hearing on April 5, 2002, the Fourth Circuit summarily rejected claims by abortion providers that the regulations were unconstitutionally vague and that they illegally delegated state authority to private and state hospitals by requiring abortion providers to have admitting privileges at a local hospital. The court also rejected claims that a requirement that clergy be made available to counsel women, if requested, violated the doctrine of “separation of church and state” and that allowing state officials to review patient records, in the ordinary course of their duties, violated patients’ informational privacy rights.

U.S. Supreme Court Declines Review of Abortion Clinic Regulations Case Decision Upholding Constitutionality of South Carolina Law Stands Today, the U.S. Supreme Court declined to review a challenge to South Carolina's abortion clinic regulations. The denial of certiorari in Greenville Women's Clinic v. Bryant lets stand a lower court ruling that the regulations are constitutional. "This is a tremendous victory for women's health," said Denise Burke, staff counsel with Americans United for Life. "This decision will have far-reaching, positive implications for women's health and the right of individual states to ensure that women are not receiving substandard medical care at abortion clinics. "Veterinarians are more regulated than most abortion providers, and women have suffered the consequences," continued Burke. "Each year, thousands of women are injured at abortion clinics. Some require emergency hysterectomies or transfusions, and some die. States have the right to ensure that women receive safe, competent medical care and that is exactly what abortion clinic regulations are designed to do." The Supreme Court's refusal to hear this case will have an immediate impact on other states that have passed or are considering similar licensing and regulatory requirements for abortion clinics. Regulations in three other states (Arizona, Texas, and Tennessee) are currently facing legal challenges by abortion providers. "This decision solidifies constitutional support for the regulation of abortion clinics and ensures that other states will consider enacting similar regulations," said Burke.

    Statutory Authority: 1976 Code Sections 43-1-80 and 20-7-2980 et seq.
    Definitions and Procedures.
    A. Definitions. Terms used in South Carolina Regulations, Chapter 114, Article 5, Part A, shall be all definitions cited in Section 20-7-2700 et seq., Code of Laws of South Carolina in addition to the definitions which follow: A.(1) Emergency Person. An individual not regularly employed by the facility who is immediately available to serve as staff in the facility during emergency situations. A.(2) Judicially Determined. A criminal conviction in a court of law which is either the result of a jury trial, guilty plea, plea of no contest or forfeiture of bond in cases of misdemeanor or a determination of child abuse or neglect in any court of competent jurisdiction. A.(3) Original and Renewal Application for a License/Approval. Completed Department of Social Services (DSS) application form, completed DSS inspection study, completed health and fire inspection reports, current criminal history background records checks (for facilities subject to licensure), written policies and other related information deemed necessary by the Department to make a determination of issuance or non-issuance of a license/approval. A.(4) Overnight Care. Care provided to children by facilities defined in these regulations from 1:00a.m. to 6:00a.m.

    BACKGROUND
    Section 10-C of the South Carolina School-to-Work Transition Act (1994) stipulates that the Council of College and University Presidents and the State Board for Technical and Comprehensive Education, operating through the Commission on Higher Education, shall develop better articulation of associate and baccalaureate degree programs. To comply with this requirement the Commission, upon the advice of the Council of Presidents, established a Transfer Articulation Policy Committee composed of four-year institutions' vice presidents for academic affairs and the Associate Director for Instruction of the State Board for Technical and Comprehensive Education. The principal outcomes derived from the work of that committee and accepted by the Commission on Higher Education on July 6, 1995, were:
    • An expanded list of 72 courses which will transfer to four-year public institutions of South Carolina from the two-year public institutions;
