Notification may encourage community members to report suspicious behavior, thereby suppressing criminal behavior. Internet sex offender registries prompt high court to look into openness issues The U.S. Supreme Court in February agreed to hear arguments in a case concerning Alaska's sex offender registration program and determine whether the notification law violates the U.S. Constitution's prohibition on ex post facto laws when it is applied to those convicted of sex crimes before the new law was enacted. The case before the Supreme Court, Otte v. Doe , will consider the decision of the U.S. Court of Appeals in San Francisco (9th Cir.) that found that the Alaska law constituted an additional "punishment" because it allowed law enforcement agencies to post information about the offenders on the Internet. Although there is no direct First Amendment claim in the case, it indirectly touches upon important record access issues. The court found that the listings constitute an additional penalty even though most of the information is a matter of public record that could be found in court files of criminal convictions. The Alaska statute requires all convicted sex offenders to register with the state, be photographed, provide fingerprints and provide name, date of birth, address, place of employment and details about the conviction. The state publishes such information on its Web site, which allows searches of the database.

Another term commonly used when this activity is "bias crime." When this behavior actually violates a criminal statute or law, it is a "hate crime". Hate crimes are unique from other forms of violence because they most likely would not have occurred without the bias element. Hate violence is not merely about committing the crime. It is about victimizing the targeted person because of hatred and prejudice. Michigan's "Ethnic Intimidation" Act was originally introduced in 1987 with the term "sexual orientation," but was stripped from the Bill's protection on the last day of legislative session. Currently anti-gay hate violence in Michigan is not punished the same as violence against other groups.

With his heart racing and soaked in sweat, Joseph Keane-Comella still wakes up in terror in the middle of the night as the dark images from the sexual abuse he suffered at the hands of his father haunt his sleep.
``I'm 30 years old, and I still have nightmares about things that happened to me when I was 11,'' said the South End man. ``I wake up in the middle of the night sometimes and I think the guy's in bed with me. It never goes away.''
But, under threat from local police in the town where the older man now lives, Keane-Comella cannot tell his father's neighbors that a convicted sexual predator lives among them. He cannot notify the day-care center across the street to watch the children carefully when they are outside.
And, with recent court rulings putting the state Sex Offender Registry law on hold, they won't find out for a while.
Unlike the 49 other states in the country, Massachusetts has a sex-offender registry in theory only despite a federal mandate to create one. Last month, Suffolk Superior Court Judge John M. Xifaras issued an injunction in a class-action suit against the registry board from forcing the state's 16,000 convicted sex offenders to mail in information about where they live and work.

    By Gina Holland - Associated Press Published: Thursday, March 6, 2003 WASHINGTON The Supreme Court ruled Wednesday that states can post sex offenders' photos and other personal information on the Internet, a step the states say is aimed at protecting people from criminals living nearby.
    In a key first test of "Megan's law" provisions that are on the books in every state, the justices said sex-offender registries are not an unconstitutional extra punishment for offenders who already have served their sentences.
    "The publicity may cause adverse consequences for the convicted defendants, running from mild personal embarrassment to social ostracism," Justice Anthony Kennedy wrote in the 6-3 decision.
    But the laws are intended, he said, "to inform the public for its own safety, not to humiliate the offender."

    Governor George E. Pataki today announced that parents can now get up to the minute information about sexual predators through the State Division of Criminal Justice Services' website (criminaljustice.state.ny.us). The new service will allow the public to access the information on High-Risk (Level 3) Sex Offenders as soon as it is entered into the system. "Now, New Yorkers will have quick and easy access to this vital information in order to make informed, responsible decisions about the safety of their children. This free resource will provide parents with the knowledge they need to help protect their children from sexual predators," said Governor Pataki. With the addition of the new website, the public now has three different options to find out if an individual is a registered sex offender. The other two are the Sex Offender Registry Information Line and the Subdirectory of High-Risk (Level 3) Sex Offenders, which is maintained at local police agencies. At Governor Pataki's directions, the Sex Offender Registry Information Line (900-288-3838) now costs only $.50 per call for up to five searches down from $5 per call. This service includes sensitive information regarding an offender's modus operandi, information that would be inappropriate to include on this website, which is easily accessed by children. A caller to the 900 telephone line can get this descriptive information in a confidential manner.

    Several developments in the past few months have suddenly made it possible for any youth-serving nonprofit to quickly find out if any of its volunteers have been convicted of child molesting or other crimes.
    Little League Baseball last month announced one of the most sweeping policies of any national youth agency, mandating that each of its more than 1 million volunteers be checked against state sex offender registries. Little League has created an Internet-based system to make that process easy, and left it open for use by anyone.
    Pop Warner Football said it will soon adopt the same policy for its 37,000 volunteers.
    The cost: Most of the sex offender registries are free, and the ChoicePoint checks start at $1.50. ChoicePoint says it will offer the same deal to any nonprofit in the country.
