Sex Offender Registry Information - Registration and Community Notification
In accordance with Megan's Law and The Jacob Wetterling Act, all 50 states are required to register sex offenders and perform community notification. However, each state differs in terms of how it administers its community notification process, what offenders are required to register, the duration of registration, what information is registered, how the information is shared, whether the public has access to the registry, who is granted access, methods of access, what information is shared - and that's just for starters.
Depending on the state, you may be able to obtain information from your state, city or county online registry, police department, sheriff's office, phone hotline or another agency in order to obtain information on specific offenders, information on all offenders in the state or a specific geographic location or you may be able to search the entire registry or part of it on such criteria as an offense type, physical characteristics, name, zip code and age.

Obtaining a Criminal Record
If you are trying to learn the criminal history of an individual, there are a number of available options. If you are concerned that the individual may be a sex offender, you may look them up in the public registry required under " Megan's Law ". If you are trying to check to see if somebody is incarcerated, many state departments of corrections now have "inmate lookup" features on their websites. (Note that a state department of corrections search will not include people incarcerated in a county jail, nor would they reveal federal convictions.) Some states will list all persons who have been incarcerated with, or placed under the supervision of, the state department of corrections, enabling you to find out at least of an individual has committed a crime of sufficient gravity to be placed in prison or on parole. private investigator or background investigation service do a full criminal background check on the individual in question.

Confidentiality Provisions for Registered Sex Offenders in California and Massachusetts
Introduction
In 1947, the state of California established America's first sex offender registry to help monitor the whereabouts of dangerous sex offenders living within its borders . In the 52 years since, the other forty-nine states have also passed legislation that requires released sex offenders to register with local law enforcement in the area in which they establish residence . Until 1996, the information contained in California's registry (and others) was available only to law enforcement agencies. The concern was that the public release of such information might violate the offender's right to privacy and to live without fear of discrimination. According to Dan Lungren, former Attorney General of the state of California , "Until now, sex offenders have been just about the most protected class of convicted criminals on the streets" Lungren and other supporters of publicly available registry information claim that by releasing that information, we better equip people to protect themselves and their children from sexual predators. The issue, like any that pits personal privacy against public safety, is far from simple. Sixty-two percent of states have chosen to err on the side of caution, including no provisions to protect the privacy rights of convicted sex offenders. In the 38% of states that do have such provisions, the degree of protection and the mechanisms used to ensure it vary greatly.

The Michigan State Senate is currently considering its list to remove the names of teenagers who had consensual sex with someone close in age One really has to question why the social stigma of a dangerous predator should be attached to teenagers who have consensual sex. Comments FWIW, in Missouri back when I was in practice, the criminal code had been revised so that minors having sex with other minors close in age could be charged only with lesser degrees of "sexual misconduct", and were not stigmatized with charges of "statuory rape". I don't know it it was intentional or not, but the way the relevant statute was written, there was a one year legal window: it was totally legal (i.e., there was no statute making this a criminal offense) for a 16 year old to have consensual sex with another 16 year old. April 5, 2004 2004-R-0371 BACKGROUND CHECKS FOR LITTLE LEAGUE VOLUNTEER COACHES By: Veronica Rose, Principal Analyst You asked for background information on the requirement for background checks on Little League coaches and others dealing with league players and why the State Police are charging for the checks. SUMMARY Little League regulations for the 2003 season (1) require Little League volunteers and employees to undergo annual background checks and (2) prohibit people convicted of any crime against or involving minors from participating as volunteers or employees in Little League programs. Volunteers and employees must complete a league application consenting to the check, and the league must complete the check before they assume any duties. Until the 2003 session, background checks were optional. http: //www. sor. state. ct. us/pls/sor/wsor$ offender. startup?Z_CHK=0 Applicants who do not submit the required application and undergo annual background checks cannot participate in league programs, and leagues that do not comply with the regulations may lose their charter, tournament privileges, or both. By law, the fee for conducting state criminal background checks, which are conducted by the State Police, is $ 25 (CGS § 29-11(c). But under federal law, the maximum that states or the Federal Bureau of Investigation (FBI) may charge for fingerprint-based checks on volunteers is $ 18. The federal law does not set a fee for searches based on name and date of birth. Connecticut charges league volunteers and employees $ 18 for both types of search, plus the fingerprinting fee, which by law is set at $ 5 when taken by the State Police. By law, the State Police must waive the criminal background check and fingerprinting fees for state, local, and federal agencies (CGS § 29-11(c)). Local departments set their own fingerprinting fee policies. Some waive the fee for volunteers.

    (CNSNews.com) - Should convicted criminals, who claim they are not dangerous, have the right to a hearing before they are listed in a state sex-offender registry? What about individuals who served time prior to the enactment of such laws?
    Those questions, in two cases to be heard by the U.S. Supreme Court this fall, could determine the constitutionality of so-called "Megan's laws," which typically list convicted sex offenders in registries available for the public to view.
    In Connecticut Department of Public Safety v. Doe, two Connecticut men claim they should have the right to a hearing before their names are included in the state's sex-offender registry. The state law requires criminals convicted of most sex-related crimes to supply information about themselves, which is then posted on a public website.
    The two men, however, claim they should not be judged by their past actions, but rather their "current dangerousness." Two lower courts sided with the men, ruling that they should be afforded the rights of a hearing.
    On the same day, Nov. 13, the court will hear Smith v. Doe, a challenge to Alaska's sex-offender registry law. Two convicted sex offenders and the spouse of a sex offender brought the lawsuit, claiming the Alaska law unfairly punished them. The sex offenders argued they had already served their time and, therefore, they did not have to abide by the law.
