What about individuals who served time prior to the enactment of such laws? Those questions, in two cases to be heard by the U.S. Supreme Court this fall, could determine the constitutionality of so-called "Megan's laws," which typically list convicted sex offenders in registries available for the public to view. In Connecticut Department of Public Safety v. Doe, two Connecticut men claim they should have the right to a hearing before their names are included in the state's sex-offender registry. The state law requires criminals convicted of most sex-related crimes to supply information about themselves, which is then posted on a public website. The two men, however, claim they should not be judged by their past actions, but rather their "current dangerousness." Two lower courts sided with the men, ruling that they should be afforded the rights of a hearing. On the same day, Nov. 13, the court will hear Smith v. Doe, a challenge to Alaska's sex-offender registry law. Two convicted sex offenders and the spouse of a sex offender brought the lawsuit, claiming the Alaska law unfairly punished them.
