Criminal and Sex Offender Registry Search Tool
Now Available to Local Little Leagues
Little League has joined with Rapsheets.com to provide local Little Leagues with a special Internet site that allows members to search a national database of more than 120 million criminal records - instantly - for $1.50 per name, and with no maintenance fee. The site provides searches of criminal records from 38 statewide databases and Washington, D.C., including Sex Offender Registries from 29 states and the District of Columbia. Normally, this service is $19.95, with an additional monthly maintenance fee. Little League requires local leagues, at a minimum, to search Sex Offender Records in the state in which certain volunteers live. Those volunteers are Managers, Coaches, Board of Directors members and any other persons, volunteers or hired workers, who provide regular service to the league and/or have repetitive access to, or contact with, players or teams. The special Internet site, available only to Little Leagues, may uncover violent criminals who could pose a potential danger, so Little League Baseball encourages the use of this Internet database. The background checks on Rapsheets.com meet or exceed the requirements set forth in Regulation I (c) of the Little League Official Regulations and Playing Rules for all states except California, Hawaii, Massachusetts, New Hampshire, South Dakota and Vermont.

Court finds sex offender registry law unconstitutional
  • The high court barred local police departments and the state's Criminal Justice Data Center from releasing information on sex offenders to the public.
Information on convicted sex offenders is no longer available to the public in Hawaii after the state's Supreme Court struck down portions of its sex offender registration law as unconstitutional on Nov. 21. The court held that Hawaii's version of Megan's Law, which requires convicted sex offenders to register with local law enforcement agencies and requires those agencies to publish personal information about the offender, violates an offender's due process rights guaranteed by the state constitution. All county police departments and the Hawaii Criminal Data Justice Center promptly removed the sex offender registries from their Web sites and public access terminals with notification that, due to the court ruling, the sex offender registry is no longer available for public viewing. Prior to the ruling, the center made sex offender registries available by ZIP code and by street address. All sex offenders living in a particular ZIP code or on a particular street could be called up through the Web site or through public access terminals at the center. Now, only criminal histories on requested persons are given out since they are public records. There is a statutory $15 charge for each criminal history for any member of the public, including the media.

  • Supreme Court to Hear Megan's Law Cases. On Wednesday, November 13, the Supreme Court will hear arguments in two cases determining the constitutionality of posting Megan's Law registries on line. In August, EPIC filed an amicus brief (PDF), urging the Court to hold that the Alaska Megan's law statute violates the Ex Post Facto clause of the Constitution because the mandatory online dissemination of a sex offender registry is excessive when weighed against the statutory purpose of protecting people in the geographic vicinity of released offenders. In tomorrow's consolidated hearing, the Court will also review the Second Circuit's determination that the Connecticut Megan's Law violates procedural due process. (Nov. 12)
    EPIC Files Amicus Against On-Line Offender Registry. EPIC filed an amicus brief (PDF) with the Supreme Court, urging the Court to uphold the circuit court's decision that the Alaska Megan's law statute violates the Ex Post Facto clause of the Constitution. In a separate ruling, the court turned back a challenge from sex offenders who argued they deserved a chance to prove they aren't dangerous to avoid having their pictures and addresses put on the Internet. The decisions came in the Supreme Court's first review of what are known as Megan's laws. They have far-reaching implications because every state and the federal government have sex-offender registry statutes. The laws are named for 7-year-old Megan Kanka, a New Jersey girl kidnapped, raped and killed in 1994 by a convicted sex criminal who lived in her neighborhood.

THE AMERICAN Civil Liberties Union, one of the more prominent critics of online sex offender registries, argues against any sort of community notification - calling it double punishment and a violation of privacy rights.
Critics also say the registries can incite vigilantism and harassment. But others point out that such harassment is rare and no incidents have yet been linked to online registries. And each online site carries a standard warning that it is illegal to use any of the information on the sites to harass offenders.
Megan's Law expanding to the Internet
The Washington State Institute for Public Policy conducted the only study of the issue and found harassment to occur in only about 3 percent of notifications in the state and in most of cases it was nonviolent, such as picketing. However, in one case the home an offender was preparing to move into was burned down.

Panel moderator Prof. Kim Forde-Mazrui Rick Moore, Deputy Commonwealth Attorney for the City of Charlottesville, estimated that 50 percent of his cases while serving as an Augusta County prosecutor from 1986-95 were child sex crime cases. "Child sex abuse cases are really among the worst and most tragic cases we're involved in," said Moore, who runs the Law School's Prosecution Clinic. He added that they're also among the most difficult to prosecute, for a number of reasons: you're dealing with a child witness, the case involves emotional incidents and people, there is real physical and emotional harm done, family dynamics can complicate cases because the offender is often a family member, and a "language barrier" makes it difficult to communicate and get information from children.

    What new charge allows law enforcement officers to intervene in such incidents? All three individuals failed to register as sex offenders in Los Angeles, California. With the implementation of the Federal Violent Crime Control and Law Enforcement Act of 1994, [1] all 50 states must establish sex offender registries. [2] While California has had sex registration laws in effect since the 1940s and, as a result, has documented over 84,000 convicted sex offenders, the act elevated the penalty for failing to register as a sex offender to a felony, making punishment for this crime more severe. Moreover,, if the previous sex crime was a felony, the subsequent failure to register became a felony with a mandated prison term. [3] California courts consistently have upheld the concept that sex offender registration promotes the state's interest in controlling crime and preventing recidivism in sex offenders. [4] They also hold the opinion that sex offenders pose a continuing threat to society and require constant vigilance. [5] The California State Legislature, in enacting Penal Code Section 290, found and declared that "sex offenders pose a high risk of engaging in further offenses after release from incarceration or commitment, and protection of the public from these offenders is a paramount public interest." [6]

    Sex Offender Registry Information - Registration and Community Notification
    In accordance with Megan's Law and The Jacob Wetterling Act, all 50 states are required to register sex offenders and perform community notification. However, each state differs in terms of how it administers its community notification process, what offenders are required to register, the duration of registration, what information is registered, how the information is shared, whether the public has access to the registry, who is granted access, methods of access, what information is shared - and that's just for starters.
    Depending on the state, you may be able to obtain information from your state, city or county online registry, police department, sheriff's office, phone hotline or another agency in order to obtain information on specific offenders, information on all offenders in the state or a specific geographic location or you may be able to search the entire registry or part of it on such criteria as an offense type, physical characteristics, name, zip code and age.
