- Deputy Attorney General James B. Comey, Assistant Attorney General Christopher A. Wray of the Criminal Division, Federal Bureau of Investigation Director Robert Mueller, and Enron Task Force Director Leslie R. Caldwell announced today that a federal grand jury in Houston has indicted former Enron Corp. Chief Executive Officer Jeffrey K. Skilling on charges of conspiracy, securities fraud, wire fraud and insider trading. A superseding indictment returned by the grand jury in Houston yesterday charges Skilling, 50, with conspiracy to commit securities fraud, 20 counts of securities fraud, four counts of wire fraud and ten counts of insider trading. Former Enron Chief Accounting Officer Richard Causey, who was originally indicted last month, was also charged in the superseding indictment with conspiracy to commit securities fraud, 20 counts of securities fraud, eight counts of wire fraud, and two counts of insider trading. Skilling surrendered this morning to agents of the Federal Bureau of Investigation in Houston, after the indictment was unsealed. Skilling had an initial appearance this morning before Magistrate Judge Frances Stacy.

Court TV NEW YORK In a 23-page decision, Judge Miriam Cedarbaum dismissed one count of securities fraud against Stewart, which alone could have carried a 10-year sentence. The ruling marks a tremendous victory for Stewart's defense, as lawyers prepare for closing arguments set to begin Monday. Prosecutors had alleged Stewart committed securities fraud when she maintained her innocence in the midst of the investigation in press interviews and at a midyear meeting for Martha Stewart Living Omnimedia (MSLO) before analysts and investors. The government had set out to argue that Stewart's statements were not only false, but that they were intended to prevent the stock price of MSLO from plummeting. "I hold that a reasonable juror could not, without resorting to speculation and surmise, find beyond a resonable doubt that Stewart's purpose was to influence the market in MSLO securities," Cedarbaum wrote in her decision.

Section 804 Statute of Limitations for Securities Fraud
  • In General. Section 1658 of title 28, United States Code, is amended
  • by inserting "(a)" before "Except"; and
  • by adding at the end the following:
    "(b) Notwithstanding subsection (a), a private right of action that involves a claim of fraud, deceit, manipulation, or contrivance in contravention of a regulatory requirement concerning the securities laws, as defined in section 3(a)(47) of the Securities Exchange Act of 1934 (15 U.S.C. 78c(a)(47)), may be brought not later than the earlier of "(1) 2 years after the discovery of the facts constituting the violation; or "(2) 5 years after such violation.".
  • Effective Date. The limitations period provided by section 1658(b) of title 28, United States Code, as added by this section, shall apply to all proceedings addressed by this section that are commenced on or after the date of enactment of this Act.

    Massachusetts securities regulators have accused Morgan Stanley Dean Witter MWD: (NYSE) of offering its brokers improper incentives for selling its own funds to investors. On August 11, 2003, Massachusetts Secretary of State William Galvin announced at a press conference that Morgan Stanley encouraged brokers to sell company-owned mutual funds by offering cash prizes and incentives, violating the state’s anti-fraud provisions. Galvin’s investigation uncovered that Morgan Stanley’s overly aggressive sales practices earned the company between $5 million to $8 million in commission and fees since January of 2003
    Regulators say Morgan Stanley ran sales contests internally to fuel sales of its own in-house mutual funds. Morgan Stanley Dean Witter Brokers were grouped into teams and allegedly competed against each other to generate the most sales and were illegally rewarded for their achievements.

    After a competitive bidding process and the filing of extensive pleadings and a hearing before the United States District Court, Lieff Cabraser, was appointed to serve as Lead Counsel for a class of persons and entities who allege securities fraud by Network Associates, Inc. during the period January 20, 1998 through April 6, 1999.
