Introduction
Real Estate brokers have traditionally acted as the agent of either a seller, or buyer, or both. An agent is usually defined as a person one who represents another person, called a principal, in dealings with third persons. The legal rules which govern agency are simple in concept, but have often proved difficult to apply. The principles of agency have their roots in "common law." Common law developed in England primarily from judicial decisions based on the long term benefit of society. Common law adapts as the community and society changes. Throughout the United States (with the exception of Louisiana which derives its laws from the French), common law forms the basis of each state's legal system. Generally speaking, the common law is in force except as specifically modified by statute or by a state's constitution. To codify, clarify, change, limit and/or expand common law principles, each state (other than Louisiana) has passed statutes.

Introduction Lithuanian legal system is based on the principles of ownership protection and freedom of contract and establishes secure and attractive legal framework for foreign and domestic investment into real estate. Current laws provide a number of legal instruments in the sphere of real estate law, e.g. rights in rem, connection between the land and buildings, free disposal of any type of real estate. Real Estate Secured Lending Secured lending is a procedure where the creditor secures the loan with property that is monetary value. For example, if you go into a bank to borrow money to purchase a home, then the home is the security that is placed as collateral with the in exchange for the bank loaning money to the homeowner. If the homeowner fails to pay the debt, then the bank can repossess the home. There are legal requirements that secure the interest must be filed in real estate records in the County Courthouse. There may be more than one security interest file in any given property. Generally, the first to file their security interest would prevail over any second party who filed a security interest. One should consult a real estate attorney concerning these highly complex matters. Subleases and Assignment of Leases Subleases involve the right of a tenant to enter into a separate agreement to lease the tenant's property rights to a third person. Whether a person has the right to sublease their property rights is determined by the terms and conditions of the lease agreement. Most lease agreements do not provide for subleasing unless written authorization is obtained from the landlord. An assignment of a lease is an agreement where one person assigns their right to another person with respect to their obligations under a contract. For example, if you want to get out of a an automobile lease, you might be able to enter into an agreement with a third party. The third party would assume your leasing obligations. You'd only be able to do this though if the automobile leasing company agrees to it.

    • According to legislation signed by the Governor on November 13, effective March 1, 2002, all sellers of residential real property improved by a 1-4 family dwelling must provide a disclosure statement to buyers (in the form set forth in the statute) regarding the property conditon prior to the buyer signing a contract. The seller must also revise the statement upon acquiring knowledge that some part of it has become materially inaccurate. Certain types of property are exempt, including cooperative and condominium units. The sellers' failure to provide such disclosure statement will result in the buyer receiving a $500 credit against the purchase price at closing.
