Quebec’s Tax and Regulatory Burden (July 2003)
In his inaugural address opening Quebec’s 37th legislature, newly elected Premier Jean Charest stated that “we have reached the end of a certain way of doing things.” He said taxes must be lowered not just for the pleasure of it but “because it is necessary, because our tax load is an obstacle to our development.” Similarly, regulation must be lightened and simplified because “there exists a tangle that poisons life for entrepreneurs, serving the interests neither of citizens nor of business.”
What exactly is the current situation? What is the weight of this tax and regulatory burden that people in Quebec are forced to bear? Government activity does not result solely in costs, of course – it also brings some advantages. The main point of this Economic Note is not to calculate the net cost (or advantage) of government activity nor to compare Quebec’s situation with those of neighbouring provinces and states but rather to indicate the size of this burden and to give a clearer idea of the challenge awaiting the new government.
The tax burden
On an overall basis, taking every tax into account, the average Quebec resident hands over more than 40% of what he or she earns to the tax collector. Income tax is the showpiece of the tax system that people in Quebec are subjected to, but it forms just one part of the total burden. Many other taxes are added on, at every level of government.

Introduction
At 9 P.M. Eastern Standard Time the Premier of Quebec held a press conference to announce that the Government of Quebec would be holding a referendum on the future of Quebec's position within the Canadian federation. The citizens of the Province of Quebec will be asked if they want to; "start the process toward becoming a recognized nation state, whereas its people, language, culture and political institutions will be able to protect their own identity within the global community." The question posed to the people of Quebec does not give them any other options other than "Yes" they agree with the latter statement or "No" they do not want the Government of Quebec to proceed with this process towards state hood.

QUEBEC SOVEREIGNTY AND CANADIAN NATIONAL UNITY In August 1998, the Supreme Court of Canada delivered one of its most important decisions on the Canadian Constitution. The government of Canada had sent a reference case about the legality of Quebec secession. The government posed three questions to the Court:
  • Under the Constitution of Canada, can the National Assembly, legislature, or government of Quebec effect the secession of Quebec from Canada unilaterally? Does international law give the National Assembly, legislature, or government of Quebec the right to effect the secession of Quebec from Canada unilaterally? In this regard, is there a right to self-determination under international law that would give the National Assembly, legislature or government of Quebec the right to effect the secession of Quebec from Canada unilaterally? In the event of a conflict between domestic and international law on the right of the National Assembly, legislature, or government of Quebec to effect the secession of Quebec from Canada unilaterally, which would take precedence in Canada?
In the end, the Court declared that neither the Quebec government nor legislature have a legal right under Canadian constitutional law or under international law to unilaterally secede from Canada. However, the court also emphasized that the rest of Canada would have a political obligation to negotiate Quebec's separation if a clear majority of that province's population voted in favour of it.

1993 (not graded) 1994 Grade: D 1995 Grade: C+ 1996 Grade: C+ The Quebec government is holding at its grade of C+, with efforts for biodiversity bringing up a poor mark for protected areas. This year the Quebec government released a final Biodiversity Strategy and Action Plan after public consultation. Reaction from Quebec's environmental community has been quite favourable. Clearly, the presence of the international United Nations Secretariat for the Biodiversity Convention, in Montreal and partially funded by the provincial government has had an impact. Quebec also has the most recently minted of any province's endangered species legislation. (Only Quebec, New Brunswick, Ontario and Manitoba have any legislation to protect species.) Currently, there are only nine listed species, and all plants. While the conservation community expects more plants to be added soon, and potentially two animals, there remains concern that the listing of species is too dependent on political discretion and the governments agenda. All promoters of projects are required to take into account the list of species at risk and submitted to the government authorisation. While the government has created several new protected areas and ecological reserves this year, their progress over-all has been slow. Work is just starting to develop a map based on gap analysis to identify those ecological areas which have been adequately represented in a protected areas system and those which have not. Quebec has received credit though from World Wildlife Fund for its work in marine protected areas, particularly for their draft natural regions framework for the St. Lawrence River and the release of the management plan for the Saguenay-St. Lawrence Marine Park.

This protection is maintained while senior citizens and those on social assistance are struggling with insurance premiums and co-payments for their drug plans that have been increased again in 2002. Quebec is currently the sole province that does not automatically reimburse only the lowest-priced drug available. Brand-name drugs are purchased for 15 years on the provincial formulary, regardless of whether a lower-cost generic alternative is available. In many cases, by the time the 15 years has expired and generic-only reimbursement is put in place, the drug has been replaced by a newer, more expensive medication. OTTAWA - September 3, 1999 - Environment Minister David Anderson and Foreign Affairs Minister Lloyd Axworthy today welcomed the announcement that the Government of Quebec plans to introduce legislation this fall, regarding temporary measures, to prohibit large-scale removals of freshwater from that province. "I am encouraged by this progress and applaud Quebec's decision," said Minister Anderson. "We all share a common interest in protecting our fresh water. I look forward to working with Quebec and all other provinces and territories this fall towards an agreement for a Canada-wide Accord to prohibit bulk water removals, including removals for export, from Canadian watersheds." For its part, the Government of Canada intends to support the Accord within its own jurisdiction. The Honourable Lloyd Axworthy, Minister of Foreign Affairs will be introducing amendments to the
