On December 13, 1998 a referendum was held in Puerto Rico and the option "None of the above" won with over one-half the vote. "Territorial" Commonwealth earned 993 votes (0.1%); Free Association, 4,536 (0.3%); Statehood, 728,157 (46.5%); Independence, 39,838 (2.5%); None of the above, 787,900 (50.3%); and blank and void ballots, 4,846 (0.3%). "None of the above" won a majority of 59,743 votes over statehood. 1,566,270 of the 2,197,824 registered voters cast ballots, for a turnout rate of 71.3%. PUERTO RICO IN 1898
Of all Spanish colonial possessions in the Americas, Puerto Rico is the only territory that never gained its independence. Internal and geopolitical dynamics during the last quarter of the nineteenth century, nevertheless, brought dramatic political, social, and economic changes to the island, setting the stage for the development of its national institutions and the transformation of its political system as a United States territory during the twentieth century. After four centuries of Spanish colonial rule, the period between 1860 and 1898 witnessed a pro-independence rebellion, colonial reform, the establishment of the first national political parties, the abolition of slavery, and a short-lived experiment in autonomy under Spanish rule. The political and military strategies of a decaying Spain and the emerging regional power of the United States at the end of the nineteenth century, however, placed Puerto Rico, along with Cuba , at center stage in the Caribbean. The dynamics of this power imbalance culminated in the formal transfer of the island to the United States in 1898 at the end of the Spanish-American War. Last Decades under Spanish Rule.

    Populated for centuries by aboriginal peoples, the island was claimed by the Spanish Crown in 1493 following Columbus' second voyage to the Americas. In 1898, after 400 years of colonial rule that saw the indigenous population nearly exterminated and African slave labor introduced, Puerto Rico was ceded to the US as a result of the Spanish-American War. Puerto Ricans were granted US citizenship in 1917 and popularly elected governors have served since 1948. In 1952, a constitution was enacted providing for internal self-government. In plebiscites held in 1967, 1993, and 1998 voters chose to retain commonwealth status.

Settled by explorer Juan Ponce de Leon, the Island was a Spanish possession for over four centuries. Puerto Rico came under United States sovereignty by thr Treaty of Paris signed on December 10, 1898, terminating the Spanish-American War. Puerto Ricans have been US citizens since 1917. In July 1950, the US Congress enacted Public Law 600. It provided that existing laws which defined the political, economic, and fiscal realtionship between Puerto Rico and the United States should remain in full force. It also authorized Puerto Rico to draft and approve its own Constitution, which took effect on July 25, 1952. Puerto Rico's relationship with the US is referred to as commonwealth status. Political Trends For many years there have been two major views in Puerto Rico with respect to the Island's relationship with the United States, one favoring commonwealth status and the other favoring statehood. A small group supports independence for Puerto Rico. Voters supporting a continuing relationship for Puerto Rico with the United States Mainland have dominated Island elections over the years. Part of the USA Puerto Rico is part of the US. There are no travel restrictions to other US areas and no customs duties or quotas on shipments between Puerto Rico and the US Mainland. Products manufactured in Puerto Rico are "Made in the USA". The people of Puerto Rico do not vote in national elections. They are represented in Congress by a Resident Commissioner who has a voice in the House of Representatives but no vote. Most federal taxes are not levied in Puerto Rico. No federal income tac is collected from island residents on ordinary income, except in cases of Federal employees.

    The question whether or not the legislation of 1900 made Puerto Rico an integral part of the United States came before the Supreme court in the form of a group of commercial cases which turned on points testing the validity of the new colonial policy.
    This firm sued Collector Bidwell of New York to recover the duties. The case was dismissed in the lower court on a demurrer and from this an appeal went to the Supreme Court of the United States.
    But the government is not sovereign. The great salient fact, which those who contend for the government's position now do not recognize, is that the people of the United States are sovereign and that the government is not, which is the great fact that distinguishes the constitutional law from that of most of the civilized nations of Europe. It did not make the United States a crippled nation, as the Attorney-General suggested, but a nation which has permanently protected itself against usurpations against its own agents.
    In another of these test cases Ex-Secretary Carlisle appeared in support of the following contentions:
    First, at all time since of the ratification of the treaty Puerto Rico has been a part of the United States.
