Print Friendly Email Article Although it is frequently attacked as an elitist institution with no regard for the public will, the Supreme Court is hardly immune to cultural and political trends. Justices are, after all, appointed by presidents with particular ideological agendas, shaped partly by polls. Once they ascend to the bench, a few appointees may surprise and disappoint their political patrons, but many do not. So, at least indirectly, the political preferences of voters wield considerable influence on the Court. It was no coincidence that the Supreme Court toyed with invalidating capital punishment in the early 1970s, when public support for it was relatively low; it's not surprising that as support for the death penalty has increased (along with the conservative hold on government), the Court has committed itself to expediting executions. Everson v. Board of Education of Ewing Township

At issue is a New Jersey statute that subsidizes transportation for students attending parochial schools. The Supreme Court holds that the use of public funds to reimburse parents for the cost of sending children to parochial schools is not unconstitutional since bus transportation is clearly separate from the religious mission of the school. The decision is the Supreme Court’s first and most comprehensive statement about the meaning of the Establishment Clause.
McCollum v. Board of Education
The Supreme Court considers an Illinois state plan whereby students are given "release time" for religious instruction during the school day. The plan allows for religious teachers to come into the schools and conduct religious classes for students with permission slips. The Court finds the plan unconstitutional in that allowing religious teachers into public schools gives them a "captive audience" for state-sponsored religious instruction in violation of the Establishment Clause. Private, Parochial Schools Now Eligible
Hafer also noted further program improvements are pending. The TAP Enhancement Act, which has unanimously passed the state Senate and is in the House, will make TAP the only state-sponsored plan that both guarantees to match tuition inflation and make it possible for accounts to grow faster than inflation. The bill would also create an investment program - with earnings tied to the performance of the financial markets - to run side by side with the existing program.

The south central Pennsylvania region encompasses Dauphin, Cumberland, and Perry counties as well as regions of Lebanon, Lancaster and York counties. E-mail this article Subscribe to this paper Larger Smaller Text By Debra Erdley TRIBUNE-REVIEW Sunday, March 24, 2002 Pennsylvania's $30 million education tax credit program, which received little attention as it was being passed into law, may go down as the shot that no one heard. Since last year, the tax credit law crafted by a coalition of school choice activists has taken off with a bang, as business after business (more than 1,000 to date) stepped forward to embrace the notion of sending money directly to scholarship funds rather than the tax collector. Clive Belfield, a professor at the Teachers College of Columbia University, said even though education tax credits are only five years old, they have already spread to six states. Tax credit bills are pending in six more states and President Bush has proposed one at the federal level.
