Foreword
More than a decade of standards-based reforms have altered almost every aspect of education policy in the United States, including Pennsylvania, but have largely ignored the continuing role of local policymakers. Although state and national policymakers have dictated more and more of the K-12 public education agenda, The Education Policy and Leadership Center (EPLC) believes it is imperative to consider how to strengthen the work of school boards that will continue to play a vital role in the operation of the public education system.
EPLC began a study of school district governance in July 2003 in an effort to address two issues: improving the effectiveness of school boards and increasing the number of citizens who are motivated and prepared to serve on boards. This report reaffirms the importance of elected boards as trustees of the public school system and representatives of their communities, while serving as public officials established and delegated significant duties by state government. They increasingly are the intermediary between a school system with its resource needs and a public that sometimes does not fully appreciate its duty to educate all of its children. These roles appear to conflict from time to time, challenging each school director to be informed, thoughtful, and dedicated to the effectiveness of the school system and the interests of the children it is intended to serve.

Phillips today said the Pennsylvania School Boards Association’s endorsement of Governor Edward G. Rendell’s proposed major education investments sends a clear message about the need for reform of the state’s educational system. “The members of the PSBA deal with local education issues every day. To get their stamp of approval on the Governor’s proposals is a strong confirmation that these are the tools we need to improve our schools,” said Phillips, who joined Governor Rendell, PSBA Executive Director Thomas Gentzel and President Ed Godin at a morning news conference to announce the endorsement. Citing the $1.5 billion to help school districts reduce property taxes and the $1.3 billion for new educational programs, Godin commended the efforts of the Governor. “In any year, they would be admirable for their purpose and their scope, but especially so in this year when so many states either are reducing or simply maintaining their financial commitment to public education,” said Godin, who is also a school board member from the Bristol Township School District in Bucks County. In addition to the education components of the Governor’s Plan for a New Pennsylvania, the Governor’s Plan would use $2 billion in state bonds and loan guarantees to leverage $5 billion in new economic development investments to create jobs and strengthen Pennsylvania’s economy. # # #

NEW COLORADO EDUCATION LAWS IMPACT CHARTER SCHOOL AUTHORIZATION.
The Colorado State Board of Education will have the power to approve charter schools under a new bill signed into law by Gov. Bill Owens. Under the new charter program, charter school organizers will be able to bypass local school districts that reject or refuse to hear requests to set up charter schools. The law, created in response to several districts where local boards have restricted new charter schools, also creates a charter school institute as an agency of the state department of education. Two additional laws were also approved concerning charter schools. One requires greater accountability for charter schools and their authorizing districts, while the other creates a system for monitoring student academic progress over time.

Cmwlth. 2002) Facts of the Case The Pennsylvania Schools Boards Association, Inc., Cameron County School District, Butler Area School District, Mars Area School District and the Pocono Mountain Area School District petitioned against Charles Zogby, the Secretary of Education, Pennsylvania Department of Education, Western PA Cyber Charter School, Commonwealth Cyber Charter School, T.E.A.C.H. Charter School and the PA Virtual Charter School. The school districts filed the petition after the Department of Education sent letters to them stating it would withhold state education subsidies from those districts that refused to pay tuition bills submitted by cyber charter schools. The Secretary eventually withheld money from numerous districts after cyber charter schools submitted unpaid invoices. The school districts challenged the withholdings because they questioned the legality of "cyber" charter schools under the Charter School Law. original jurisdiction while Count IV was addressed to Commonwealth Court's appellate jurisdiction.

Print photo Dr. Eugene W. Hickok is the United States Deputy Secretary of Education. President Bush named him to the position on April 19, 2004. Hickok had served since July 2003 as both under secretary of education and acting deputy secretary of education. The deputy secretary is the chief policy advisor to the secretary. In this position, Hickok oversees and manages the development of policies, recommendations and initiatives that help define a broad, coherent vision for achieving the president's education priorities, including the No Child Left Behind Act. Prior to his appointment, Dr. Hickok was Pennsylvania's Secretary of Education, responsible for overseeing the state's education system - kindergarten through college. A powerful advocate for parental choice and accountability in education, Dr. Hickok helped implement a sweeping education-reform agenda. Pennsylvania now has higher standards for students and teachers; a strong accountability system; locally designed charter public schools; stronger reading, literacy and library programs; and a model education technology initiative. He also served on the boards of trustees of Pennsylvania's four state-related universities, and on the State System of Higher Education's Board of Governors. During his six years as Secretary of Education, Dr. Hickok also testified before the Pennsylvania General Assembly and the U.S. Congress about Pennsylvania's education policies and initiatives.
