Hillary Clinton addressing the 1996 Democratic Convention "Parents give up their rights when they drop the children off at public school." Texas Federal District Judge Melinda Harmon " Y ou are not welcome at this school," warned the second-grade teacher. "We feel that you are criticizing and watching over our shoulder." Stunned, the Kansas mother listened. She had voiced her reluctance to let her daughter attend an "historical" play that touted hypnotism and spiritism. Didn't she and her husband have the right to raise their daughter according to biblical guidelines? Apparently not in the eyes of local educators. They are not alone. A Colorado mother was "expelled from the school grounds" for sharing her concern over the earth-centered spirituality taught as part of environmental education. Two New York mothers faced ridicule for objecting to the use of Magic Gathering-a psychologically addictive occult card game-to teach math. It didn't matter that the elementary age students would "summon" the ghostly forces shown on the cards they collected, calling out "spirits, enter me." In 1988, parents in San Ramon, California, resisted the classroom use of R-rated movies. The movies were stopped-for a season. But four teachers, the local teacher's union, and the California Teachers Association sued the school board and superintendent for (1) violating their constitutional right to free speech in the classroom and (2) for allegedly heeding the religious view of a small minority of citizens. The teachers won. On May 18, 1990, a California Superior Court decided that a teacher's constitutional rights supersedes the concerns of parents and the school board.

Current Status On September 18, 2003 a public hearing will be held by the Joint Committee on Education, Arts, and Humanities! Lots of parents from across Massachusetts were there to give horrifying testimony about the homosexual agenda in their childrens' schools. The Committee will meet any day now and decide the fate of H1445 . Either it "lives" and is sent on to the House or it "dies" and is sent to "a study." Once a bill is sent "to study" it is essentially dead.

What's Wrong With "Parental Rights"?
Spring 1996 A divisive campaign is snowballing around the country. It wrongly assumes that educators and parents are adversaries and books are the enemy. Watch for this campaign in your state; it's a camoflouge for censorship! ...Proponents of something called the "Parental Rights Amendment" are trying to amend all state constitutions and eventually the federal Constitution. The proposed amendment states: "The right of parents to direct the upbringing and education of their children shall not be infringed." ....What's wrong with this amendment? On first reading, it certainly sounds innocuous. As a parent, I want my rights...Why the fuss, then? The Religious Right insists that public school officials have some nefarious scheme for subverting "parental rights," primarily by choosing curriculum and other material that are at odds with their moral values. The bottom line of the Parental Rights Amendment is to give parents active in Religious Right groups a type of constitutional "trump card" to override any decision public schools make that they don't like. How would this work in practice? The Massachusetts legislature gave us one example two years ago when it considered a "parental rights" bill that required two weeks' written notice to parents whenever the children were to be involved in any teaching or activity deemed "controversial." These were not just the hot button topics of homosexuality and abortion, but everything from discussions of values to death and marriage. Worse, if parents did not affirmatively "opt in" every time actually filling out a form noting it would be all right for their children to be exposed to these topics their children were barred from participation.

Remarks by the President in a Conversation on Parental Options and School Choice Archbishop Carroll High School Washington, District of Columbia In Focus: Education 1:49 P.M. EST THE PRESIDENT: Thank you, John. Listen, I'm thrilled to be here. I love to come to centers of excellence. This high school is a center of excellence. (Applause.) It is a school that I was so pleased to hear that 98 percent of the senior class will be going on to higher education. (Applause.) That is a I would say that's what's called dashing false expectations, is the best way to put it. See, I would suspect that prior to coming to a place that demanded high standards and high excellence, people would say, well, these certain kids can't learn. See, there's an attitude in our society that, maybe certain children can't learn, so therefore let's have a system that just shuffles them through. But not at this school. This school believes in the worth and value of every child, that every child can learn. And therefore, this school is not afraid to raise expectations and set glorious heights and demand excellence. And as a result, you've achieved a startling achievement: 98 percent of the high school seniors are going to higher education. I want to congratulate you and congratulate Jim, congratulate the teachers, congratulate the parents (applause) but most importantly, congratulate the students. (Applause.) I appreciate you setting goals and making the right choices to achieve those goals.

UPFRONT-INFORMED PARENTAL CONSENT TV shows and movies can be rated. Internet screens can filter out objectionable material. We can opt our children out of Family Life/Health when there is a conflict of values, but the state requires English and History and encourages students to read books from the school library and suggested summer reading lists. A more effective method or procedure to address objectionable content in books used in our public schools than only the current retroactive challenge process is needed. For Family Life/Health class, in our county schools, the only instructional materials used are those identified and approved by the school administration. This is because it is recognized in Family Life/Health that there are controversial materials involved. These instructional materials are fairly constant from year-to-year. They are made available for review to parents, etc. both prior to, and after, school administration approval for use. The school may say that there are so many books that they cannot review them all. This remark is very concerning because it implies that the schools are not reviewing the books before they are used now. Well it’s the schools job to review instructional material. Some school systems have thousands of teachers and librarians and billion dollar budgets. Books need to be reviewed by your child’s teachers and librarians as part of the process of determining them appropriate for selection. You shouldn’t have to read every potential book your children could be assigned or pick up in the school library to determine if there is objectionable material. How can parents read all the books their children might encounter in the schools and still have time for their jobs and daily activities? It is part of the schools job to review books, and with so many books available it is unbelievable that in order to teach our children that so many books with controversial material are now chosen.

A BAD BOOK IN YOUR CHILD'S SCHOOL? You found your child had a book with vivid descriptions of sex, violence, vulgar language or something else objectionable to you. You have lots of questions. How dare the school allow this junk! Why? How did it happen? Are there other books like this? Why are they doing this to my child? To you, the parent, it definitely seems like the school is corrupting your child and undermining your values and parental rights. You knew violence and pornography were everywhere these days but you didn't know the schools were in the business. What other stuff will your child read in school? Some minimum standard of decency has been violated. You feel the school system is forcing their values (or lack of values) on you and your child. What should you do? Somebody, somewhere in the school system must have decided this book was good. Well you think it is bad. You think it inappropriate, obscene, vulgar, lacking educational value or merit, or containing too graphic violence, etc. You don't understand how this book could be considered appropriate. Are things like this going on in other schools in your county? Is this a systemic problem in the schools? You want to feel comfortable with your child in the hands of the school system. We parents entrust our children to the schools. We understand others values may be different than ours and we also understand that our children should and will be exposed to different ideas, but this has gone way over the line. Your trust has been betrayed by the schools.

The Changing Face of Parents’ Rights Ralph D. Mawdsley I. Introduction Since the latter part of the nineteenth century, courts have recognized the right of parents to make educational decisions for their children. Courts and legislatures have sought to balance the states’ authority to educate students with the parents’ natural authority to raise their children. However, the legal basis for such balancing of interests has changed. Parents’ rights have evolved over four historical periods and have been influenced in the past thirty years by changing perspectives concerning the rights of students, school boards, and justiciable causes of action. This article will be divided into two parts to discuss the changing face of parent rights in directing their children s education. In the first part, the article will examine the four historical periods of development referenced above, focusing on relevant court decisions. This examination of time periods will show that as the rights of parents to direct the education of their children have evolved, so also have the rights of students, school officials, and others in the education process. The second part of the article will examine how parents successes in asserting their rights against public schools have been affected by legal developments over the past thirty years. This section will analyze the extent to which the development of student rights and school board authority has affected claims by parents under new causes of action.
