Consideration of this legislation comes at a time when individuals throughout the United States are expressing concern about the failure of bilingual education programs, in general, to teach English to English language learners as quickly as possible. As you probably know, my own State of California, by a margin of 61 percent to 39 percent, voted to end bilingual education programs and to focus on teaching children English. During my years in Congress, I have heard many individuals, including parents, raise concerns about the current Bilingual Education Act and the fact that many children spend as many as six or seven years in classes using their native language in instruction, but still are not fluent in English. In addition, the U. S. Commission on Civil Rights, in their November, 1997 report states that "one aspect of Federal legislation over the past three decades has had adverse effects on schools’ development and implementation of education programs with a primary goal of placing students in regular education program to the greatest extent possible. This has been the emphasis on provisions that restrict the options schools may pursue in developing and implementing education programs. The Bilingual Education Act has placed restrictions on the types of programs that could be funded under the act, and these restrictions have, in turn, limited school districts’ options."
