By Roman Kupchinsky One of the pillars of the antiterrorism strategy of the United States has been to deny sanctuary to terrorists by cooperating with other states to take action against these international threats. But what if the followers of Al-Qaeda, expelled from their traditional sanctuaries in Afghanistan after 11 September and dispersed around the world, are now taking refuge in the Muslim ghettos of Berlin, Madrid, London, Paris, and other European urban centers? Is the above cited principle still valid under these new circumstances and, if not, what can be done to adopt it to a changing situation?
Prior to 11 September the European connection to Al-Qaeda was believed to be more of individual cells mainly in Germany and Spain and followers in Britain, with its members acting as recruiters for the jihadist training camps in Afghanistan. With the disappearance of those camps, there is evidence to show that the European cells went deeper underground and are now sanctuaries for trained cadre moving about the continent with missions to establish new, combat-ready squads of fighters trained in the techniques of urban terrorism.

The site linked to the e-mail looked identical to AOL’s billing center, until Yuhasz noticed the domain name was a fake a scam commonly known as phishing. Most people recognizing a possible scam would have deleted the message and moved on. But Yuhasz, a cybercrime specialist for the FBI, had other plans.

We are at the leading edge of what could become a serious threat to law enforcement and national security: the proliferation and use of robust digital encryption technologies. These technologies will be unbreakable, easy to use, and integrated into desktop applications and network services, including protocols for electronic mail, web transactions, and telephony. This paper discusses their impact on organized crime and terrorism. We begin by summarizing actual cases where encryption was encountered, the scope of the problem, and the methods used by law enforcement to deal with it. Our findings suggest that the total number of criminal cases involving encryption world-wide is at least 500, with an annual growth rate of 50-100%.

Chairman Oxley, Ranking Member Towns, and Members of the Subcommittee: I appreciate the opportunity to appear before this Subcommittee on behalf of the Securities and Exchange Commission ("SEC" or "Commission") to address the involvement of organized crime on Wall Street and the Commission's efforts to end this involvement. The Commission commends the Chairman, the Ranking Member, and the Members of the Subcommittee for holding hearings on this important topic. These hearings are particularly timely in light of the announcement this past June by the SEC, the United States Attorney's Office for the Southern District of New York, the FBI, and NASD Regulation of a major strike against organized crime on Wall Street. Over 100 individuals were indicted, including 11 members and associates of five different organized crime families.

They also may plan and coordinate murders, arson, extortion, kidnapping, mayhem, and other violent crimes. The District Attorney’s Organized Crime Division combats those problems posed by organized crime syndicates. John G. Malcolm, deputy assistant attorney general in the criminal division of the U.S. Department of Justice did say there seems to be some connection between illegal copying and organized crime, in that many of the groups profiting from illegal copies are highly organized and can have international distribution networks. Organized crime often supports terrorism, he suggested. "These groups will not hesitate to threaten or injure those who tend to interfere with their operations," Malcolm said.

Criminals have also discovered that the Internet can provide new opportunities and multiplier benefits for illicit business. The dark side of the Internet involves not only fraud and theft, pervasive pornography, and pedophile rings, but also drug trafficking and criminal organizations that are more intent upon exploitation than the disruption that is the focus of the hacking community. In the virtual world, as in the real world, most criminal activities are initiated by individuals or small groups and can best be understood as "disorganized crime." Yet there is growing evidence that organized crime groups are exploiting the new opportunities offered by the Internet. Organized crime and cybercrime will never be synonymous. Most organized crime will continue to operate in the real world rather than the cyberworld and most cybercrime will be perpetrated by individuals rather than criminal organizations per se. Nevertheless, the degree of overlap between the two phenomena is likely to increase considerably in the next few years.
