The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.

EDUCATIONAL INSTITUTIONS AND NONPROFIT CORPORATIONS PAYING ANNUITIES
731.704 Certificate of authority required for educational institution or nonprofit corporation to receive transfer of money or property on condition of agreement to pay annuity.
(1) An educational institution or nonprofit corporation may receive a transfer of money or property conditioned upon its agreement to pay an annuity to the transferor or the nominee of the transferor, if the institution or nonprofit corporation holds a certificate of authority issued under subsection (3) of this section.
(2) Application for a certificate of authority shall be made in compliance with the rules of the Director of the Department of Consumer and Business Services. The director may by rule require such information relating to an educational institution or nonprofit corporation as the director considers desirable in the administration and enforcement of ORS 731.704 to 731.720.
(3) If the director finds that the application is in order, that the educational institution or nonprofit corporation is eligible to receive transfers under ORS 731.704 to 731.720 and that the institution or nonprofit corporation has complied with subsection (4) of this section, the director shall issue a certificate of authority to the applicant upon payment of the fee established by the director.

Since last Fall, I have had the pleasure to take the reins of the SLPA certification/training program at Chemeketa Community College. This program is a state of the art program with classes delivered in a distance learning format with online or videoconference classes. Oregon is really a leader in this area and is setting a model for other states to follow in regards to the comprehensive certification program for SLPAs as well as having a state law that mandates specific training for SLPAs. Students have been participating from across the state and region as well as from other states. I have been encouraged by the positive feedback I have received from students as well as supervising SLPs.
I think another component of the SLPA issue across the state is to highlight some of the requirements of the SLPA law documented by the Oregon Board of Examiner’s office.
In order for an assistant to be certified, he/she must submit the following to the Oregon Board of Examiners Office for Speech-Language Pathology and Audiology:

Oregon's constitution prohibits state appropriations for the benefit of any religious institution. Ore. Const. Art. 1, Sec. 5. Registration/Licensing/Accreditation: Private schools must be approved for the public placement of students for special education services. OAR 581-15-126. Recordkeeping/Reports: Length of School Year/Day: Instruction in English: Teacher Certification: Teachers at registered private schools may demonstrate their qualifications by: 1) possessing a current teaching license; 2) teaching at least half time in the subject field in which the bachelor's degree was obtained while actively working toward an Oregon teaching certificate; or 3) possess relevant verifiable experience consistent with the educational goals of the school and the Department of Education. Or. Admin. R. 581-45-530. Curriculum: See Safety Fire and Earthquake Instruction. Special Education: School districts must make available special education designed to meet the needs of resident handicapped children in private schools. Such special education must not be provided in the private school. School districts must provide such children with genuine opportunities for equitable participation in special education consistent with the number of children and their needs. Or. Admin. R. 581-15-166 (1978). Private educational agencies furnishing special education to handicapped children pursuant to a contract with a public agency must have on file with the Oregon Department of Education a plan approved for the special education programs. The plan must 1) describe the population to be served and the instructional services to be provided; 2) include a staff roster indicating name, instructional qualification, and assignment of all special education personnel employed by the private educational agency; 3) describe facilities, equipment and materials to be furnished and utilized; 4) document compliance with state and local health, fire and safety standards; and 4) meet additional minimum standards set out by regulation. Or. Admin. R. 581-15-126 (1978).
