Governing the Operation of Degree-Granting
For-Profit Institutions of Higher Education March 2000
Abstract
The Education Commission of the States (ECS) surveyed 11 states to inquire about regulations governing the operation of degree-granting for-profit institutions of higher education. Based on the survey results, for-profit institutions are not singled out in the regulatory process. For-profit institutions undergo similar application reviews to those required of private nonprofit institutions (with the exception of providing supplemental forms on shareholders). While most states, however, provide some form of financial assistance to students attending for-profit institutions, it is not on the same level as the aid available to public and private nonprofit institutions.
Introduction
With the rapid growth of for-profit institutions of higher education, many questions arise about quality, competition, market models and appropriate public policy. The Education Commission of the States (ECS), with a grant from the Alfred P. Sloan Foundation, undertook a descriptive study of the growth and impact of for-profit institutions that grant degrees. As part of that study, ECS asked 11 state agency leaders with large for-profit sectors and markets to share information on how they regulate these institutions of higher education. As for-profit institutions grow in number and size, public agencies charged with oversight and consumer-protection responsibilities must respond within existing legal frameworks. The purpose of the study was to determine if and how these frameworks are changing.

Alcohol and Drugs on Campus
Oregon State University operates a zero tolerance policy for use of alcohol by minors on campus. Minors using alcohol on campus may be subject to arrest, citation and/or student judicial proceedings. Driving under the influence and the sale or distribution of alcohol to minors is also a criminal offense and persons involved in these activities are subject to arrest. The University strictly regulates any alcohol use on campus. A permit must be obtained for events held on campus. Student life policies provide regulations for use of alcohol by persons aged 21 or older in the housing units and for student activities.

Student Grades
Student grades may be obtained via the OSU Student Online Services Web pages. Individual copies of grades will be provided ($10.00 fee) upon request by the Registrar's Office, 102 Kerr, (541) 737-4331. Grades are not automatically mailed to the student. Grades, GPA calculations, and academic standings are not complete and final prior to 8:00 a.m. on the Wednesday following the final exam week. Grades and GPAs appearing prior to that day may be incomplete.

Rules and Regulations for Using Equipment Equipment in the Technology Education Center is for use by College of Education faculty, staff, and students for classes and presentations that take place on-campus. Equipment is not for use in public schools, home use, off campus conferences. Users can pick up and return all equipment to 116 Education unless other arrangements are made. Lab staff do not deliver. It is the users responsibility to be able to set up and correctly operate the equipment. It is highly recommended that the user practice with the equipment before the presentation and be aware of lighting conditions in the presentation room, and to make sure that there are adequate electrical and network connections. If you are using your own computer with a laptop it is especially important to test the computer with the projection system before the presentation. Users should take precautions to make sure that the equipment is secure, kept away from heat and moisture, and that all parts and cables are returned.

COMMERCIAL AND CHARITABLE SOLICITATIONS AND COMMERCIAL TRANSACTIONS
Introduction
(1) Definitions. As used in this rule, the following definitions apply:
(a) "Sale", "selling", or "purchasing" mean an activity which creates an activity or obligation to transfer property or services for a valuable consideration;
(b) "Commercial solicitation" means any direct and personal communication in the course of a trade or business reasonably intended to result in a sale;
(c) "Private sale" means occasional selling between persons who are campus students or employees; (d) "Commercial transactions" means selling or purchasing or both selling and purchasing by any person in the course of employment in, or in the carrying on of, a trade or business. To the extent a non-profit organization or charity is selling a tangible product or is offering a tangible product with the expectation of thereby obtaining an immediate and direct contribution, this aspect of the entity's activity shall be deemed for the purposes of this rule to be a commercial transaction; (e) "Interference standard" describes the basis on which University officials will make an activity impact judgement (i.e., extent to which an activity or proposed activity limits, impedes or makes more costly than normal the use or function of an area);

    The college operates on a term system (also called a quarter system). Fall term begins in late September and ends before Christmas. Winter term begins in early January and runs until mid-March, and spring term begins in late March and ends in mid-June. The 10-week summer term runs from mid-June until late August.     Generally speaking, a class that meets one hour a week for one term will yield one credit; a class that meets three hours per week will yield three credits. A lab class usually yields one credit for each two or three hours of lab time. If you are employed while you attend college, bear in mind that most classes require one or two hours of preparation for each class hour. In our program descriptions, we suggest curricula that will allow you to complete the program in one or two years; if you are working, you may need to extend that timeline. To earn a transfer degree in two years, you should schedule an average of 15 credits per term to accumulate 90 credits in six terms. You may take no more than 21 credits in any single term without a counselorís signature.
