WASHINGTON (CNN) The Justice Department announced Tuesday the government's civil rights lawyers have jumped into a legal case to support a Muslim girl's right to wear a head scarf in a public school. Assistant Attorney General for Civil Rights Alex Acosta said government lawyers would support 11-year-old Nashala Hearn, a sixth-grade student who has sued the Muskogee, Oklahoma, Public School District for ordering her to remove her head scarf, or hijab, because it violated the dress code of the Benjamin Franklin Science Academy, which she attended. The girl continued to wear her hijab to school and was subsequently suspended twice for doing so. The family appealed the suspensions, which were upheld by a district administrative hearing committee.

Oklahoma City, Oklahoma 73105 Dear Superintendent Garrett: This office has received your request for an official Attorney General Opinion addressing the following question: The constitutional provisions regarding public purpose and gifts are generally construed in conjunction with each other. A determination that an expenditure is for an authorized public purpose necessarily mandates a determination that the same is not a gift of public monies. From a reading of the Oklahoma Constitution and pertinent cases, public funds can only be appropriated for a public purpose and public funds must be used in furtherance of a governmental function as opposed to benefiting private individuals or groups. Likewise, public property can only be used for a public purpose. Therefore, the first hurdle is to determine whether providing funds for the purpose of funding a contract or using school property as part of a contract with a local foundation meets the public purpose standard. The United States government is taking a decidedly different approach from that of the French government when it comes to students who want to wear religious clothing to school. The French government recently banned religious attire from its classrooms, citing France's tradition of secularism. In the United States, the federal government is intervening on behalf of a girl who wants to wear a religious head scarf, or hijab, to her sixth grade classes in the southern state of Oklahoma. Nashala Hearn, 12, just started to wear a hijab this year. Her father, Eyvine Hearn, embraced Islam four years ago, but says he didn't want to force the religion on any of his three children. He left the decision up to them, and his eldest child, a teenaged daughter, still does not practice the faith. Last August, shortly before school began, Nashala, who's the youngest, told her parents she wanted to honor Allah by wearing a hijab. Mr. Hearn says he and his wife spoke to Nashala's teacher about it before classes began. "We let her know that we were Muslims, and that we pray at certain times of the day, and I gave her a prayer schedule," he said. "The teacher was excited, for reasons of world culture. She was thinking of having me come in as a speaker and speak on our religion."
