Peck, Legislative Counsel DATE: January 22, 1992 RE: Private School Choice Demonstration Amendment The proposed school choice demonstration amendment to S. 2 would permit states to include private and parochial schools as "choice schools," notwithstanding contrary provisions of state law. While this effectively preempts state law after the Secretary of Education awards grants for the demonstration projects, it does not and cannot do so before an award is made. Therefore, a number of states, operating under state constitutions that prohibit the public funding of sectarian schools or institutions, are ineligible to apply for the grants. A government has only the power and authority granted to it by the people through a constitution. This is the foundation of a nation that observes "the rule of law." Just as the authority of the federal government is limited by the powers granted and denied by the federal Constitution, the authority of the state governments are limited by the powers granted and denied by their respective state constitutions. Where a state constitution prohibits public funding of sectarian institutions, the state would violate its constitution when it applied for the grant program contemplated by the choice demonstration amendment because it would exceed its constitutional authority. Thus, the following states are constitutionally inhibited from participating in the choice demonstration and cannot benefit from the amendment under consideration:

President Bill Clinton has called for a "national crusade" on education. Naturally, that means spending more money: he would have Washington hire teachers and build schools. Many states, flush with cash, also plan to spend more. But the problem of education is monopoly, not money. Average SAT scores dropped from 980 to 899 between 1963 and 1992, while real per-pupil spending rose 160 percent. In fact, real spending per pupil has risen 40 percent a decade since World War II. The past decade of "reforms" has changed nothing. The 1994 National Assessment of Education Progress (NAEP) test found that 36 percent of fourth graders, 39 percent of eighth graders, and 57 percent of 12th graders failed to meet basic history standards. In most other subjects students perform poorly, and, incredibly, do worse the longer they stay in school. Last year the journal Education Week called America's public schools "rife with mediocrity," reporting that "there is no state in which at least half the students perform at the 'proficient' level or above." It refused to give the states grades based on their NAEP results, since "all would have failed." International comparisons tell an equally dismal story, with American students scoring below foreign kids in almost every subject. The latest survey, the Third International Mathematics and Science Study, ranked America 19th out of 21 countries in math, surpassing only Cyprus and South Africa. (No Asian nations, whose students typically do well, participated.)

Diocese of Leavenworth (Leavenworthensis). Suffragan to St. Louis. When established, 22 May, 1877, it comprised the State of Kansas, U. S. A., with the Right Rev. Louis Mary Fink, O.S.B. as its first bishop. At his request, ten years later the Holy See divided the diocese into three: Wichita, Concordia, and Leavenworth. Leavenworth was then restricted to the 43 counties lying east of Republic, Cloud, Ottawa, Saline McPherson, Harvey, Sedgwick and Sumner Counties. The diocese had an area of 28,687 sq. m., with a total population in 1890, of 901,536. Authorized by the Holy See , Bishop Fink on 29 May, 1891, took up his residence in Kansas City, Kans., and the diocese was named after this city for some years. Apostolic letters dated 1 July, 1897, further diminished the territory of the diocese in favour of Concordia and Wichita. It now includes only the Counties of Anderson, Osage, Pottawatomie, Shawnee Wabaunsee, Wyandotte, Jackson, Jefferson, Linn, Lyon, Marshall, Miami, Nemaha, Atchison, Brown, Coffey, Doniphan, Douglas, Franklin, Johnson, and Leavenworth; an area of 12,594 sq. miles. The first missionary to the wild Indians of the plains, within the present borders of Kansas, was Father Juan de Padilla. He obtained the martyr's crown just fifty years after

The D.A.R.E., or Drug Abuse Resistance Education program, was started in the Los Angeles Unified School District by Chief Daryl Gates of the Los Angeles Police Department in 1983. Gates recognized that police were unable to cure the drug problem that was sweeping America by arresting pushers and users, so he set out to educated students in Los Angeles schools. Gates received the full cooperation of the Los Angeles school district, and the program began with the 1983-84 school term. During the first year, ten officers taught the new curriculum to more than 8,000 students in 50 Los Angeles elementary schools. By 1986, the program had grown to reach all 345 elementary and 58 junior high schools in the city. Based on his success, Gates invited other jurisdictions to send officers to Los Angeles for 80 hours of intensive DARE training. This training is now used by police departments in all 50 states. There are now at least 3,000 instructors in the United States, 150 of whom are with law enforcement agencies in the state of Oklahoma. Officers who teach in the DARE program must volunteer for the job on the basis of a solid commitment to preventing substance abuse among young people, and must have a clean record, a minimum of two years street experience, maturity and good communication and organization skills.

I am your public school, a 200 year-old experiment giving America the strongest economy in world history. We are 88,000 buildings in more than 15,000 districts. And we are as diverse as this great country. This fall I embrace more than 46 million children; for most of them, I am their only hope for future success. When the buses roll up, my doors are flung open to children of all shapes, sizes, levels of ability, some in wheel chairs, geniuses and the retarded, average and the developmentally disabled. They speak more than 100 languages, including Mong—the Cambodian highland children who came here with no written alphabet. I represent “home schooling” at its best for I am the “home school” of 10 million latchkey children. Some of you would judge me by test scores but I would remind you that a test only measures one dimension of a student’s development—only in that subject on that day depending on whether the student tests well.

F rank Keating was born on February 10, 1944, in St. Louis and moved to Tulsa with his family when he was six months old. He was educated there in parochial schools, attending Marquette and Monte Cassino elementary schools and graduating from Cascia Hall High School. He received his undergraduate degree in history from Georgetown University and returned to Oklahoma to earn his law degree at the University of Oklahoma in 1969. He has received honorary degrees from Seton Hall University in New Jersey and Grove City College and LaRoche College in Pittsburgh.
After service as an FBI agent, Keating was a local prosecutor in Tulsa. He later served in both houses of the Oklahoma Legislature, rising to minority leader of the State Senate, and was named U. S. Attorney for the Northern District of Oklahoma in 1981. From 1985 through 1993 he served in Washington as Assistant Secretary of the Treasury, Associate Attorney General and as General Counsel at the Department of Housing and Urban Development. In those roles, Keating had oversight responsibility for virtually every federal law enforcement agency.
Governor Keating is a lifelong Catholic communicant. In 1980 he received a papal appointment as a Knight of the Holy Sepulchre. He and his family attend St. Joseph's Old Cathedral and Corpus Christi churches in Oklahoma City.

What is the Youth Leadership Exchange?
Purpose
YLX empowers central Oklahoma youth to make a positive difference through community leadership. What is YLX? YLX was developed by the Oklahoma County Chapter of the American Red Cross as a leadership training program for youth from Oklahoma. Class I convened in September 1995 and was graduated in May 1996. YLX moved from the American Red Cross to become a program of Leadership Oklahoma City in July 1997. Currently, there are three separate classes:
  • Leadership Skills: (45 members selected each September) focuses on general community leadership skills such as group dynamics, goal-setting, rights and responsibilities, and personal leadership skills. Leadership Skills class members make site visits to many local community organizations, schools, and businesses and spend time in training sessions such as a mock trial and jury deliberations.
  • Youth in Action: (45 members selected each September) focuses on advanced community leadership skills such as facilitation techniques, decision-making, and fund raising. Youth in Action class members select community projects for funding. The projects are funded through money from Leadership Oklahoma City and matching funds raised by class members working in teams to involve local donors.
