Summary of Opinion
The Oklahoma Attorney General was asked whether a “money hunt” in which participants hunt animals with hounds, pay a fee, and collect from the stakes depending upon their hounds’ performances violates gambling laws. The Attorney General responded that such an event does violate gambling laws, distinguishing it from entry fees paid for rodeos and livestock exhibitions in which prizes are awarded by a non-participant association sponsoring the event.

Oklahoma City, Oklahoma 73015 Dear Representative Leist: This office has received your request for an Attorney General Opinion in which you ask, in effect, the following question: Whether hunting with hounds in competition for a stake, when the stake is comprised of pooled entrance fees paid by contestants, is a violation of Oklahoma law. You inquire about the legality of a practice where persons enter hounds into a contest, sometimes known as a "money hunt," in which these hounds hunt other animals in competition. To participate in such contests, contestants make an outlay of cash or other item(s) of value as entrance fees, which are pooled. The pooled entrance fees, constituting the stake for the contest, are then distributed to winning contestants in gradations varying in accordance with the performance of their hunting hounds.

Stites Dear Representative Stites: This office has received your request for an official Attorney General Opinion in which you ask the following question: Under the provisions of the Oklahoma Horse Racing Act ("the Act"), 3A O.S. 200 - 3A O.S. 209 (1991-2000), is the Oklahoma Horse Racing Commission empowered to authorize a licensed racetrack (which the Act refers to as an "organization licensee") to accept pari-mutuel wagers on previously run horse races - races which are neither live races nor races being transmitted to the organization licensee at the time the live race is being run at the host track? Unions Lose Again in Oklahoma by Charles W. Baird In my February column I celebrated Oklahoma's new right-to-work (RTW) law which was adopted by voters 54-46 percent on September 25th last year. A RTW law prevents unions with monopoly representation privileges from forcing nonmembers to pay for representation services they do not want. Section 14(b) of the National Labor Relations Act authorizes states to enact such laws. Several unions filed suit in federal district court to attempt to overturn the new law. They lost, but the details are instructive, and the unions are likely to appeal. Careless Wording The new law says, in part: "No person shall be required, as a condition of employment, or continuation of employment, to: 1. Resign or refrain from voluntary membership in, voluntary affiliation with, or voluntary support of a labor organization; 2. Become or remain a member of a labor organization; 3. Pay any dues, fees, assessments, or other charges of any kind or amount to a labor organization. " Unfortunately, Section 14(b) applies only to workers who are covered by the NLRA, and the Oklahoma law says "no person" can be forced to pay dues and fees. The NLRA applies to all private sector workers except those employed in the railroad and airline industries. Those workers are covered by the Railway Labor Act (RLA) which does not have any RTW provision. Furthermore, the NLRA does not apply to any government workers. Oklahoma may enact RTW legislation for its state and local employees, but it cannot do so for federal government employees working in Oklahoma. The Civil Service Reform Act (CSRA) covers them. The unions tried to get the law thrown out on the grounds that it purports to affect RLA and CSRA workers, something that states have no power to do.
