Introduction to Criminal Law - U.S.A.
The criminal justice system in the United States of America is a hybrid system, involving state and federal government agencies. The power to make criminal laws is divided between the federal and state governments. For examples, most crimes are punished under state laws but there are some federal laws which create and punish certain conduct as well. The Constitution of the USA gives the federal government jurisdiction over tax, interstate commerce and mail and on that basis, the federal government has enacted laws which create crimes such as failing to file an income tax return, transport a stolen car across state lines and defrauding the postal service. State criminal laws are usually consolidated in state penal, vehicle or health codes. For a sample state penal code, readers are invited to consult the Texas Penal Code . Also, procedural matters vary from state to state.

This Supplement is intended to update the Federal Guidelines for Searching and Seizing Computers that was published in July 1994. The Supplement describes relevant federal and state cases decided since July 1994 as well as a number of additional earlier decisions. The cases in this Supplement are organized according to the sections in the Guidelines. Where a case relates to more than one section, it is discussed in more than one place. In order for us to stay abreast of the current developments in this fast changing area of the law, we invite you to contact us about your experiences. Please also contact us with any comments, corrections or contributions regarding the Guidelines or this Supplement at (202) 514-1026. Oklahoma Files Criminal Complaint Against WorldCom and Six Former Execs
As discussed in this earlier post , Oklahoma's AG has filed criminal charges against WorldCom and six of its former executives. A copy of the Felony Information filed with the District Court of Oklahoma County is available here According to an article in the Wall Street Journal, Oklahoma AG Drew Edmondson said the executives named in the complaint Bernie Ebbers, Scott D. Sullivan, David F. Myers, Buford T. Yates, Betty L. Vinson and Troy M. Normand "have one week to turn themselves in to authorities in Oklahoma. If they fail to meet that deadline, Mr. Edmondson said arrest warrants will be issued and his office will seek extradition." Bloomberg reports that six other states are considering "WorldCom charges," as well. Permalink

Criminal Procedures
Criminal procedures are composed of the rules governing the series of proceedings through which the substantive criminal law is enforced. In the United States, local and state government defines most crimes, though the federal government has adopted its own criminal code, at Title 18, to deal with activities extending beyond state boundaries or having special impact on federal operations. The procedure for criminal trials in federal courts is outlined in Title 18. States also have statutes that set out the framework for criminal procedure , subject to important constitutional limits. For example, the U.S. Constitution Bill of Rights provides basic protections including the right to an attorney, the right to not testify, the right to confront witnesses, and the right to a jury trial, among others. State constitutions may increase, but not take away from the federal protections.

Criminal Identity Theft and Assumption Deterrence Act
In October 1998, Congress passed the Identity Theft and Assumption Deterrence Act of 1998 (Identity Theft Act) to address the problem of identity theft. Specifically, the Act amended 18 U.S.C. § 1028 to make it a federal crime when anyone: knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law. Violations of the Act are investigated by federal investigative agencies such as the U.S. Secret Service, the FBI, and the U.S. Postal Inspection Service and prosecuted by the Department of Justice.

The Arlene Berry Case
The physician who cannot tell that his drugs are producing ill effects upon his patient until serious, even fatal consequences evolve, has no business prescribing DRUGS: The primary physician responsible, Dr. Edward H. Jordan , alias Dr.Ted Jordon t reated Arlene Berry over the telephone, while sitting at home watching TV. He treated her "unseen" and without any review of her medical files. In fact, he made NO diagnosis at all.
This investigation has been hampered by hospital negligence and fraudulent concealment, ranging from altered medical records to outright fabrication. The power of proof of causation has been seriously undermined by the record tampering.
The poorly written, disorganized record is strong evidence of an incompetent health care provider.

BY-LAWS OF THE OKLAHOMA CRIMINAL JUSTICE RESEARCH CONSORTIUM (Revised and Approved September 26, 1997)
ARTICLE I Name The name of this organization shall be the Oklahoma Criminal Justice Research Consortium ARTICLE II Purpose The purpose of this Consortium is the promotion, review, collection, dissemination, and publication of research pertinent to the criminal justice system. To accomplish this end a network of qualified and recognized researchers and practitioners is encouraged through the Consortium's Executive Committee and General Membership. ARTICLE III Membership Section 1 : Qualifications A. Any individual shall be eligible for membership through appointment by the Executive Committee. B. Members are expected to conduct themselves in an ethical, professional, and collegial manner in their dealings with the Consortium and its members, and when acting as representatives of the Consortium to the public. Failure to do so may result in their removal by a majority vote of the Executive Committee. Section 2 : Voting A. Each member shall be entitled to one (1) vote at any General Membership meeting. Routine business shall be transacted by a majority vote of the members in attendance.

Disqualification or Disability
New Jersey Statutes 2C:51-1: Basis of disqualification or disability
Any legal disqualification or disability because of someone’s conviction of an offense or sentence on such conviction must be:
  • Necessarily incident to execution of the sentence of the court;
  • Provided by the Constitution or the Criminal Code;
  • Provided by a statute other than the Criminal Code, when the offense is defined by that statute; or
  • Provided by the judgment, order or regulation of a court, agency or official exercising a jurisdiction conferred by law, or by the statute defining such jurisdiction, when the offense, conviction, or sentence is reasonably related to the individual’s competence to exercise the right or privilege of which he is deprived.

Proof of a conviction as relevant evidence:
  • Upon the trial or determination of any issue; or
  • For the purpose of impeaching the convicted person as a witness is not a disqualification or disability for the purpose of this law.
