    This chapter outlines some criminal law issues and focuses on misdemeanors, for which punishments are relatively less severe than for felonies. Felonies are covered in the Chapter, along with white collar crimes, the rights of persons accused of crimes, and the rights of crime victims. This chapter also discusses driving-while-intoxicated violations. Domestic abuse is covered in the Family Law Chapter. Criminal procedure is covered in the Process of a Lawsuit Chapter, and private causes of action that result from criminal conduct are covered in the Personal Injury Law Chapters.
    Criminal Codes
    Criminal law defines conduct that is prohibited by the government and the range of penalties that can be imposed for violating these prohibitions. Persons who violate criminal laws incur penalties ranging from fines to imprisonment or, in some states such as Texas, execution. Punishment for committing a misdemeanor may include jail time and/or a fine. Punishment for an infraction does not include jail time. The law also allows authorities to seize property connected with the commission of a crime. For example, a person charged with violating laws connected with controlled substances must forfeit the substances as well as the raw materials used to make the drugs, vehicles and property used to further the crime, and any money or other proceeds from the sale of the controlled substances.

    Areas of Practice Bar Admissions ... Education Rick Hagen was raised in Denton, Texas. After graduating from Austin College, he worked as the Legislative Assistant to State Representative Jim Horn. Mr. Hagen graduated law school from the University of Oklahoma, where he received the American Jurisprudence Award for Trial Techniques. Mr. Hagen was hired by the Honorable Rusty Duncan to work as a briefing attorney on the Texas Court of Criminal Appeals- the highest criminal court in the State. After working on the Court, Mr. Hagen began a two-year stint as a prosecutor in Central Texas. In 1993, he returned to his hometown of Denton and began practicing law with Mr. Jackson. Mr. Hagen has been involved in a number of unique cases involving questions of constitutional law. In 1994, Mr. Hagen received national attention when he successfully defended a juror who was held in contempt of court after asserting her constitutional right to privacy when she declined to answer questions on a jury questionnaire. In Michigan, Mr. Hagen represented family members of a patient of Dr. Jack Kevorkian, who refused to testify in Kevorkian's trial for the assisted suicide of their mother. While the family members were ultimately forced to testify, Kevorkian was acquitted. In the Big Bend area of Texas, Mr. Hagen, along with the late attorney Ward Casey, successfully defended a citizen who possessed peyote, asserting his First Amendment religious right to do so. Mr. Hagen was recognized by the National Clearinghouse for Battered Women for his representation of women in 1998 and 2000 accused of murdering their abusers when grand juries declined to indict each woman.

    This article is concerned with laws of politics and jurisprudence : rules of conduct which mandate and/or proscribe specified relationships among people and organizations ; as well as punishments for those who do not follow the established rules of conduct. In ethics and moral philosophy this type of law is often called a "human legal code " to distinguish it from more fundamental laws applicable to all beings ( metaphysics ontology ). Such a body of laws can be seen as a legally-enforced ethical code or as a "secular moral code " (to the degree that political leaders replace religious leaders as moral examples ). Because lawyers and jurists more than other professions are self-regulating, almost by definition, they are often held to higher standards of behaviour or at least a stricter etiquette . Opt-out - generally this requirement includes a mechanism allowing recipients to easily (often at no cost) remove themselves from the sender's electronic mail address lists so that they are not included in future mail. In some cases there is reference to a physical address for the receipt of US mail or a toll free number. Definition - a definition of 'unsolicited electronic email' has only been outlined in a small number of cases. A number of states define 'electronic mail' or 'commercial electronic mail' with the legislation relating to sending bulk electronic mail 'without authority' or 'computer trespass'. Penalties - apply in virtually all cases and civil action can be undertaken. In a number of cases, the Attorney General of that state acting on behalf of the state can bring action in the superior court to enforce the provisions of the relevant section. A provider (eg ISP) may sue the sender of unsolicited commercial e-mail if it violates the provider's policies and the sender has actual notice of such policies. Scope (Extra-jurisdictional reach) - Generally refers to emails that are sent to a resident of a state via a provider's service or equipment located in the state - ie there is some scope for jurisdiction over a non-resident who uses a computer or computer network located within the said state. In some cases the legislation refers to the sender being aware of facts making the recipient's presence in a particular state a reasonable possibility. In the following table:
