TITLE VI - CRIMINAL OFFENSES
Section 1: Short Title

This Ordinance may be cited as the Tribal Criminal Code. Section 2: Application (a) This ordinance shall apply to all Indian persons violating its provisions within the territorial jurisdiction of the Tribe, provided, that the provisions of Chapter Four of this ordinance shall apply to all members of the Tribe and all Indian residents of the jurisdiction of the Tribe where ever such violation may occur, if such violation has any actual or intended effect upon the political integrity or political or economic security of the Tribe. (b) This ordinance shall apply to non-Indians to the extent not inconsistent with federal law and to the extent that any person found to have violated any provision of this act may be banished from the jurisdiction of the Tribe for a period of not more than ten years, or for such longer term as may be imposed by the Section violated, in a civil proceeding brought by the prosecutor. The non-Indian in such cases, shall have all the procedural rights of a criminal defendant, and such cases shall be tried by the rules of criminal procedure. CHAPTER ONE - CRIMES AGAINST PROPERTY

Why is it a STATE Computer Crimes Code (isn’t federal law better?)? The United States of America has laws that exist at two entirely distinct levels: federal law and state law. See, e.g., NGA: Principles for State-Federal Relations of the Bill of Rights of the U.S. Constitution; See generallly National Conference of State Legislatures Federal laws apply throughout the entire geographical nation; state laws only apply in the geographic territory of each state. The state of Oklahoma’s laws, for example, only apply to conduct and/or persons located within the state of Oklahoma at the time an offense was committed and/or at the time the offender is prosecuted. For many years, federal law has been used to address new problems that arise in the United States. In the 1930’s, for example, Congress adopted a federal kidnapping statute - popularly known as "the Lindbergh Law" – which was designed to let federal authorities step in and pursue kidnappers once they had crossed a state border with their victim. See 18 U.S. Code section 1201

"[C]ourts, as well as officers, parents and the moral forces of this State and Nation, must not shirk the onerous task involved in such problems, if a Sodom and Gomorrah is to be forestalled."
The Victorian Morality Period, 1873-1948 I. Sodomy The Oklahoma Territory was organized in 1890 and received most of the laws of Nebraska, including its criminal code and common-law reception. This seemingly made sodomy punishable by one year-life. However, a compilation of criminal laws included an explanatory note that only those laws "locally applicable" were taken from Nebraska law and that those that were "irrelevant, inapplicable, or repugnant to United States laws" were excluded. Compiler LeGrand Byington omitted "the extraneous, verbose and immaterial clauses, that would have encumbered rather than aided the enforcement of the essential provisions, and thereby cheapened the volume to the people whose immediate needs it supplies." One Nebraska law not found in this new compilation was the "crime against nature" law, although a large number of other sexual crimes were included.
