CHAPTER 6 - WEIGHTS AND MEASURES AND STANDARD TIME
SUBCHAPTER IX - STANDARD TIME
It is the policy of the United States to promote the adoption and observance of uniform time within the standard time zones prescribed by sections 261 to 264 of this title, as modified by section 265 of this title. To this end the Secretary of Transportation is authorized and directed to foster and promote widespread and uniform adoption and observance of the same standard of time within and throughout each such standard time zone.
  • (a) Duration of period; State exemption
  • (b) State laws superseded It is hereby declared that it is the express intent of Congress by this section to supersede any and all laws of the States or political subdivisions thereof insofar as they may now or hereafter provide for advances in time or changeover dates different from those specified in this section.
  • (c) Violations; enforcement For any violation of the provisions of this section the Secretary of Transportation or his duly authorized agent may apply to the district court of the United States for the district in which such violation occurs for the enforcement of this section; and such court shall have jurisdiction to enforce obedience thereto by writ of injunction or by other process, mandatory or otherwise, restraining against further violations of this section and enjoining obedience thereto.
Within the respective zones created under the authority of sections 261 to 264 of this title the standard time of the zone shall insofar as practicable (as determined by the Secretary of Transportation) govern the movement of all common carriers engaged in interstate or foreign commerce. In all statutes, orders, rules, and regulations relating to the time of performance of any act by any officer or department of the United States, whether in the legislative, executive, or judicial branches of the Government, or relating to the time within which any rights shall accrue or determine, or within which any act shall or shall not be performed by any person subject to the jurisdiction of the United States, it shall be understood and intended that the time shall insofar as practicable (as determined by the Secretary of Transportation) be the United States standard time of the zone within which the act is to be performed.

A mechanic's lien is a claim against the personal property on which the claimant has bestowed labor or furnished material for the value of the labor done or materials furnished. Anyone who has furnished labor, services, material or equipment and has properly complied with the notice requirement is entitled to file a mechanic's lien. All 50 states have been researched and it has been determined that only 34 states have laws on mechanic liens. It would be very convenient if all state and federal codes, statutes, and caselaw were available on the World Wide Web. This would give lay people easy access to the laws that they must follow and it would allow attorneys to do legal research without having to leave their office to go to a law library, or pay for expensive collections of casebooks. Unfortunately, economic realities dictate that we may never see all of the substantive law of all the states on the Web. Several states receive quite a bit of income by selling the exclusive rights to publish that state's caselaw. In addition, it is quite expensive to publish and maintain a web site, and money for such a project is not available in all states. Caselaw on the Web ideally would include decisions from at least the last 30 years, a sophistocated search engine for locating relevant law, case summaries, headnotes, etc. Providing all of these on a Web site would be very expensive. Criminal Identity Theft and Assumption Deterrence Act
In October 1998, Congress passed the Identity Theft and Assumption Deterrence Act of 1998 (Identity Theft Act) to address the problem of identity theft. Specifically, the Act amended 18 U.S.C. § 1028 to make it a federal crime when anyone: knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law. Violations of the Act are investigated by federal investigative agencies such as the U.S. Secret Service, the FBI, and the U.S. Postal Inspection Service and prosecuted by the Department of Justice.

    State Computer Harassment or "Cyberstalking" Laws
    Law enforcement agencies estimate that electronic communications are a factor in from 20 percent to 40 percent of all stalking cases. Forty-four states now have laws that explicitly include electronic forms of communication within stalking or harassment laws. State laws that do not include specific references to electronic communication may still apply to those who threaten or harass others online, but specific language can make the laws easier to enforce. Two reports from the U.S. Department of Justice provide detailed information on cyberstalking: Stalking and Domestic Violence: Report to Congress (May 2001) and Cyberstalking: A New Challenge for Law Enforcement and Industry (Aug. 1999). CyberAge Stalking , from LLRX.com , discusses the prevalence of cyberstalking and outlines state and federal statutes and case law. It also provides resources and information about how to protect against this crime. Cyberstalking: Navigating a Maze of Laws New York Law Journal , July 2002) describes various statutory definitions and provisions in several state cyberstalking laws.
