77 South High Street Columbus, Ohio 43266-0603 Dear Speaker Davidson: I appreciated your cooperation last year as you worked with the State Board of Education and the Department to facilitate the adoption of the rigorous new teacher education and licensure standards. Now, I seek your assistance in moving forward the proposed Standards for Ohio Schools, which, when joined with the teacher standards, will further enhance Ohio's performance-driven system of education. These proposed standards contain two essential elements for guaranteeing results-oriented schools: (1) a framework for establishing more rigorous graduation requirements and assessments , and (2) a new school accountability review system I am pleased to enclose the Rules Edition of the proposed standards which were accepted in principle by the State Board on May 12, 1997. The standards are a single, cohesive set of rules which will guide the education of learners in elementary and secondary schools chartered by the State Board. The standards apply not only to regular education programs, but also to special, gifted, vocational, and early childhood education.

Students who graduated from high school in 1999 were kindergartners when a small group of southeastern Ohio school superintendents began serious discussions about the inadequacies and inequities of Ohio school funding system. Now, the fall of 1999, the fundamental problems of Ohio school finance have yet to be resolved.
The Coalition of Rural and Appalachian Schools (CORAS) generally is recognized as having initiated the school funding reform movement in Ohio. It began in 1988 with five Athens-area school superintendents who realized the basic unfairness of the way schools were funded and the system effect on students' educational opportunities. The superintendents sought the assistance of the dean of the College of Education at Ohio University in forming a broad-based organization that could exert greater influence on the legislative processes, where solutions to funding problems were presumed to lie. The resulting organization, CORAS, grew quickly. In 1989, 60 member school districts commissioned Dr. Kern Alexander, a nationally recognized school finance expert, to conduct an equity study.
On July 1, 1994, Perry County Judge Linton D. Lewis Jr. ruled that the Ohio school funding system was unconstitutional, a decision upheld by the Ohio Supreme Court on March 24, 1997. In issuing its decision, the Supreme Court admonished the state to "create an entirely new financing system" and to perform a "complete systematic overhaul" of the system of funding primary and secondary schools. The court gave the General Assembly one year to enact legislation which would, in essence, "fix the system."

  • Elementary and secondary schools have their operations funded mainly by local real estate taxes voted on and then levied within individual school districts. For instance, in fiscal year 1997, the local share for school funding was approximately 56.2 percent and the state contributed approximately 43.8 percent. Property taxes are voted upon as a specified millage. Each mill generates $1 for each $1000 of property value.

Cleveland, Ohio Print-Friendly Version On June 27, 2002 the Supreme Court of the United States issued its ruling in Zelman, et. al. v. Simmons-Harris et. al. whereby a sharply divided Court upheld as constitutional a school voucher program that allowed thousands of Cleveland, Ohio students to attend religious schools. Some commentators have called this one of the most important decisions on education and church-state law in over half a century. In 1996 the State of Ohio established a pilot program designed to provide educational assistance to families with children who reside in the Cleveland City School District. Based upon an income factor, families could qualify for up to $2,250 in vouchers to be used toward tuition at any private school (including religious schools) that qualified, any public school in any district adjacent to the Cleveland district, qualified community schools (schools funded by the State but run by their own school boards and not by local school districts), magnet schools (public schools operated by a local school board that emphasize a particular subject area or teaching method), or for private tutoring. In 2001, of the approximately 75,000 students in the Cleveland system, nearly 4,500 participated in the program. At one point, 99 percent of students were using vouchers at religious schools. Forty-six of the 50 schools participating in the program last year were religious schools. For the 2001-2002 school year approximately $8.1 million was distributed through vouchers, with $220,410 going to secular schools, $6,622,657 going to Catholic schools, and $1,298,251 going to other religious schools. We represented, on a pro bono basis, two Lutheran school associations that participated in the voucher program and joined with the Cleveland Catholic Diocese, along with several other secular private schools, and were granted Petitioner status to intervene as parties in the case.

Citizen Contact: Michele Morrone (614) 644-2873 Ohio Environmental Education Fund Awards $26,876 to Cleveland Public Schools, General Education Division, Office of Science The Ohio Environmental Education Fund (OEEF) has awarded a $26,876 grant to Cleveland Public Schools, General Education Division, Office of Science, in Cuyahoga County. The program is titled "Living at the Edge: Exploring our North Coast Heritage", and is a three session, 12-hour interdisciplinary environmental program on board the Steamship William G. Mather Museum. The program focuses on Great Lakes history, geography and ecology. The majority of the grant funding goes toward science and chemistry equipment, teacher salaries and transportation costs. The OEEF is administered by Ohio EPA. It uses one-half of civil penalties collected by the Agency for air and water pollution control violations to fund the grants. Eligible grant recipients include environmental advocacy groups, public and private schools, colleges and universities, trade or professional organizations, and state and local units of government.

The Fourth of July came early this year for thousands of children and their parents in Cleveland. Today the United States Supreme Court has reconfirmed the basic rights of parents, taxpayers, and state governments to develop educational choices that put children ahead of bureaucracy. Today is a truly historic day in the struggle for civil liberty and religious freedom. By upholding the Ohio School Choice Plan the United States Supreme Court has clearly rejected the strained arguments of the ACLU and others who continually work to rewrite the First Amendment according to their own narrow agenda. This decision also sends a clear message to the education establishment that children are no longer to be considered the property of the state, to be held in schools against the wishes of parents and taxpayers. This day is a new Independence Day for education and civil rights in America. There are many people who deserve thanks for this tremendous victory including Senator George Voinovich who, as Governor, led the charge for this landmark program and the members of the Ohio General Assembly for their continual support in voting to reauthorize and fund the Ohio Plan. Attorney General Betty Montgomery did a brilliant job in leading the legal defense along with the Ohio team led by Judi French and David Young and assisted by Clint Bolick of the Institute for Justice. We also deeply appreciate the support of President Bush who sent Solicitor General Ted Olson to the Court on behalf of the Ohio Plan.

Bob Taft Since being sworn in as Ohio's 67th Governor on January 11, 1999, Bob Taft has focused on rebuilding Ohio's schools, helping every child learn to read, attracting new jobs, positioning Ohio as a leader in technology, improving services for seniors, and restoring cities and rural communities. Since his first day in office, Governor Taft's top priority has been to enable every child to succeed. Governor Taft is implementing his 12-year plan to provide $10 billion for new school buildings so every child has a good, safe place to learn. He is working to revise statewide academic standards and hold schools accountable for results, and his OhioReads program has recruited more than 27,000 volunteer tutors to ensure every child can read at grade level by the end of the fourth grade. The 122nd General Assembly enacted 7 new bills which state leaders declared to be in compliance with the Supreme Court order. The bills are as follows:
  • House Bill 215 Senate Bill 102 Together, HB215 the state's two-year FY98-99 budget and SB102 pumped $550 million into a state program that helps school districts repair or replace rundown buildings. The budget also included $156 million for classroom computers and other new technology, and $50 million for textbooks and classroom materials House Bill 650 The school funding bill earmarked $5.24 billion for primary and secondary education for the FY1999 school year. [Ohio Legislative Services estimates of funds distribution to local school districts.] Provisions:
      A revised funding formula that gradually raises the state's per-pupil subsidy to $4,414 over the next four years up from $3,663 in 1997. Cut budgets of other state agencies by $100 million to free up money for schools Added another $170 million to the school-building aid program, and $30 million to a new emergency program for cash-strapped districts. Increased spending on special and vocational education, and on the state's transportation subsidy to local districts.
