Ohio law regarding fireworks and related safety tips offered by statewide organizations
COLUMBUSWith the Fourth of July around the corner, the Ohio Insurance Institute (OII) and the Ohio Department of Commerce's Division of State Fire Marshal share the following information regarding Ohio's law governing fireworks usage, general statistics and safety tips.
Ohio law and other state laws
Ohio law specifically permits the use of sparklers, trick noise makers and other such novelties. According to the National Council on Fireworks Safety (NCFS), Ohio is one of five states that allows consumers to buy and use "novelty" fireworks. These fireworks can be sold and used anywhere in Ohio.
The law also allows for the purchase of "consumer fireworks" which may only be sold by a licensed fireworks manufacturer or wholesaler. While they can be purchased by anyone over the age of 18, they cannot be used in Ohio. Purchasers must sign a form agreeing to take the items out of the state within 48 hours if they are an Ohio resident, or 72 hours if they reside outside the state. "Consumer fireworks," may include cone fountains, cylindrical fountains, roman candles, sky rockets, firecrackers, mines and shells, helicopter-type rockets, certain sparklers and revolving wheels, depending on how these are defined under state law. Penalties for discharging "consumer fireworks" in Ohio include fines up to a $1,000 and a maximum of six months in jail.

Bill Files

A bill file typically contains various versions of a particular bill, a synopsis of committee amendments, committee reports, testimony, fiscal notes, and local impact statements. Bill files are compiled by the Legislative Service Commission and housed at the Ohio Historical Society. Committee Reports
As a bill works its way through the legislative process, it will be assigned to a standing committee. If the committee reports the legislation back to the full House/Senate, it will issues a committee report. Typically, reports are not available before 1989. Available reports can be found in the Bill file or online at Ohio Capital Connection.

The Ohio Open Records Law
INTRODUCTION: Realizing the sometimes difficult burdens placed on local governments in Ohio by state mandates, retired and current mayors of eleven Cuyahoga County municipalities have joined to create a forum for considering the impact of proposed state legislation on local jurisdictions. Organized on July 20, 1994, the Mayors' Think Tank, in conjunction with The Ohio Urban University Program's Center for Public Administration and Public Policy at Kent State University, determined to conduct public policy research on current topics affecting local government. For their first topic, they chose to study the impact of HB696, Revisions to Open Records Law. During the Fall Semester 1994, two graduate students in Public Administration, under the direction of a Public Administration faculty member, conducted in-depth research on HB696. This research included reviewing existing law, and telephone interviews with sources close to the intent of the current bill, and with local officials who would feel the direct effects of its passage. Results of the research were presented to the Mayors' Think Tank on December 7, 1994. After careful review and discussion of the data presented, the mayors present came to consensus on the following resolution. Though they are aware that the current legislation, HB696, is no longer viable, they are compelled to voice their concerns in the event that a new version of this legislation is introduced in the next House session beginning in January 1995.

Ohio's Do-Not-Call Law Goes Into Effect
Additional Protection For Consumers Begins

COLUMBUS, Ohio Ohio's do-not-call law went into effect Monday, giving residents additional protection from telemarketers. The new law enhances the protection offered by the existing federal do-not-call regulations. The Ohio law allows the state attorney general to investigate alleged violations of do-not-call laws and regulations; authorizes the attorney general to file lawsuits in state courts on behalf of Ohio residents; allows the attorney general to recover damages for consumers and civil penalties; and creates the Telephone Solicitation Protection Fund. Residents can fill out a consumer complaint form with the Ohio Attorney General's Office and the Federal Trade Commission. The information will be used to target violators for possible enforcement actions. Complaints can be filed online with the state at donotcall.ag.state.oh.us

Associated Press The state's top lawyer says she will zealously fight a lawsuit against Ohio's participation in a multistate lottery, even though she has strong concerns about expanding the lottery. Attorney General Betty D. Montgomery says that's not a conflict of interest. "Is there a divergence of personal view vs. public duty?'' she asked. "Yes.'' From city attorneys to state attorneys general, lawyers who represent public institutions must sometimes go into court defending laws they disagree with. "We all take an oath of office to support the laws of our state, but we are all going to have a few differences on what we think the current state of the law should be,'' Indiana Attorney General Steve Carter said. Carter is defending legislation that outlaws soliciting children for sex, even though he thinks the law is flawed and needs strengthening. Prosecutors have appealed the dismissal of solicitation charges against a man arrested in a police sting. The man's attorney successfully argued that Indiana's law makes it illegal to ask children for sex but not if the "child'' turns out to be an undercover police officer.

(Note: The Attorney General often deviates from prepared remarks.) Good afternoon. On any given day, Iyman Faris appeared to be a hard working independent truck driver. Working out of Columbus, Ohio, he freely crisscrossed the country, making deliveries to airports and businesses without raising a suspicion. But Faris led a secret, double life. He traveled to Pakistan and Afghanistan, covertly met with Osama Bin Laden, and joined Al Qaeda's jihad against America. From late 2000 to March of this year, Faris worked in concert with our Al Qaeda enemies to plot potential attacks against America and its citizens here in his adopted homeland. This afternoon, I am announcing that Judge Leonie Brinkema, of the United States District Court in the Eastern District of Virginia, has unsealed the guilty plea of Iyman Faris, a/k/a Mohammed Rauf. On May 1st, Faris pled guilty to two charges: conspiracy to provide material support to the Al Qaeda organization, as well as providing material support to that terrorist group. With this two-count plea, the Department of Justice continues to root out terrorists and those who support terrorists and continue to operate here in the United States.

Substitute House Bill Number 187 An Act To enact sections 4731.052 and 4731.283 of the Revised Code regarding the authority of physicians to prescribe, dispense, and administer dangerous drugs for management of intractable pain. Be it enacted by the general Assembly of the State of Ohio: SECTION 1. That sections 4731.052 and 4731.283 of the Revised Code be enacted to read as follows: Sec. 4731.052. (A) as used in this section: (1) "Dangerous drug" has the same meaning as in section 4729.02 of the revised code. (2) "Intractable pain" means a state of pain that is determined, after reasonable medical efforts have been made to relieve the pain or cure its cause, to have a cause for which no treatment or cure is possible or for which none has been found. (3) "Physician" means an individual authorized under this chapter to practice medicine and surgery or osteopathic medicine and surgery. (B) the state medical board shall adopt rules in accordance with chapter 119. Of the revised code that establish standards and procedures to be followed by physicians in the diagnosis and treatment of intractable pain, including standards for managing intractable pain by prescribing, dispensing, or administering dangerous drugs in amounts or combinations that may not be appropriate when treating other medical conditions. In developing the rules, the board shall consult with and permit review by physicians who are experienced in the diagnosis and treatment of intractable pain.
