Overview of State of Ohio Law, Regulation and Policy
"Pollution prevention is a priority for this Administration. A strong pollution prevention program minimizes waste and maximizes profits. It's good for business and for the environment - a real win-win." Governor George V. Voinovich The State of Ohio's environmental programs are increasingly emphasizing pollution prevention. Ohio is modifying and expanding efforts that will help to redirect attention toward prevention for toxics and other emissions and wastes. These activities are found in the Ohio Environmental Protection Agency, the Ohio Department of Development, and the Ohio Department of Natural Resources. Appendix B , "Sources of pollution prevention information," provides additional information about these activities. Two Ohio laws are aimed at reducing waste generation in the state. House Bill 147 directs owners and operators of Class I injection well facilities to prepare waste minimization and treatment plans for wastes generated at these facilities. The plans will identify the specific technically and economically feasible measures that will be taken to prevent or reduce releases into the environment. Appendix D of this guidance manual discusses the waste minimization planning requirements for Class I injection well facilities in detail.

WHAT IS A "TORT"
Generally speaking, a "tort" is an injury one person or entity inflicts (accidentally or intentionally) upon another. When one person commits a tort upon another, the injured person is entitled to remedies under the law. Generally, these remedies can include monetary compensation and restraining orders. The person who brings the lawsuit is called the " plaintiff ," and the person who is sued is called the " defendant ."     Ohio’s Concealed Carry Law
    Ohio’s new concealed carry law, effective April 8, 2004, permits individuals who meet certain criteria to obtain a license to carry a concealed handgun (“licensees”) in Ohio if the licensee carries the license and valid identification when carrying the concealed weapon. Although the law does not permit the licensee to carry a concealed handgun into certain governmental buildings and other locations, licensees are not prohibited from carrying a concealed handgun into a non-governmental hospital or other non-governmental health care facility unless the hospital or health facility has adopted policies to prohibit concealed handguns in the facility.       (1) The purchaser, other than for purposes of resale, of a motor vehicle; (2) Any lessee of a motor vehicle in a contractual arrangement under which a charge is made for the use of the vehicle at a periodic rate for a term of thirty days or more, and title to the vehicle is in the name of a person other than the user; (3) Any person to whom the motor vehicle is transferred during the duration of the express warranty that is applicable to the motor vehicle; (4) Any other person who is entitled by the terms of the warranty to enforce the warranty.
    (B) "Manufacturer" and "distributor" have the same meanings as in section of the Revised Code, and manufacturer includes a remanufacturer as defined in that section. (C) "Express warranty" and "warranty" mean the written warranty of the manufacturer or distributor of a new motor vehicle concerning the condition and fitness for use of the vehicle, including any terms or conditions precedent to the enforcement of obligations under that warranty. (D) "Motor vehicle" means any passenger car or noncommercial motor vehicle as defined in section 4501.01 of the Revised Code, or those parts of any motor home, as defined in section 4501.01 of the Revised Code, that are not part of the permanently installed facilities for cold storage, cooking and consuming of food, and for sleeping, but does not mean any mobile home as defined in division (O) of section 4501.01 of the Revised Code, recreational vehicle as defined in division (Q) of that section, or manufactured home as defined in division (C)(4) of section 3781.06 of the Revised Code.

    Ohio legislators passed one of the most comprehensive lemon laws in the nation in 1987. It requires automakers to repair defects that affect the use, value, or safety of a new motor vehicle within the first 12 months or 18,000 miles (whichever comes first). If you are having problems with your NEW purchased or leased vehicle, you should immediately take it to an authorized dealer for repair. The automaker or dealer must be given a reasonable opportunity to fix the problem, and if the problem is not corrected, you might be eligible for a refund or replacement. You are covered by this law even if the problem was discovered late in the protection period and the repair attempts extend beyond one year or 18,000 miles. Failure to comply with Ohio's Lemon Law is a violation of Ohio's Consumer Sales Practices Act.
    What Is a Lemon?
    A lemon is a motor vehicle that has a problem or problems, covered by the warranty, that substantially impairs the use, value, or safety of that vehicle. If you have had problems within the first year or 18,000 miles with your passenger car, light truck (no more than one ton load capacity and not used in business), or motorcycle, you should take it back to the manufacturer or the dealer and ask them to fix it. If they fail to correct the problem(s) after being given a reasonable opportunity to do so, you might own a lemon.
