What is driving "under the influence" or "over the legal limit"?
In Ohio, driving under the influence includes driving while intoxicated with too much alcohol, or driving under the influence of a drug of abuse. Although you hear much more about "alcohol-related" incidents, one can be convicted be " under the influence " if a jury determines that: the defendant consumed some alcohol or drug of abuse, whether mild or potent, in such a quantity, whether small or great, that it adversely affected and appreciably impaired the defendant's actions, reactions, or mental processes under the circumstances then existing and deprived him of that clearness of intellect and control of himself which he would otherwise have possessed

    Table of Overruled Opinions AG Opinions The Ohio Attorney General's Web Site includes Ohio Attorney General's Opinions from 1994 to the present in full-text format. For further information on any formal opinion of the Attorney General, please contact the Opinions Section. Search Opinions Ohio law (ORC 109.12-14) requires or allows the Attorney General to provide legal advice, upon request, to state agencies and officers, to the prosecuting attorneys of Ohio's 88 counties, and to either chamber of the Ohio General Assembly. The Opinions Section of Attorney General's Office historically issues as many as 100 formal opinions each year. Requests for opinions must come from an entity or official to whom the Attorney General has a statutory duty to render advice. The Attorney General cannot issue opinions to individual citizens either within or from outside of Ohio, on hypothetical questions, issues committed to another branch of government, questions about the constitutionality of a statute, or issues currently in litigation. Typically, the process begins when one of the Attorney General's clients submits a letter to the Attorney General requesting a legal opinion on a specific question of law. The letter is acknowledged by the Opinions Section, docketed, and assigned to a staff attorney in the Section. The letter is also submitted to the Ohio State Bar Association for distribution to attorneys and other interested parties throughout the state, so that comment on the issue may be submitted by anyone with an interest in the issue.
