Criminal Identity Theft and Assumption Deterrence Act
In October 1998, Congress passed the Identity Theft and Assumption Deterrence Act of 1998 (Identity Theft Act) to address the problem of identity theft. Specifically, the Act amended 18 U.S.C. § 1028 to make it a federal crime when anyone: knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law. Violations of the Act are investigated by federal investigative agencies such as the U.S. Secret Service, the FBI, and the U.S. Postal Inspection Service and prosecuted by the Department of Justice.

JUDGES: Warren, Black, Douglas, Harlan, Brennan, Stewart, White, Marshall PER CURIAM The record shows that a man, identified at trial as the appellant, telephoned an announcer-reporter on the staff of a Cincinnati television station and invited him to come to a Ku Klux Klan "rally" to be held at a farm in Hamilton County. With the cooperation of the organizers, the reporter and a cameraman attended the meeting and filmed the events. Portions of the films were later broadcast on the local station and on a national network. The prosecution's case rested on the films and on testimony identifying the appellant as the person who communicated with the reporter and who spoke at the rally. The State also introduced into evidence several articles appearing in the film, including a pistol, a rifle, a shotgun, ammunition, a Bible, and a red hood worn by the speaker in the films. One film showed 12 hooded figures, some of whom carried firearms. They were gathered around a large wooden cross, which they burned. No one was present other than the participants and the newsmen who made the film. Most of the words uttered during the scene were incomprehensible when the film was projected, but scattered phrases could be understood that were derogatory of Negroes and, in one instance, of Jews. Another scene on the same film showed the appellant, in Klan regalia, making a speech. The speech, in full, was as follows:

It would be very convenient if all state and federal codes, statutes, and caselaw were available on the World Wide Web. This would give lay people easy access to the laws that they must follow and it would allow attorneys to do legal research without having to leave their office to go to a law library, or pay for expensive collections of casebooks. Unfortunately, economic realities dictate that we may never see all of the substantive law of all the states on the Web. Several states receive quite a bit of income by selling the exclusive rights to publish that state's caselaw. In addition, it is quite expensive to publish and maintain a web site, and money for such a project is not available in all states. Caselaw on the Web ideally would include decisions from at least the last 30 years, a sophistocated search engine for locating relevant law, case summaries, headnotes, etc. Providing all of these on a Web site would be very expensive. Given the above, it is impressive how much substantive law

Held , in view of the foregoing, the claimant is precluded from becoming entitled to child's insurance benefits on his father's earnings record.
Section 404.305(b) of Regulations No. 4 provides, in pertinent part, that
"(b) Insured's death caused by an intentional act. You may not become entitled to or continue to receive any survivor's benefits or payments on the earnings record of any person if you were convicted of a felony or an act in the nature of a felony of intentionally causing that person's death. . . ."
For certain homicides, e.g., first or second degree murder, the Social Security Administration (SSA) presumes intent, because by definition, these crimes involve intent. However, voluntary manslaughter may or may not be defined as involving intent; therefore, SSA establishes no presumption of intent. Instead, SSA bases its decision as to entitlement or nonentitlement on whether the State where the conviction occurred treats voluntary manslaughter as an intentional homicide. If State law is inconclusive, development of the facts related to intent is required. In Ohio, voluntary manslaughter is a felonious homicide. However, a person can be convicted of voluntary manslaughter if he or she "knowingly" caused the death of another regardless of whether he or she "intended" to cause that death.

In some cases, the changes were long overdue.
Since the passage of Senate Bill 2, effective July 1, 1996, the Ohio legislature has continued its efforts to "refine" the state's criminal code. In some cases, the changes were long overdue. One such example is House Bill 154, effective October 4, 1996, which makes it a crime for a person under detention to possess a deadly weapon. It may seem absurd to create a law that prohibits a prisoner from having a deadly weapon, but oddly enough, the criminal laws of Ohio did not previously address that issue. Although it has long been a crime to smuggle weapons into a correctional facility, the simple act of a prisoner possessing a deadly weapon was not specifically designated as a crime. This new legislation will correct that oversight. The penalties for this new crime have been sensibly adjusted to fit the danger posed by the offender: the more serious the crime of which the prisoner was convicted, the greater the penalty will be for his or her possession of a deadly weapon. Furthermore, any sentence imposed for this crime must run consecutively to the sentence which the prisoner is already serving. This recent legislation also changes the meaning of "detention" under Ohio law. Persons "under detention" now include anyone on parole or under supervision by the Adult Parole Authority. Not only does this new definition prevent parolees from having deadly weapons; it also means that whenever a parolee absconds from supervision, he or she can be charged with escape! The new charges can be filed in the county in which the parolee was being supervised, regardless of where the original conviction arose.
