44. Early November 1995 - Is It Illegal?
MUMS constitution withers in the eyes of the law by Carrie Coogan. that most of their planned activities are considered illegal under ohio s criminal code.
http://www.p7a77.net/mums/journal/95-11-00.html
Since those against MUMS realized they weren't going to be able to convince Senate that MUMS is illegal - because Senate actually had the ability to discuss issues and recognize propaganda - they took it to the papers. From The Miami Student - November 7, 1995 MUMS' constitution against Ohio State Criminal Code - by Amy Ruttkamp The Miami University Masturbation Society (MUMS) received recognition by Student Senate as a University student organization on Oct. 24. As stated in its constitution, "The Miami University Masturbation Society will achieve its goals through many activities, some of which may include the following: ...masturbation sessions and contests (held in private, but open invitation)." However, the society has never held a masturbation event, according to Jason Pfaff, the "executive supreme dictator"/founder of MUMS. According to the Ohio State Criminal Code, "No person shall recklessly do any of the following, under circumstances in which his or her conduct is likely to be viewed by and affront others, no members of his or her household: expose his or her private parts, or engage in masturbation; ... ; engage in conduct which to an ordinary observer would appear to be sexual conduct or masturbation. Whoever violates this section is guilty of public indecency." To a first-time offender, public indecency is a misdemeanor of the fourth degree.

Summary
Before invoking the rough instrument of the criminal law we must be sure that it will have some impact on the problem at hand. We must also be satisfied that on balance the use of criminal law will not be counter-productive, that it will not "do more harm than good."[1]
The haste to criminalize the risk of AIDS transmission ignores the failure of previous attempts to control venereal disease, as well as the considerable jurisprudential and public health problems that would arise.[2]
Background
In recent years, the use of the criminal law to prosecute HIV-positive individuals for engaging in activities that may transmit HIV has attracted the attention of policy- and lawmakers in Canada. A handful of prosecutions across the country have received considerable media coverage and in January 1995, the federal Minister of Justice declared that he was considering amending the Criminal Code to make it a crime to "knowingly communicate" HIV. In November 1996, the first appellate court decision regarding criminal prosecution for unsafe sex was released.
Individuals and organizations consulted during Phase I of the Project on Legal and Ethical Issues Raised by HIV/AIDS, undertaken jointly by the Canadian HIV/AIDS Legal Network (Network) and the Canadian AIDS Society (CAS), expressed concern about

Recent Criminal Case Law Analysis: A Reminder to Fully Examine the Facts of Your Case By Hon. Cary Pierce, Steven D. Armamentos and Christopher B. Klis This article will examine People v. Manders1 People v. Rockey2 , and People v. Boomer3 , a trilogy of recent Second District opinions that may just provide that little "something else" for your next DUI case (be it from a defense or prosecution standpoint). The vast majority of DUI cases begin with a routine traffic stop and in many cases the violation is some form of improper lane usage. In People v. Manders , the defendant’s vehicle was stopped primarily for "weaving" back and forth within its own lane, as well as coming within three inches of the centerline and the fog line on either side of the vehicle. A petition to rescind the defendant’s summary suspension and a motion to quash arrest and suppress evidence were filed and heard simultaneously. The trial court granted both, finding there was no probable cause to stop defendant’s vehicle, and the State appealed. The Manders court began its analysis by noting that it is virtually impossible to drive a vehicle in a perfectly straight line4 . They found support for this proposition in Section 11-709 of the Illinois Vehicle Code5 , which states that a vehicle shall be driven
