Internships in Civil Rights The Ohio Civil Rights Workgroup The Ohio Civil Rights Workgroup is one of two state groups (the other being CA) that are associated with the National Homeless Civil Rights Organizing Project (NHCROP). The purpose of the Ohio Civil Rights Workgroup is to monitor and keep track of civil rights violations in the form of hate crimes and policies that criminalize homelessness. The Workgroup serves as a means of representing the rights of homeless people when certain policies threaten their necessary life functions. Currently, the Workgroup has representatives throughout the state of Ohio in Akron, Cincinnati, Cleveland, Columbus, Dayton, and Toledo. It will continue to expand in Ohio so that the civil rights of homeless people in all communities can be maintained. In order to facilitate the task of monitoring these violations, NEOCH is developing a database that will one day be used by representatives throughout the State to keep an accurate count of when and where civil rights violations are happening. The database will aid the purpose of the Civil Rights Workgroup and will help build a more organized connection between homeless communities throughout Ohio. Organizing Information on Civil Rights in Ohio (The following is based on information provided by the Greater Cincinnati Coalition for the Homeless, a field site for the National Homeless Civil Rights Organizing Project, or NHCROP.)

Office Overview
The Office of the Chief Legal Counsel is comprised of the chief legal counsel, five associate counsels, an attorney dedicated to the Office of Collective Bargaining and two support staff. Full legal services are provided and range from assisting the Attorney General in trial preparation and discovery to reviewing contract awards and certifications, advising on administrative rules and statutory requirements and providing recommendations on procurement, construction management, labor and human resources matters. Office Organization
Work assignments are based on a variety of considerations, including client assignments, subject matter expertise and workload. In order to facilitate the provision of legal services, various administrative "clients" and/or subject areas have been assigned to each attorney. The client assignments are listed below:

Home Practitioner Information Releases IT 2004-01 IT 2004-01 Recent Federal Law Change Affecting Military Servicemembers Requires Modification To Year 2003 Ohio Income Tax Return – February 2004 Recently-enacted federal law, Servicemembers Civil Relief Act , requires modifications to Ohio’s year 2003 Ohio income tax return, form IT-1040. Section 511(d) of that act states, "A tax jurisdiction may not use the military compensation of a nonresident servicemember to increase the tax liability imposed on other income earned by the nonresident servicemember or spouse subject to tax by the jurisdiction."
For taxable year 2003, a nonresident servicemember – whether filing a married filing joint return, a head of household return, a married filing separate return, or a single return – can use line 34 of Schedule A on the back side of the year 2003 Ohio form IT-1040 to deduct her/his military compensation and all other types of the nonresident servicemember’s income not sitused to or earned in Ohio. Examples of other types of such income not sitused to or earned in Ohio generally include interest income, dividend income, capital gains from the sale or exchange of stocks and bonds, and lottery prizes and awards other than prizes and awards paid by the Ohio Lottery Commission. Examples of income sitused to or earned in Ohio, which the nonresident servicemember cannot deduct, include the following: wages earned in Ohio from employment other than employment as a servicemember with any of the armed services, capital gains from the sale of real estate located in Ohio and from the sale of tangible property located in Ohio, and prizes and awards paid by the Ohio Lottery Commission.

- Calling the language intolerable, a Cincinnati lawmaker is attempting to remove references to "colored persons," "white persons," and "Negroes" from Ohio law. State Sen. Mark Mallory, D-Cincinnati, will introduce legislation today that he says will bring Ohio's law books into the 21st century. "A lot of times when we change laws we might not always update the language used in the code," Mallory said Monday. "These terms are considered to be offensive and it just doesn't make sense in this day and age to have language like that in Ohio's laws." The bill would amend the four sections of Ohio law that use these terms. References to "Negroes," used in explaining non-discriminatory hiring practices, would be changed to "African-Americans." Also, language that distinguishes between "colored persons" and "white persons" would be replaced with "discrimination on the basis of race." Mallory was informed of the language by Jack Chin, a professor with the Urban Justice Institute at the University of Cincinnati. Chin also alerted Mallory that Ohio was the only state to never ratify the 14th Amendment, which guarantees equal rights for Americans, regardless of race. The senator's bill to ratify the amendment passed the General Assembly in March.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
ARTICLE 1 INTERNET PRIVACY Section 1. That section 2307.64 of the Revised Code be enacted to read as follows: Sec. 2307.64. (A) As used in this section: (B)(1) Except as otherwise provided in division (B)(3) of this section, a person that transmits or causes to be transmitted to a recipient an electronic mail advertisement shall clearly and conspicuously provide to the recipient, within the body of the electronic mail advertisement, both of the following: (1)(a) Fifty dollars for each violation of division (C) of this section, not to exceed fifty thousand dollars;

Ohio Laws Addressing Harm to Farm Property

C. William Swank Program in Rural-Urban Policy Rural crime has always been a concern for farm owners, but current social and political conditions have created new worries about harm to farm property. Population increases in agricultural areas and opposition to agricultural production practices are a few of the current circumstances exposing farm owners to the threat of harm to farm property. These conditions lead to incidents of trespass, vandalism, and other acts that harm livestock and other farm property. Ohio law addresses many of the questions raised about farm security. Is there any recourse against four-wheelers who destroy farm crops? Is it a crime to harm or kill livestock? How can a farm owner be compensated for harm caused by vandals? This fact sheet presents the Ohio laws that answer these and other questions about farm security. When addressing acts of harm to farm property, it is important to understand the difference between criminal and civil actions. This fact sheet begins with an explanation of criminal and civil actions and separately addresses criminal and civil laws regarding farm security issues. The fact sheet concludes with recommended actions an agricultural landowner can take to maximize the protection of Ohio law and reduce or prevent farm security problems.

B. Historical Foundations
The states are the central actors in the United States system of governments. Just as the national government was created by the states, so are local governments creatures of the state. The Ohio Constitution and Ohio Revised Code outline the form, function and powers of local governments. Ohio government has a rich history. Ohio is a part of western lands ceded by New York, Virginia, Massachusetts and Connecticut. In 1787, the Confederate Congress passed an ordinance for the "governance of the territory of the United States northwest of the river Ohio." This land became known as the Northwest Territory, and eventually five states were carved from it. The ordinance of 1787 provided for and outlined the duties of Territorial officers. Initially they were a governor, a secretary and three judges. The governor and judges were responsible for adopting and publishing "such laws ..., criminal and civil, as may be necessary, and best suited to the circumstances of the district ...." The governor also appointed local magistrates and other civil officers as necessary to preserve peace and order in the townships and counties, also established by the governor. When the free male population of the Territory reached five thousand, the Ordinance of 1787 authorized the election of a general assembly, with one representative for each five hundred free male inhabitants.
