THE OHIO HOME EDUCATION REGULATIONS: NOTIFICATION IN A NUTSHELL IS IT LEGAL? Yes . It is your constitutional right to make education choices for your child. This right was upheld by the Supreme Court of the United States in 1972 ( Wisconsin vs. Yoder). In 1976, the Ohio Supreme Court ruling in you’re The State of Ohio vs. Whisner recognized the primary rights of parents to teach their children at home. Further, your primary parental right to provide the education for your child/ren is specifically safeguarded by Ohio’s home education regulations (OAC 3301-34-02). Ohio law does not specifically provide for home education; the Home Education regulations are based on Ohio Revised Code Section 3321.04-Compulsory Attendance. The requirements specifically addressing home education became effective on August 1, 1989 and can be found under The Ohio State Board of Education Administrative Code-Chapter 3301-34 entitled Rules for Excuses from Compulsory Attendance for Home Education. These requirements carry the same effect as law and school districts may not exceed, change or alter these standard in any manner. These standards serve as rules and policies for districts to follow. The Nautical Know How Basic Boating Course is a NASBLA approved course. Successful completion of this course meets Ohio's requirement for boating safety education. This section contains information on Ohio Boating Regulations that are in addition to the Federal Requirements covered in the Basic Boating Course . If you have not reviewed the course material, please do so now. All Federal Requirements in the basic course apply to Ohio; this section lists Ohio-specific State Requirements that are above and beyond Federal Requirements. Age Restrictions: Effective January 1, 2000, anyone born after January 1, 1982 must successfully complete a NASBLA approved boating safety course in order to operate a vessel powered by a motor of more than 10 horesepower, including personal watercraft. Successful completion of this online course satisfies Ohio's mandatory education requirements. No person under 16 years of age shall operate a personal watercraft (PWC) . Individuals between 12 - 15 years of age may operate a PWC if a supervising person 18 years of age or older is also on board. Other than a personal watercraft, no person under 12 years of age shall operate a vessel unless under the direct supervision of a person 18 years or older. If the vessel is a powercraft powered by more than 10 horsepower, the supervising person shall be aboard the powercraft.

The only notification FORM which is valid is one which has been created by the Superintendent of Public Instruction; there is only ONE such superintendent and her offices are in Columbus at the Ohio Department of Education. Forms created by your school district are not valid and it is suggested that you do not use forms provided by your school district since oftentimes they contain additional or incorrect wording which exceed the requirements of the regulations.
(For example, many such forms ask for "grade level." This is NOT required information under the home education regulations. It is not necessary or desireable to provide it.)

The Family Educational Rights and Privacy Act of 1974, as amended, sets forth requirements designed to protect the privacy of student educational records. The law governs access to records maintained by educational institutions and the release of information from those records. A notice is published quarterly in the Master Schedule of Classes to explain the rights of students with respect to records maintained by the University. It also outlines the University's procedures to comply with the requirements of the Act. Copies of the Act, the Federal Regulations adopted pursuant to it, and this notice are available for persons to examine in the Office of the University Registrar, 320 Lincoln Tower, 1800 Cannon Drive, Columbus, OH 43210-1230. 1. Definition of Education Record The meaning of "education records" is, with certain exemptions as listed below, those records, files, documents, and other materials which contain information directly related to a student, and are maintained by any employee or agent of the University. 3301-34-01 Definitions The following terms are defined as they are used in this chapter. (A) "Certified teacher" means a person who holds a valid Ohio teaching certificate, excluding the certificate issued under section 3301.071 of the Revised Code. (B) "Home education" means education primarily directed and provided by the parent or guardian of a child under division (A) (2) of section 3321.04 of the Revised Code which child is of compulsory school age and is not enrolled in a nonpublic school. What are the legal requirements for homeschooling? Homeschooling is legally permitted in all fifty states, but laws and regulations vary from state to state. In Ohio, homeschooling is regulated by the Ohio Administrative Code (OAC), Chapter 3301-34. All homeschooling families should be familiar with the full text of this regulation. The OAC is also available in many public libraries and at this link below. OAC 3301-34 Here is a brief synopsis:
  • Proper notification must be given to the superintendent each school year.
  • Parent must meet minimum qualifications.
  • Nine hundred (900) hours of home education must be provided each year including language, reading, spelling, writing, geography, history of the United States and Ohio, national, state and local government, mathematics, science, health, physical education, fine arts including music, first aid, safety and fire prevention.
  • An academic assessment report of the child must be sent to the superintendent annually. This report can be the results of a nationally normed, standardized test or it can be a written narrative indicating that a portfolio of the child's work has been reviewed by a certified teacher.

Types of Regulated Care in Ohio What is Covered by the Licensing Law In Ohio Ohio Law defines "child day care" as administering to the needs to the needs of children outside of school hours by persons other than their parents or guardians on a less than twenty four hour basis. Some types of child care must be regulated in Ohio; other types of child care may operate without a license. * What must be regulated? Centers - seven or more children of any age. Centers must be licensed. The Ohio Department of Job and Family Services licenses over 3500 child care centers which care for over 215,000 children each day. Type A Homes - seven to twelve children (or four to twelve children if four children are under two years of age) cared for in the provider's personal residence. The provider's own children under six years of age must be included in the total count. Type A homes must be licensed. 60 type A family day care homes are licensed by the Department of Job and Family Services. Type B homes - one to six children cared for in the provider's personal residence. No more than three children may be under two years of age. The provider's own children under six years of age must be included in the total count. Anyone can operate a Type B Home without a license. However, care for more than 6 children requires a license. Type B homes must be certified by the county department of Job and Family Services if the child care is paid for with public funds. Approximately 7,000 type B homes are certified by local departments of Job and Family Services.
