Administrative Procedures Act (APA) Reference Number and Category: HEALTHY ACTIVE CHILDREN: Section 1. LOCAL SCHOOL HEALTH ADVISORY COUNCIL (a) Each school district shall establish and maintain a local School Health Advisory Council to help plan, implement, and monitor this policy. (b) The local School Health Advisory Council shall be composed of community and school representatives from the eight areas of a coordinated school health program mentioned in Section 4 (a), representatives from the local health department and school administration. Section 2. PHYSICAL EDUCATION AND PHYSICAL ACTIVITY (a) To address issues such as overweight, obesity, cardiovascular disease, and Type II diabetes, each school district shall require students enrolled in pre-kindergarten, kindergarten, and grade level below high school to participate in physical activity as part of the district's physical education curriculum. Elementary schools should consider the benefits of having 150 minutes per week and middle schools should consider having 225 minutes per week of physical activity including a minimum of every other day of physical education throughout the 180-day school year.

Economic Development Board
The Economic Development Board, comprised of some of the state's premier leaders from the business, education, tourism and workforce communities around the state, serves as the state's top economic development policy advisory body and is responsible for recommending economic development policy to the Governor. Appointments to the Board are made by the Governor (who appoints 23 of the 37 members ), by the Speaker of the House and the President Pro Tempore of the Senate. According to General Statute 143B-434 , the Board's membership must also include:

North Carolina Receives High Marks For Improving Teacher Quality

North Carolina was once again among the top 10 states in the nation in efforts to improve teacher quality, according to Education Week's eighth annual 50-state report card, 2004 Quality Counts: Count Me In. North Carolina received a B on Improving Teacher Quality, the same letter grade as in 2003. The full letter grade report card showed North Carolina receiving a B on Standards and Accountability, up slightly from a B- in 2003; and a C+ in School Climate, which is the same grade as in 2003. In the category of Resources, Education Week awards grades for Adequacy and Equity. North Carolina received a C in each category, down slightly from the C+ grades of 2003. North Carolina's performance overall places it in the middle of the nation on most measures except for Improving Teacher Quality. On that particular measure, North Carolina was ranked seventh nationally for its efforts.

Skip to Recent Events Historical Background In 1987, the North Carolina Supreme Court , in Britt v. North Carolina State Board of Education , 361 S.E.2d 71, denied review of an appellate court decision dismissing plaintiffs' case, which had claimed that the state's education finance system violated the state constitution because it caused disparities in school programs and facilities. Ten years later, however, the state's supreme court distinguished the Britt "equity" decision, in Leandro v. State 488 S.E.2d 249 (1997), and remanded plaintiffs' "adequacy" claims for trial. The court declared that the right to education in the state constitution "requires that all children have the opportunity for a sound basic education," echoing the same constitutional standard articulated by New York's highest court in CFE v. State in 1995. Trial Court Decisions The Leandro trial court decided to hear rural plaintiffs (Hoke County) and urban plaintiffs separately and began with the Hoke County plaintiffs. The Rural Center is governed by a 50-member board of directors representing state and local leadership in business, agriculture, education, government, and numerous other areas of public service. Nine members (three each) are appointed by the Governor; Lieutenant Governor; and Speaker of the House. The other members are elected by the board for two-year terms. The business arm of the board is its 13-member executive committee. Programmatic oversight is provided by four committees: Business Development Committee, Workforce Development Committee, Physical Infrastructure Committee, and Civic Infrastructure Committee. Board members also serve on a number of standing and special-issue committees. The full board meets three times each year, generally in October, February and July. Meetings of other committees are held as needed.

    The Organization of Public Higher Education in North Carolina
    The General Assembly of North Carolina combined 16 institutions into a single University of North Carolina governed by a Board of Governors and administered by a president, who has complete authority to manage the affairs and execute the policies of the University of North Carolina and its constituent institutions, subject to the direction of the Board of Governors and the provisions of The Code . Each constituent institution has a separate Board of Trustees and is administered by a chancellor, who serves as the administrative and executive head of each constituent institution and has complete executive authority for the respective institution, subject to the direction of the president and the policies of the respective Board of Trustees and the Board of Governors. The general purpose of combining the institutions into a system is to "foster the development of a well-planned and coordinated system of higher education, to improve the quality of education, to extend its benefits and to encourage an economical use of the state's resources."

    HISTORY OF THE UNIVERSITY OF NORTH CAROLINA In North Carolina, all the public educational institutions that grant baccalaureate degrees are part of the University of North Carolina. The University of North Carolina at Wilmington is one of the 16 constituent institutions of the multi-campus state university.
    The University of North Carolina, chartered by the N.C. General Assembly in 1789, was the first public university in the United States to open its doors and the only one to graduate students in the eighteenth century. The first class was admitted in Chapel Hill in 1795. For the next 136 years, the only campus of the University of North Carolina was at Chapel Hill.
    In 1877, the N.C. General Assembly began sponsoring additional institutions of higher education, diverse in origin and purpose. Five were historically black institutions, and another was founded to educate American Indians. Several were created to prepare teachers for the public schools. Others had a technological emphasis. One is a training school for performing artists.
    In 1931, the N.C. General Assembly redefined the University of North Carolina to include three state-supported institutions: the campus at Chapel Hill (now the University of North Carolina at Chapel Hill), North Carolina State College (now North Carolina State University at Raleigh), and Woman's College (now the University of North Carolina at Greensboro). The new multi-campus university operated with one board of trustees and one president. By 1969, three additional campuses had joined the university through legislative action: the University of North Carolina at Charlotte, the University of North Carolina at Asheville, and the University of North Carolina at Wilmington.

Dr. James E. Shepard, the founder, served as the President of the institution from its founding until his death in 1947.
