Wilmington Street Raleigh, North Carolina 27601-2825 Dear Superintendent Ward: We received copies of the administrative rules, approved by the North Carolina State Board of Education on June 7, 2001, that require greater inclusion of English language learners in assessment and accountability systems and reporting of the results for students who take the alternate assessments. Based on those rules, I am pleased to approve North Carolina's final assessment system. If additional changes are made to North Carolina's assessment system, you must submit information about those changes to the Department as required by section 1111(e)(2) of Title I. Moreover, please be advised that approval of North Carolina's assessment system for Title I does not mean that the system complies with Federal civil rights requirements, including Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act, and requirements under the Individuals with Disabilities Education Act.

CURRICULUM AND INSTRUCTION
Health Education
Statute (2001) requires North Carolina schools to provide comprehensive health education in kindergarten through grade 9, though the law does not specify amounts of instructional time. State Board of Education policy HSP-N-004 16 NCAC 6D.0503 (2002) requires high school students to complete 1 credit (out of 20) in health and physical education in order to graduate.
In 2000-2001 North Carolina revised its Healthful Living Course of Study , which includes standards and a recommended curriculum that districts must follow per Statute
Students in North Carolina are not required to pass a statewide exam covering health education topics at any point in grades K-12.
HIV, STD, and Pregnancy Prevention Education
North Carolina Statute requires schools to provide instruction for students in grades kindergarten through grade nine on preventing sexually transmitted diseases, including AIDS, and other communicable diseases, as well as abstinence until marriage education. The detailed statute specifies that all schools must stress that "a mutually faithful monogamous heterosexual relationship in the context of marriage is the best lifelong means of avoiding diseases transmitted by sexual contact, including AIDS. The North Carolina Healthful Living Course of Study outlines the recommended curriculum that districts must follow.

The Board Phillip J. Kirk, Jr. Phil Kirk currently wears two hats in his professional life. He is serving as the President and Secretary of the North Carolina Citizens for Business and Industry and as publisher of the North Carolina magazine. In November 1997, Governor Hunt selected Kirk for perhaps the biggest challenge of his career when he named him as the Chairman of the State Board of Education. He was re-elected for a two-year term as Chairman of the State Board last year. A native of Rowan County, Kirk is a graduate of Catawba College where he has received an Honorary Doctor of Law degree and the O.B. Michael Award as the outstanding alumnus. The Phillip J. Kirk, Jr. scholarship has been endowed in his name in the Department of Education at Catawba. He has held a variety of jobs, including holding the Chief of Staff's position for Governors Jim Holshouser and Jim Martin and U.S. Senator Jim Broyhill. He has served as the Secretary of the Department of Human Resources under two Governors and in 1970 he became the youngest State Senator of North Carolina history. Among his other former jobs are English and Journalism Teacher, Radio Announcer, Newspaper Reporter, and VP of a nursing home management firm.

Continued Competency Assessment Scores to be Given Only to Pharmacists

The National Association of Boards of Pharmacy (NABP) has announced that the scores from the Association's new computer-administered, multiple-choice Pharmacist Continued Competency Assessment Mechanism will be reported only to pharmacists. Scheduled for implementation in 1999, the Assessment Mechanism will be used as a diagnostic tool to help pharmacists identify areas of practice that require their specific attention or additional education. "As state agencies charged with protecting the public health and welfare, the boards of pharmacy recognize the importance of assuring the public that its pharmacists are competent and able to fulfill their professional responsibilities," stated NABP President Ralph E. Progar. "The philosophy guiding the development of NABP's Pharmacist Continued Competency Assessment Mechanism is one that stresses continuing education rather than punitive measures." During the developmental phase of the Assessment Mechanism, NABP will convene a focus group to ensure the program accurately reflects current standards of practice. NABP will also work closely with the American Council for Pharmaceutical Education (ACPE) to facilitate the development of appropriate continuing pharmaceutical education programming that complements the blueprint for NABP's Pharmacist Continued Competency Assessment Mechanism.

Brief History The North Carolina General Assembly established the North Carolina Board of Science and Technology (the board) in 1963 to encourage, promote, and support scientific, engineering, and industrial research applications in North Carolina. To meet these goals, the Board works to investigate new areas of emerging science and technology and conducts studies on the competitiveness of state industry and research institutions in these fields. The Board also works with the General Assembly and the Governor to put into place the infrastructure that keeps North Carolina on the cutting edge of science and technology. In the earlier days of industrial recruiting, Governor Terry Sanford relied on this board to assist him in persuading firms to locate in North Carolina, particularly if they needed professionally trained people and scientific and engineering support. Later, as our Department of Commerce became more proficient in industrial recruiting, this Board under Governor Hunt began to concentrate on strengthening our research and education base in fields important to our economic growth. G.S. 115C-45(c) reads as rewritten: "(c)Appeals to Board of Education and to Superior Court. – An appeal shall lie to the local board of education from the any final administrative decision of all school personnel to the appropriate local board of education. in the following matters: (1) The discipline of a student under G.S. 115C- 391(c), (d), (d1), (d2), or (d3); (2) An alleged violation of a specified federal law, State law, State Board of Education policy, State rule, or local board policy, including policies regarding grade retention of students The terms or conditions of employment or employment status of a school employee ; and Any other decision that by statute specifically provides for a right of appeal to the local board of education and for which there is no other statutory appeal procedure.
