    he Attorney General's Environmental Protection Bureau is responsible for enforcing the many laws enacted to prevent damage to our environment, and among its powers is the authority to commence affirmative litigation on behalf of the State of New York to protect the public. It also prosecutes, civilly and criminally, violators of the State's Toxic Dumping Laws. Acting on the request of the State Departments of Environmental Conservation and Health, and the Adirondack Park Agency, the Bureau may initiate actions to enforce environmental standards and defends those State agencies when their regulatory actions are challenged in court. In addition, the Bureau's attorneys and technical staff investigate and respond to citizen complaints and, when requested, prepare reports on environmental issues.

    Definition of Charter Schools The New York Charter Schools Act
    Charter schools get their name from the fact that they are schools operated according to a charter or plan that describes how they will function, including their educational philosophy and approach and their financial operation. Any charter school opened under the provisions of this law will have the flexibility to operate free of many State and local educational laws and regulations. But charter schools will be held accountable to the provisions of the charter school law, the provisions of the charter authorized for the school, and the same health and safety, civil rights, and student assessment requirements applicable to other public schools. Top of Page How Charter Schools Are Formed Under the new law, charter schools are public schools funded by tax dollars according to formulas described in the legislation. Any teacher, school administrator, parent or community resident, or a group of such individuals, may apply to establish a charter school. Such individuals or groups may apply to establish charter schools in conjunction with colleges, universities, museums, libraries, not-for-profit corporations, or for-profit businesses or corporations. In addition, existing public schools may elect to convert to charter schools. Existing private or nonpublic schools, however, may not convert to charter schools.

    January 2001 Pesticide Industry Group RISE Communication Attorney General Eliot Spitzer has asked the Department to share with school administrators the following information. In September, a pesticide industry group known as RISE (Responsible Industry for a Sound Environment) wrote to more than 20,000 school facilities managers nationwide, including those in New York State. The materials distributed by RISE promote pesticide use with deceptive claims and irrelevant anecdotes about the health and environmental impacts of pesticides. The Attorney General wants you to be fully informed of the correct information so that you can make pest control decisions to best protect the health of students, staff and visitors. While ostensibly promoting Integrated Pest Management (IPM) at schools, the materials sent by RISE actually encourage continued excessive reliance on pesticides by schools. This central role for pesticides runs contrary to the positions of the Department, the Attorney General’s office and countless other governmental and citizens’ groups. However, it is understandable that RISE advocates this role, given that its mission, as set forth at its web site, is to: (1) provide a strong unified voice for the specialty pesticide industry, (2) positively influence public opinion and policy; and (3) promote the use of industry products.     The safety of our children is of paramount importance to the Department of Health and Mental Hygiene (the Department), as it is to all of us, so I am pleased to be here to discuss food safety in school cafeterias. The Department of Health and Mental Hygiene has included school cafeterias in its food service establishment inspection program since September 1996, even though the Department of Education has a special unit to inspect and monitor food safety in its cafeterias. The Department schedules school cafeteria inspections at least once during each school year. Cafeterias found to meet a threshold for a re-inspection, that is, a combined point total of 28 for critical and general items, are scheduled for an additional inspection on or after 15 days from the date of the original inspection. (The minimum point totals for each violation category are as follows: Public Health Hazards - 7 points; critical violations - 5 points; general violations - 2 points. Additional points may be added in each category to reflect the extensiveness of a violation.) It is important to recognize that this is a complex process and that all violations are not equal. The standard applied by the New York City Department of Health and Mental Hygiene is extremely high, and it is exceedingly difficult to get a perfect score. In fact, it is relatively uncommon for food service establishments of any kind, school food service programs included, to go through an inspection without being cited for some violations. Our inspectors check for more than a hundred different conditions, ranging from the wearing of hairnets and general cleanliness issues to meeting cooking temperature requirements and the proper food storage. There are also many variations of conditions reflected in a given violation that may determine the potential degree of risk to food safety.
