As written, the order violates, in different ways, the rights of all four categories; it recalls Clemenceau's famous comment about the Dreyfus case that "military justice is to justice as military music is to music." Fortunately, public debate over the order has been far more extensive than it has been over the many other violations of rights by the Bush administration since September 11. In consequence, the President's order is being modified by Defense Department regulations and Jus-tice Department practice. These developments demonstrate that even at a time when a commencement speaker at a university is booed off the stage for giving a talk about constitutional rights, and when only one member of the US Senate voted against sweeping federal legislation abridging civil liberties, The Third Geneva Convention of August 12, 1949, ratified by the United States Senate on July 6, 1955, defines prisoners of war as: (1) Members of the armed forces of a Party to the conflict, as well as members of militias or volunteer corps forming part of such armed forces.

Seems that they have been doing it right for so long it has become routine," Smrekar says. The yearlong study by the Peabody Center for Education Policy at Vanderbilt looked at 1998 test results of the National Assessment of Educational Progress, a congressionally mandated exam popularly called the Nation's Report Card, and the SAT college entrance exam. Key findings: In eighth-grade writing, 38% of DOD domestic students and 31% of those overseas scored at grade level or higher. This was second only to Connecticut and above the national average of 24%. NAEP ranks students at one of four levels: below basic, basic or partial mastery of materials, proficient or grade level and advanced. DOD had more students scoring in the advanced bracket than any other state or jurisdiction. The majority of U.S. students perform at basic levels or below. DOD schools have a much higher percentage of black and Hispanic students, and both groups posted higher scores in reading and writing than the national averages for their peers.

By BOB McMANUS Email Archives Print Reprint May 12, 2004 JOHN Boyd was a hotshot U.S. Air Force fighter pilot who may have been the most influential war strategist that no layman ever heard of - and who would have understood perfectly what just happened to Nick Berg in Iraq, and why. Boyd was legendary on several levels, but is best known as a brilliant student of change in war - revolutionary change, the sort that happens when one side shows up at an infantry fight with tanks and airplanes, and things are never the same again. That would have been Europe, in 1939 and 1940, when massed German armor and close air support shattered numerically larger Polish, French and British armies that hadn't adapted to the internal-combustion engine - and thus were doomed before the first shots were fired. The U.S. and Soviet armies did adapt, eventually - and, of course, prevailed.

RELATED U.S. Department of Education BOSTON, Massachusetts (AP) A little-noticed provision in a new federal education law is requiring high schools to hand over to military recruiters some key information about its juniors and seniors: name, address and phone number. The Pentagon says the information will help it recruit young people to defend their country. But the new law disturbs parents and administrators in some liberal communities that aren't exactly gung-ho about the armed forces. Some say the law violates students' privacy and creates a moral dilemma over the military's "don't ask, don't tell" policy on gays. "I find it appalling that the school is sending out letters to do the job of the military," said Amy Lang, the parent of a student at Cambridge Rindge and Latin School, where Coke was once banned in a protest against the soda giant's investments in apartheid South Africa. "It's clearly an invasion of my daughter's privacy." The No Child Left Behind law, signed last January, pumps billions into education but also gives military recruiters access to the names, addresses and phone numbers of students in 22,000 schools. The law also says that schools must give the military the same access to their campuses that businesses and college recruiters enjoy.

Update October 7 reports from around the country This October 7th, on the second anniversary of the bombing of Afghanistan, the Not In Our Name Youth Network is calling on youth and students to take a stand against the military recruiters. As the US Government's war and occupations of Iraq and Afghanistan continue, the recruiters have become even more aggressive in targeting us in our schools and communities, as well as on the airwaves. Increased ads on MTV and BET, as well as in magazines and billboards, are meant to complement recruitment efforts on campuses, creating an environment of militarism which cannot be ignored or avoided. The unjust and immoral wars that the government wages in our name can only continue with a constant supply of fresh recruits. We have a responsibility to stand with the people of the world and refuse to fight in these wars of empire. Every day more and more young people are enticed with empty promises and outright lies about the purposes and benefits of the military. We must counter this by spreading truth and resistance to the war machine.

Argentine Military Battles Antisemitism

In another sign of change in South America, the Argentine military signed an agreement earlier this month incorporating the Anti-Defamation League's educational materials on racism and antisemitism into the curriculum of the country's military schools. The agreement between the army and the Rioplatense foundation, an Argentine human rights group, was supposed to have been celebrated last week in New York with a meeting between the ADL's national director, Abraham Foxman, and Fernando Maurette, Argentina's vice-minister of defense and the person responsible for the project. The event was canceled because of the snowstorm that engulfed New York last Tuesday. Maurette explained in an interview with the Forward that the agreement was intended to ingrain human rights values in an institution that is still associated by many with the military junta of the 1970s, and in Jewish minds with Nazi sympathies. "There is a prejudice against the Argentine military even though the army has remained on the sidelines of politics over the past 20 years, and this even though there has been a lot of chaos recently and many opportunities for them to interfere," said Maurette, who is an anthropologist with no military background. "So we need to improve not only the image, but also make sure this teaching is thorough."

Military Schools Exempted from "No Child Left Behind" Requirements

Fifty-eight military schools, operated by the Department of Defense at military bases in Alabama, Georgia, Kentucky, New York, North Carolina, South Carolina, and Virginia, are exempted from the requirements of the 2002 federal education act, mandating strict standards for testing and teacher certification, with penalties for schools that fail to meet the goals. The Department of Defense schools don't fall under "No Child Left Behind" requirements because their funding comes from the DoD rather than the Department of Education. Doug Kelsey, the deputy director of the DoD's school system, said that the schools are trying to live up to the spirit of the legislation despite the fact that the DoE has no jurisdiction over DoD schools. "We actively comply with the intent of the law," he said.

T he Seattle School District, by allowing military recruiters on its high school campuses, is evidently in conflict with its own policy of non-discrimination based on sexual orientation. This policy, in effect since 1991, is in clear conflict with the "Don't Ask, Don't Tell" guidelines of the Department of Defense. The Seattle School District Superintendent's office, when asked for the authority under which the military is allowed into schools, referred to a state statute (RCW 28A.230.180) that gives access to military recruiters "on the same basis" as any other organization that seeks to make students aware of occupational or educational options. In actual fact, the military enjoys an exception to district policy. If Microsoft or Boeing for example, had employment policies that rejected gay/lesbian job applicants or fired them for open admission of their sexual orientation, would these companies be allowed on high school campuses?
Despite federal and state laws that mandate access by the military to public schools, there have been several successful efforts to ban recruiters from high school and college institutions because of discrimination against gays and lesbians.
