One of the major issues addressed by the legislation is the quality of teachers for children with special needs. IDEA ’97 requires students receiving special education services to be educated with their non-disabled peers to the “maximum extent practicable.” As a result, according to a 2001 report from the Study of Personnel Needs in Special Education, 75% of students receiving special education services spend 40% or more of their day in general education classrooms. Consequently, 96% of general education teachers currently teach, or have in the past taught, children with special needs.

How have states responded to the challenge to prepare general education teachers to meet the needs of students with special needs? According to ECS’ Teacher Preparation Policy Database (http://www.tqsource.org/prep/policy/), 46 states and the District of Columbia currently have statutes or regulations requiring teacher education programs to provide some instruction on teaching children with special needs to individuals seeking initial training in elementary or secondary education. The amount and content of this instruction, however, varies dramatically.

Is it possible for a gifted child to have a disability, or a child with a disability to be gifted? Whitmore and Maker (1985) discussed four obstacles to identification:
  • Stereotypic expectations that disabled persons are below normal.
  • Developmental delays, particularly in verbal area, among disabled children, so their high intellectual ability usually goes undetected when using verbal tests with them.
  • Incomplete information about the child, which results in overlooking areas of strength that might be displayed in nonacademic settings.
  • No opportunity to demonstrate superior ability because of the highly verbal nature of school tasks and ability testing used in special education.
To lessen these barriers, schools must use nonverbal intellectual measures as well as alternative assessments. Child Find programs should encourage the search for giftedness as they assess children who might be disabled. As in all things, early intervention is a key to ultimate success. Dear Governor Johnson: et seq . We conducted our investigation by touring the School with two consultants from April 23-26, 1997; reviewing documents; and meeting with current and former staff, students and their families, and other interested persons. Our review of documents included numerous School and State documents and individual students' records.
During our tour and throughout our investigation, we received the cooperation of the staff at NMSVH. We appreciate the unimpeded access to the School that State officials afforded us.
NMSVH is a residential facility, established in 1903 for the purpose of educating students with visual impairments. The census of students at the School, which once numbered two hundred or more, has dropped in recent years to between sixty-five and seventy students. The number of students in attendance fluctuates during the school year primarily as a result of expulsions and removal of students by their parents. The School educates some of its students year-round, while other students return home for the summer term. The School's summer program is open to young people who do not attend the School during the regular school year.
Approximately half of the students at NMSVH have one or more disabilities in addition to their visual impairment; some of these children are nonverbal. Many of the students have behavior problems and some have significant medical needs. At least half of the students at the School are considered to be of average or above average intelligence.

One more try, but it doesn't work. You are still staring at the same page. Now you're frustrated, so you hit the Control/Alt/Delete keys which completely shuts down the Internet. You have to start over. Frustrated, you wonder what was the problem. The answer? The programmer of that particular Web site "coded" or "programmed" the page so you couldn't get out. This experience is comparable to the frustration an individual with a disability feels each time he or she uses a computer with a Windows-based software environment IN PARTICULAR when working WITH the Web. Computer-use assistive devices, designed to help people with disabilities keep up, are typically insufficient for most people who need them. The bells and whistles (literally) of most Web sites defeator at least severely impedemost assistive devices, including screen readers, adapted keyboards, specialized Web-reading software, screen-enlargement software, and other similar technology.

The amendment allows states and school districts to exempt one percent of those students from having to take the grade-level standardized tests they administer each year to determine if their students are making the annual academic progress the federal government expects of them.
Because New Mexico averages a higher number of special education students than most other states, Gallup-McKinley County Schools has urged its Public Education Department to take advantage of a provision in the amendment which allows states to ask for an even larger exemption. But a closer look at the numbers reveals it may not have to.
Though New Mexico may have an above-average proportion of special education students 19.6 percent versus 13.3 percent nationally during the 2001-2002 school year, according to the U.S. Department of Education fewer than one percent of New Mexico students are specifically diagnosed as having "significant cognitive disabilities," disabilities typically that severely impair a student's IQ. And it's only the latter group states may exempt, said New Mexico Director of Special Education Sam Howarth.
According to Howarth, roughly 0.7 percent of New Mexico public school students fall into that category, well below the proportion of students it may exempt.
