Recently, we received a letter from the State of New Jersey indicating that since we had completed projects for clients there, we're required to file tax returns there for those past years. Are we likely liable for service taxes in New Jersey? Which other states tax services in this way? A:
In determining whether a corporation is "doing business" in another state, you would have to look at the rules governing each state. The commerce clause of the U.S. Constitution limits each state's ability to tax activities outside of its boundaries. In the case of New Jersey, consideration is given to the following factors: the nature and extent of the activities of the corporation in New Jersey, the location of its offices, and the continuity, frequency and regularity of the activities of the corporation in that state. The employment in New Jersey of agents, officers, and employees also is a factor, as is the location of the actual seat of management or control.

SCORE is a 10,500 volunteer association sponsored by the U.S. Small Business Administration. As of January 2003 there are approximately 300 members of SCORE available in the State of New Jersey to assist present and potential business owers. The association has matched volunteer business-management counselers with clients in need of expert advice. SCORE has experts in virtually every area of business management and maintains a national skills roster to help identify the best counselor for a particulat client. Volunteer counselors, whose collective experience spans the full range of American enterprise, share their management and technical expertise with both present and prospective small business owners. Small Business Development Centers SBDCs provide training, counseling, research and other specialized assistance at nearly 1000 locations nationwide. The New Jersey Small Business Development Center (NJSBDC) network is part of a national partnership between the state and federal governments, the private sector, and colleges and universities. A variety of educational and business resources are available to counsel and train small business owners to finance, market and manage their companies. Business Information Centers Business Information Centers (BICs) are a one-stop reference facility with computer counseling stations, video cassette monitors and nearly 200 sample business planning guides. The BIC combines computer technology with an extensive small business reference library of hard copy books, publications and current management video tapes to help entrepreneurs plan their business, expand an existing business, or venture into a business area. BIC personnel can help direct you to other resources and can arrange for free business counseling with a volunteer from the Service Corps of Retired Executives SCORE).

First convened in December, 1995, the Jump$tart Coalition for Personal Financial Literacy determined that the average student who graduates from high school lacks basic skills in the management of personal financial affairs. Many are unable to balance a checkbook and most simply have no insight into the basic survival principles involved with earning, spending, saving and investing. Many young people fail in the management of their first consumer credit experience, establish bad financial management habits, and stumble through their lives learning by trial and error. The Coalition’s direct objective is to encourage curriculum enrichment to insure that basic personal financial management skills are attained during the K-12 educational experience. The wheels of education do not need to be reinvented, they simply require balance.
In a speech to the Jump$tart Coalition on November 7th, U.S. Senator Daniel K. Akaka (D-Hawaii) profiled efforts underway in Congress to improve the financial literacy of Americans of all ages, from children in school to adult investors. Click HERE for the text of his remarks.
