REGULATION OF FOR PROFIT CONVERSIONS IN THE
HEALTH CARE INDUSTRY
New Jersey State Nurses Association supports the regulation of for-profit conversions in the health care industry. Areas for regulation of conversions should include safeguard disclosure of the full value of the non-profit organization's assets. New Jersey State Nurses Association supports proceeds from the conversion to be used for essential and charitable health care services within the community of origin. Without regulation the conversion process remains unstructured. The public does not have access to the financial details of the transaction, assets are often undervalued and "available information does not allow a careful assessment of how well vulnerable populations continue to be served when public or nonprofit hospitals convert to for-profit ownership or management" (Challot, l996). For-profit organizations often discontinue offering essential health services, which they consider unprofitable. A foundation may be formed for the charity care services were still being forwarded out of the foundation assets rather than the for-profit hospital assets. To counter these problems a regulatory process should be formed to accomplish the following three objectives: 1) safeguarding the value of the charitable assets, (2) safeguarding the community from loss of essential health services and, (3) ensuring that the proceeds of the transactions are used for appropriate charitable purposes (Boisture et al, l995). In addition, the regulatory process should include an independent review of the appropriateness of the transactions determining that sale proceeds are not used for private benefits.

    EPIC Award Honors Gary Carter, NJHA President and CEO NJHA President and CEO Gary Carter was honored with an EPIC Award Thursday from The Institute for Nursing. The awards are presented annually to recognize "Exceptional People Impacting the Community" who advance community wellness, promote healthcare initiatives and support the nursing profession in New Jersey. In accepting the award, Carter bestowed the "exceptional" label to the state's 67,000 nurses.     Resident Assessment Instrument Users' Manual Revisions The Centers for Medicare and Medicaid Services has published revisions to sections of the Resident Assessment Instrument Users' Manual, effective April 26. Among the changes are revised examples illustrating levels of dependency in activities of daily living and revisions to coding instructions for skin lesions, certain medications and diagnostic and surgical procedures.     We, the undersigned, believe that regulations governing the use of aversive, restraint, time-out and seclusion interventions are required to protect the safety and dignity of students with disabilities.
    We support legislation that would provide guidelines on how such interventions should be implemented.
    We believe:
    Parents must receive written notice in the form a behavior intervention plan from their school district prior to the use of aversive, restraint, time-out and seclusion interventions in the education of a child with a disability including the frequency, duration, and rationale for the use of restraints. Such interventions may not be included in an initial behavior intervention plan and may only be utilized after positive behavioral interventions and supports have proven to be ineffective.
    School districts may not use aversive, restraint, time-out and seclusion interventions prior to informed parental consent.

    Governing the Operation of Degree-Granting
    For-Profit Institutions of Higher Education March 2000
    Abstract
    The Education Commission of the States (ECS) surveyed 11 states to inquire about regulations governing the operation of degree-granting for-profit institutions of higher education. Based on the survey results, for-profit institutions are not singled out in the regulatory process. For-profit institutions undergo similar application reviews to those required of private nonprofit institutions (with the exception of providing supplemental forms on shareholders). While most states, however, provide some form of financial assistance to students attending for-profit institutions, it is not on the same level as the aid available to public and private nonprofit institutions.
    Introduction
    With the rapid growth of for-profit institutions of higher education, many questions arise about quality, competition, market models and appropriate public policy. The Education Commission of the States (ECS), with a grant from the Alfred P. Sloan Foundation, undertook a descriptive study of the growth and impact of for-profit institutions that grant degrees. As part of that study, ECS asked 11 state agency leaders with large for-profit sectors and markets to share information on how they regulate these institutions of higher education. As for-profit institutions grow in number and size, public agencies charged with oversight and consumer-protection responsibilities must respond within existing legal frameworks. The purpose of the study was to determine if and how these frameworks are changing.
