In New Jersey, the Legislature under the compulsory education law ( N.J.S.A. 18A:38-25) has permitted children to receive "equivalent instruction elsewhere than at school," including the home. The following homeschooling questions and answers are intended to assist parent(s)/guardian(s)and public school districts in dealing with issues that frequently arise in this context.

  • The following New Jersey statutes apply to compulsory education:
    • N.J.S.A. 18A:38-25 requires compulsory education in New Jersey: "Every parent, guardian or other person having custody and control of a child between six and 16 shall cause such child regularly to attend the public schools of the district or a day school in which there is given instruction equivalent to that provided in the public schools for children of similar grades and attainments or to receive equivalent instruction elsewhere than at school." N.J.S.A.

    Tests Required in New Jersey
    Tests Required for Licensing in New Jersey
    Effective September 1, 2000, applicants for licensing in elementary education must pass the Elementary Education: Content Knowledge test. Applicants for New Jersey licensing for subject teaching fields must pass the appropriate Praxis II: Subject Assessment or Specialty Area test(s). The tests are required for all applicants, including those who are licensed in other states. Certain teaching fields are exempt, as noted in the listing below. Applicants for licensing for the Speech-Language Specialist endorsement must pass the Speech-Language Pathology Specialty Area test. Applicants for licensing for the Principal and/or School Administrator endorsements must pass the Educational Leadership: Administration and Supervision Specialty Area test.

    ESEA - No Child Left Behind Act
    The 1965 Elementary and Secondary Education Act (ESEA) was renewed by Congress and signed into law January 8, 2002. The main provisions of the law focus on academic improvement, annual testing, teacher and paraprofessional quality, and other academic programs.

    NJEA seeks Changes to NCLB - The LEE Group (Leadership for Educational Excellence), of which NJEA is a member, is calling upon the state to adopt recommendations for correcting problems with New Jersey's implementation of the federal No Child Left Behind Act (NCLB). (3/24/04) The N.J. Department of Education submitted to the U.S. Department of Education on April 1, 2004, an application to amend its "accountability workbook" which defines how it will implement the ESEA/No Child Left Behind Federal Law. The application includes several changes to the original plan, including increasing the minimum number of special education students required to be counted as a subgroup for sanctions under "adequate yearly progress" from 20 to 35. It decided, however, not to make changes to the number for any other subgroup categories. The document can be found on the NJDOE's website at http://www.nj.gov/njded/grants/nclb/workbook.pdf
