The following is the sixth in a series of legislative endeavors in the state of New Hampshire to correct the unconstitutionalities of our home education law. We are not being covert in our actions. Our intent to have a law with which all persons can comply in good conscience without the loss of ANY constitutional liberties.

Editor's note: The NH NIPE bill was defeated. HSLDA made no effort to support this bill to remove hs'ing regulations unlike the situation in 1990 when HSLDA actively participated in the dialogue and sent Mike Smith to personally lobby the NH Legislature to give us hs'ing regulations. New Hampshire's Home Education Law
with Commentary by Doris Hohensee (doris@mainstream.net) I.Summary of objections:
  • Mere compliance with N.H.'s home education law results in a loss of parental rights. Although courts have upheld the primary right and obligation of parents to raise and educate their children, New Hampshire law recognizes only "the primary right and obligation of a parent to CHOOSE the appropriate educational alternative for a child under his care and supervision, AS PROVIDED BY LAW." Parents' right to educate their children has now been reduced to a choice of State-approved State-regulated educational alternatives and then only "as prescribed by law."
  • N.H.'s law requires parental 'application' not 'notification' to the State.

In addition, local voters have two opportunities to approve or deny charter schools: 1) voters decide whether they will allow charter schools in their district; (2) after a specific charter school contract is approved by both the local school board and the state board of education, it is put on ballot for voter ratification; additionally, since charter school budget is shown as a separate line item in district’s budget, voters could in theory limit or eliminate funding for the school.
