Governor Shaheen and House GOP Unveil Tax Plans

Yesterday, the House Ways and Means Chairman, David Alukonis, told us that he expects his Committee to consider 70 to 80 bills this session. Most of them will be somebody's idea on how to pay for public education in New Hampshire. Two high-profile plans were revealed this week.
Governor Shaheen's EXCEL New Hampshire Plan
Governor Shaheen released her EXCEL New Hampshire Plan which combines a new and improved statewide education property tax at the reduced rate of $4.90 per $1,000 of valuation, except for utility property which will continue to be taxed at the rate of $6.60 per $1,000. The EXCEL Plan also includes a 2.5% narrow based sales tax, which reportedly will exempt the necessities of life such as food, clothing, fuel, and prescription and non-prescription medications. Services are reported to be excluded from the tax base. It appears as though the proposal is a traditional retail-only sales tax. The Governor's plan also rolls back the Business Enterprise Tax, which is a tax on the interest, dividends and compensation paid by business enterprises from a rate of .50% to the originally enacted rate of .25%. The EXCEL Plan also reduces the interest and dividends tax from 5% to 4.5% and outright repeals the inheritance tax. The plan also funds the Land and Community Heritage Investment Program with one-sixth of the existing real estate transfer tax revenue. When added to the other revenue sources which fund the Education Trust Fund (ETF), the EXCEL Plan purports to raise a total of $916,000,000 for fiscal year 2002 (July 1, 2001 through June 30, 2002).

The New Hampshire Constitution ensures that religious societies have the right to elect their own teachers. Registration/Licensing/Accreditation: The approval of private schools as a substitute for public school attendance is a reasonable exercise of the state's power whereby it can be known by reasonable means that the required teaching is given. State v. Hoyt , 146 A. 170 (1929). N.H. Code Admin. R. Ed. 400, 406.6. Recordkeeping/Reports: Length of School Year/Day: To comply with the compulsory attendance requirement, attendance at an approved private school must be 180 school days. N.H. Code Admin. R. Ed. 401.03. Instruction in English: Curriculum: Special Education: Health: Safety: Transportation: Home Schooling: Home schools are not considered non-public schools in New Hampshire. Home schools are considered a third type of school for attendance purposes. On or before the date a home education program will begin, and each year thereafter, a parent desiring to initiate a home education program must advise the participating agency with which the program will be established. Participating agencies can be the resident district superintendent, commissioner of education, or nonpublic school principal. N.H. Code Admin. R. Ed. 315.01; 315.03. No later than 30 days after the establishment of a home education program, the parent must provide the following information to the participating agency: list of subjects to be taught in accordance with RSA 193-A; 4,1; the name of the correspondence school used, if any; the name of the commercial curriculum provider, if used; an outline of the scope and instructional sequence for each subject; and a list of textbooks or other instructional material to be used. N.H. Code Admin. R. Ed. 315.03.

Advanced Systems (now Measured Progress) has been the contractor for its home state's assessment program, the New Hampshire Education Improvement Assessment Program (NHEIAP), since it began in 1992. About 17,000 New Hampshire students are tested at grade 3 in English language arts (including writing) and mathematics. Tests at grades 6 and 10 in English language arts (including writing), mathematics, science, and social studies are taken by an estimated 34,000 students. Since 1998, Measured Progress also provides the NHEIAP Alternate program for 300 students in grades 3, 6, and 10, tested in English language arts, math, science, and social studies. Its mission is to advance the administration of justice by providing legal information and related services to the judicial, legislative, and executive branches of government, the legal communities of New Hampshire, and the people of the state.
History In 1716, a collection of law books belonging to the provincial government formed the first state library collection. After the State House was built in 1816, a room was set aside for the library. For a time, the Secretary of State also served as the State Librarian. In 1895, a separate building was constructed to house the State Library and the New Hampshire Supreme Court. In1943, the State Library separated out its legal materials and created a Law Division of the State Library. It served as the law library for many years. In 1970, the current Supreme Court building was constructed, and the Law Division of the State Library moved, along with the New Hampshire Supreme Court, to the Supreme Court building.

new appellate review process and began accepting all direct appeals from the state's trial courts for the first time since 1979. Under the new system the court will accept virtually all cases from the district, probate and superior courts and review them following full briefing and submission of a transcript of the lower court proceedings. The Supreme Court will then decide whether the case should be scheduled for oral argument or decided on the briefs alone. The final decision of the court will be issued either in a brief order, an order with some explanation, or a full written opinion. Cases scheduled for oral argument will be heard either by the full court or a three-justice panel. Decisions of a three justice panel must be unanimous and a written decision is issued in each case, usually within two to three weeks of argument.     General Adult Services provides walk-in, telephone, e-mail and mail reference services. The department maintains a large collection of circulating fiction and nonfiction books, circulating periodical titles, microfilm of various newspapers, New Hampshire State Documents and up-to-date reference sources. The Hunt Room contains historical and genealogical material, and interlibrary loan services allow customers to borrow material from other libraries. Adult Services also maintains an Outreach Services program, which provides various services to customers who can't easily access the services of the main library.
    Interlibrary Loan Services
    Nashua Public Library customers may obtain materials from other libraries in New Hampshire as well as from other United States libraries through Interlibrary Loan (ILL). Materials borrowed from libraries within the state generally will arrive within a week to ten days. Books from out-of-state may take longer. Some university or special libraries may charge loan fees. Items owned by the Nashua Public Library; new books; rare, fragile, or books in high demand may not be requested.

The FAA worked with the Nashua School District in seeking a partnership agreement between FAA, New England Region and the School District- 12 Elementary schools, 3 middle schools and 1 high school. The fruits of these labors culminated in an official partnership signing ceremony on May 21, 1998 on the campus grounds of the Nashua High School.

New Hampshire's Home Education Law
with Commentary by Doris Hohensee (doris@mainstream.net) I.Summary of objections:
  • Mere compliance with N.H.'s home education law results in a loss of parental rights. Although courts have upheld the primary right and obligation of parents to raise and educate their children, New Hampshire law recognizes only "the primary right and obligation of a parent to CHOOSE the appropriate educational alternative for a child under his care and supervision, AS PROVIDED BY LAW." Parents' right to educate their children has now been reduced to a choice of State-approved State-regulated educational alternatives and then only "as prescribed by law."
  • N.H.'s law requires parental 'application' not 'notification' to the State.
