Across the United States, 37 States and the District of Columbia have enacted charter school legislation. In September 2002, 77 additional schools were approved to open with approximately 300 more being reviewed. New Hampshire is now the only state with a charter school law under which no charter schools have emerged.
  • Under New Hampshire law, the State Board of Education reviews applications for completeness and awards a five-year charter. This does not ratify the charter and approve its opening, however. Ratification is by vote of the legislative/ budgetary authority of the specific New Hampshire city or town.
  • Although specific timelines are listed in statute, New Hampshire's charter school law includes a provision allowing the school board and state board to waive any deadlines applying to their respective actions. (RSA 194-B:3, XII). In fact, there is no prohibition against both enabling votes taking place on the same day, one after the other, if the review and charter-granting process has already taken place.
  • The generic authorization vote can also take place at a special district meeting called at any time by petition. Since this vote does not require raising money as per RSA 197:3, the courts do not need to be petitioned to hold the special district meeting.

Charter schools do not have to meet state standards; up to 50 percent of the teachers may be uncertified; and employees may not remain in the bargaining unit. The New England Board of Higher Education (NEBHE) named New Hampshire state Sen. Lou D'Allesandro (D-Manchester) chair of the regional organization. NEBHE was established in 1955 by a congressionally authorized, interstate compact designed to encourage cooperation among New England colleges and universities, which now number more than 270. NEBHE programs focus on the relationship between New England higher education and regional economic development. D'Allesandro is serving his third term in the New Hampshire Senate, where he is the deputy minority leader. He is chair of the Ways and Means Committee, vice chair of the Capital Budget Committee, and a member of both the Rules and Enrolled Bills and Finance committees. He is also a member of the Fiscal Committee of the General Court. "I am honored to have been selected to serve as chairman of the New England Board of Higher Education," said D'Allesandro. "As a public servant, I recognize the importance of establishing effective partnerships on issues of mutual interest.     • FILLING THE VOID: Governor Benson is scheduled to sign a bill that will dramatically improve New Hampshire's charter school law. Though the original law was created in 1995, not a single charter school has opened since then. This new bill will now allow the state board of education to sponsor charter schools, creating a multi-authorizer environment, and it does away with some very harmful provisions that were part of the original bill, including one that required charter schools to be their own LEA (Local Education Agency) for special education purposes. This is a monumental victory for charter school advocates in New Hampshire, who have been working for eight long years to be true participants in the charter school movement.     To the Editor: At a senate hearing for HB 727, the Parental School Choice Voucher Bill, Sarah Browning read a note written by Fred Bramante, Chairman of the State Board of Education. Paraphrasing this note: Fred Bramante was opposed to the Parental School Choice Voucher Bill because on May 17th the Real World Learning Conference would allow for exploring school choice options. At the end of the conference, Nicholas Donahue, Commissioner of the NH Department of Education, gave a presentation and spoke about the most popular ideas resulting from all 18 work sessions. Surprisingly, nothing was mentioned about private school choice/vouchers. I find it disturbing that, although the impression was given that this conference would seriously explore school choice issues, the private school choice issue/vouchers, though most popular, was eliminated in the conclusion.     The New Hampshire Constitution ensures that religious societies have the right to elect their own teachers. Registration/Licensing/Accreditation: The approval of private schools as a substitute for public school attendance is a reasonable exercise of the state's power whereby it can be known by reasonable means that the required teaching is given. State v. Hoyt , 146 A. 170 (1929). N.H. Code Admin. R. Ed. 400, 406.6. Recordkeeping/Reports: Length of School Year/Day: To comply with the compulsory attendance requirement, attendance at an approved private school must be 180 school days. N.H. Code Admin. R. Ed. 401.03. Instruction in English: Curriculum: Special Education: Health: Safety: Transportation: Home Schooling: Home schools are not considered non-public schools in New Hampshire. Home schools are considered a third type of school for attendance purposes. On or before the date a home education program will begin, and each year thereafter, a parent desiring to initiate a home education program must advise the participating agency with which the program will be established. Participating agencies can be the resident district superintendent, commissioner of education, or nonpublic school principal. N.H. Code Admin. R. Ed. 315.01; 315.03. No later than 30 days after the establishment of a home education program, the parent must provide the following information to the participating agency: list of subjects to be taught in accordance with RSA 193-A; 4,1; the name of the correspondence school used, if any; the name of the commercial curriculum provider, if used; an outline of the scope and instructional sequence for each subject; and a list of textbooks or other instructional material to be used.     101 Pleasant Street Concord, New Hampshire 03301 Dear Mr. Donohue: In order to receive approval of its final assessment system under Title I, New Hampshire needed to: revise its policy to require that all students, including limited English proficient students, be assessed; include the results from the alternate assessment for students with disabilities in the accountability system and in state, district, and school reports; and provide the Department with technical reports and alignment studies. In regard to the proposed policy for including all students in the assessment system, New Hampshire will send the policy approved by the State Board of Education and evidence that the policy is being implemented for the 2000-2001 test administration to the Title I office. As indicated in your letter, the State will also forward copies of its revised State, district, and school reports prior to the 2000-2001 test administration showing the results of students taking the alternate assessment as well as how these results are included in measures of school progress. When the above changes have been implemented, New Hampshire will have met those Title I requirements.

    The Colorado State Board of Education will have the power to approve charter schools under a new bill signed into law by Gov. Bill Owens. Under the new charter program, charter school organizers will be able to bypass local school districts that reject or refuse to hear requests to set up charter schools. The law, created in response to several districts where local boards have restricted new charter schools, also creates a charter school institute as an agency of the state department of education. Two additional laws were also approved concerning charter schools. One requires greater accountability for charter schools and their authorizing districts, while the other creates a system for monitoring student academic progress over time.
