HSLDA News December 18, 2002 Nevada State Board of Education Passes New Homeschool Regulations The Nevada State Board of Education met on Saturday, December 14, and approved MOST but not all of the changes to the homeschooling regulations proposed by Nevada homeschoolers. Read the new regulations at: http://www.hslda.org/hs/state/nv/nvhsregs2002.pdf (Requires Adobe Acrobat Reader This was a great relief to three families from Goldfield, Nevada, whom Child Protective Services had expressly threatened with removal of their children unless they signed their county's homeschool paperwork (in accordance with the old regulations). They signed their county's forms under protest and with the express condition that any agreement they entered into would be binding only until the State Board amended the regulations. Home School Legal Defense Association is pleased with the changes that were enacted by the State Board of Education. We were, however, surprised and disappointed at the last-minute objections that kept us from improving the law governing homeschool consultants. Nevada is one of only two states in the country that legally require a consultant for new homeschoolers. In the other 48 states, local support groups voluntarily give new homeschoolers a helping hand, with excellent results. The consistent experience of other states proves that there is no need for a law mandating consultants for new homeschoolers. HSLDA is committed to work together with Nevada's homeschool organizations to repeal the consultant law sometime in the future.

Dear HSLDA Members and Friends, A lot has happened since August 9, when I first informed you that the Department of Education has decided that home schoolers must comply with Nevada's new Content and Performance Standards. The bad news is that the Department insists that Nevada law requires this. The good news is that after hearing all the objections from HSLDA and Nevada home school leaders, they are not going to try to make families meet these new Standards this fall. It is our understanding that they intend to propose changes to the regulations that govern home schoolers within a few weeks or months. This gives Nevada families a chance to get organized in defense of freedom!

Registration/Licensing/Accreditation: only Regulations passed by the State Board of Education in September 1999 allows licensed schools to employ teachers licensed in other states or territories, as long as the percentage of licensed teachers vs. unlicensed teachers does not drop below 70 percent. The unlicensed teachers must have either a bachelor?s or master?s degree with verified full-time or supervised experience. Recordkeeping/Reports: Private elementary and secondary schools may not permanently admit a student until the parent/guardian furnishes a birth certificate or other proof of the child's identity, and if applicable, the students prior school records. Children must be admitted to a school under the name appearing in the identifying documents, unless the parent/guardian furnishes a court order to the contrary or the child is in the custody of the welfare division. If the parent/guardian fails to furnish identifying documents within 30 days of conditional admission, the principal must notify the local law enforcement agency and request a determination whether the child has been reported missing. Nev. Rev. Stat. 394.145. Curriculum: Health: Safety: Transportation: Home Schooling: A child may be excused from compulsory attendance requirements when written evidence is provided to the board of trustees of the county school district that the child will receive equivalent instruction. The request must include a statement about the person who will be teaching, where the instruction will take place, the educational plan including the proposed educational goals and the instructional materials to be used, a calendar of the proposed days of teaching, and evidence of qualification of the instructor.     English Literacy/Civics Revision
    COMPETITION A new competition will be conducted for multiple-year grants for English Literacy/Civics. Nevada will use not more than five percent (5%) of the State award for State administration. Both program funds (82.5% of State allocation) and leadership funds (12.5%) will be allocated through a competitive bid process after notices have been posted and mailings sent out to potential applicants. As it is hoped that new providers, assuming eligibility, will compete for English Literacy/Civics funds in this new competition, the RFP will be sent out to a broad spectrum of potential applicants. In addition, per state regulations, ads will be placed in newspapers throughout the state to alert potential applicants. The entire English Literacy/Civics allotment will be used for English Literacy/Civics purposes. Funds and activities for English Literacy/Civics efforts will be tracked separately from Adult Basic Education/English as a Second Language funds. All eligible providers have direct and equitable access to apply for this grant. The same grant announcement process and the same application process will be used for all local providers; this process is described in 6.3 of the Nevada Five Year State Plan for Adult Education.

However, a child may be excused if "the child's receiving at home or in some other school equivalent instruction of the kind and amount approved by the State Board of Education." (§392.070). Nevada statutes do not expressly allow or prohibit Released Time for religious instruction for public school students. EDUCATION REGULATIONS: (Policy) None CASES: No cases reported. ATTORNEY GENERAL OPINIONS: 1) AGO 320 (3-3-1954) This opinion expressly states that Released Time from public school attendance for the purpose of religious instruction is not authorized by Nevada Laws. 2) AGO 316 (2-19-1954)
    AGO 14 (2-23-1955) These opinions both hold that governing Boards of public schools do not have the authority to allow use of public school buildings or facilities by religious groups for sectarian purposes. If Released Time programs were allowed, the religious instruction could not be given on school property.
