StateNotes Special Education 700 Broadway, Suite 1200 Denver, CO 80203-3460 Fax: 303.296.8332 www.ecs.org State Efforts Regarding Teacher Preparation, Certification, Recruitment and Retention October 2003 The Individuals with Disabilities Education Act of 1997 (IDEA) took bold steps toward ensuring children with disabilities receive the free and appropriate public education to which they are entitled. One of the major issues addressed by the legislation is the quality of teachers for children with special needs. IDEA ’97 requires students receiving special education services to be educated with their non-disabled peers to the “maximum extent practicable.” As a result, according to a 2001 report from the Study of Personnel Needs in Special Education, 75% of students receiving special education services spend 40% or more of their day in general education classrooms. Consequently, 96% of general education teachers currently teach, or have in the past taught, children with special needs.

How have states responded to the challenge to prepare general education teachers to meet the needs of students with special needs? According to ECS’ Teacher Preparation Policy Database (http://www.tqsource.org/prep/policy/), 46 states and the District of Columbia currently have statutes or regulations requiring teacher education programs to provide some instruction on teaching children with special needs to individuals seeking initial training in elementary or secondary education. The amount and content of this instruction, however, varies dramatically.

1999 Award Winners DEBRA VOLL - Debra Voll is a Primary Communication Disorders teacher at Desert Shadows Elementary School in Scottsdale, Arizona. Since 1990, she has taught a self-contained kindergarten and first grade communication disorders class, through a team approach with two teachers, a speech-language pathologist and three instructional aides. The classroom population includes twelve children with severe language learning disabilities, autism and other pervasive developmental disorders, as well as emotional and behavioral challenges.
Ms. Voll received a B.S. in Education in 1973 from Illinois State University and obtained a Masters of Education in Educational Leadership with Distinction from Northern Arizona University in 1996. She was nominated in 1992 for the National PTA's Phoebe Apperson Hearst Outstanding Educator Award, and has been awarded numerous venture grants for innovative projects, including the involvement of therapy dogs in the classroom.
JANE MURPHY - Jane Murphy is a classroom teacher for District 75 CityWide Special Education in New York City. She is currently working with a team of teachers to launch a pilot inclusive education program to adapt two community classrooms for children with and without identified special needs representing a range of emotional, social and cognitive functioning, as well as physical and learning disabilities. Prior to this new project, she spent ten years in the district working in a program designed for children with severe emotional disturbances.

Commonly Asked Coaching and Volunteer Questions What is the minimum age for a coach? What volunteer opportunities are available for minor (under age 18) volunteers? Can an athlete be coached by a family member? Can all coaches be left alone with athletes? ... How does a coach become certified? What is Special Olympics? Special Olympics is a non-profit organization dedicated to providing year-round sports training and competition in a variety of Olympic-type sports for people eight years of age and older with developmental disabilities, giving them continuing opportunities to develop physical fitness, demonstrate courage, experience joy and participate in a sharing of gifts, skills and friendships with their families, other Special Olympics athletes and the community. Who is eligible? Special Olympics is open to every developmentally disabled person, regardless of the level or degree of that person's disability, and whether or not that person also has other mental/physical disabilities. Each athlete must register to participate in Special Olympics as required by the General Rules. There is no maximum age limitation for participation. How does an athlete register to participate?

What does a parent do when his child needs extra help, a different approach, or special equipment to be able to learn? What if these services are not accessible through the private sector, and then denied by the public school? In this issue: Erasing the barriers: What the law says Seeking therapy: Forstroms’ story Practical help and advice: Betty Statnick What the law says about services for the learning disabled In order to clarify the law for our families throughout the country who need these services, but have been denied, Home School Legal Defense Association filed suit on behalf of several families. We filed in Connecticut when 9-year-old Kaitlyn Gallagher was denied $10,000 of specialized equipment for the blind, in New Jersey when 6-year-old Gregory Forstrom was denied speech therapy, and in Nevada when 9-year-old Christopher Hooks was denied speech therapy.

In 1999, in the wake of the Columbine school massacre, and
under the direction of Mrs. Johnson, the Board passed the
precedent setting Resolution that called for academic rather than drug
solutions for behavioral and learning problems in the classroom.
When Congress originally passed IDEA, covering Special Education, its primary purpose was to provide a Free and Appropriate Education for children with hearing, sight, speech and other physical handicaps. Over the ensuing 27 years, the funding has been largely funneled, instead, to children with "learning disorders," a term so subjective that children who fidget, butt into line or interrupt their teachers are so labeled. In most cases they are subsequently prescribed cocaine-like, mind-altering drugs. Many of these children simply have never been taught to read. Clearly, there is a critical need to provide an objective, scientifically based definition of "learning disability," and this must be the central point of reforming IDEA.

Arts-in-Education: Washoe, White Pine, Carson City, and Storey County School Districts, and Washoe County Home School.
VSA arts of Nevada conducts hands-on visual art, creative movement, and theater arts workshops in mainstreamed, special education, and rural classrooms. These workshops give students the opportunity to explore the arts and to discover their hidden talents, helping them develop a higher sense of self-awareness. Few counties in Nevada hire visual art teachers in elementary schools, so this program is imperative for bringing the arts into education. Several of these workshops focus on children with disabilities who are in self-contained, mainstreamed, and home-school settings.

What is the Individuals with Disabilities Education Act (IDEA)?
IDEA, 20 U.S.A. 1400 et. seq., is a federal law which entitles all students with disabilities to have available to them a free appropriate public education emphasizing special education and related services designed to meet their unique needs. It also assures that the rights of children with disabilities and their parents are protected. 20 U.S.C. 1400 (c). On June 4th, 1997, President Clinton in signed into law a number of amendments to IDEA. New provisions governing disciplinary actions went to effect on that date.
