For the latest information from the ACLU, go to http://www.aclu.org August 1, 2001 - Nebraska Study Finds Economic Status, Geography, Play Role in Application of Death Penalty LINCOLN, NE A report on Nebraska's death penalty released today by the state Crime Commission points to geographic and socio-economic disparities in the state's death penalty process. The report, commissioned by the Nebraska state legislature two years ago, cost $180,000 to complete, reports the Omaha World-Herald. While the report did not find evidence of racial disparity in Nebraska's application of the death penalty, according to The New York Times, prosecutors in urban counties, specifically Omaha and Lincoln areas, were more likely to seek the death penalty and refuse plea bargains compared to the more rural Nebraska counties. The other troubling and significant finding of this report is that the socioeconomic status of the murder victim seems to play a role in determining which defendants are sentenced to death. Criminal Justice Legal Foundation President and long-time death penalty advocate Michael Rushford boldly acknowledged Nebraska's arbitrary application in the death penalty sentencing process based upon the victim's social standing.
