    ADMINISTRATIVE LAW
    Administrative procedures and hearings play an increasing role in law practice, as regulatory agencies expand their influence. The federal and state administrative procedure acts serve as the focus for this course. ( Corbett The Administrative Law is designed for the lawyer who: (1)works for the government;
    (2) represents clients or entities doing business with the government, are regulated by the government, or individuals or entities who receive government benefits, or
    (3) works for a public interest entity or practices public interest law representing interests other than the government or private entities. The course is primarily procedural. It assumes that the lawyer is working with some substantive issue-environmental, consumer/worker safety, social security, etc.-and needs to knowhow the substantive issues are presented and determined by the government and potentially appealed to the courts. While legislation that creates substantive rights/duties most often also provides procedures, there are basic or generic procedures that apply to all agency processes. The course focuses of these generic procedures.

    Montana Adopts a New Method of Accreditation
    T wo years ago, 18 Montana schools pioneered an alternative method to fulfill state accreditation requirements. These schools volunteered to participate in the state’s pilot of a school improvement process that empowers teachers and community members to translate their vision for improved student learning into accreditation standards. The pilot schools and their partners—the Montana Office of Public Instruction, the Montana Board of Education, the Northwest Association of Schools and Colleges, and NWREL—form the coalition MISTA: Montana Improving Schools Through Accreditation. Traditionally, Montana awarded accreditation based on a school’s ability to meet uniform state standards. But in March 1995 the state adopted an alternative method called Performance-Based Accreditation (PBA), which allows schools to meet state accreditation requirements through a locally delivered and locally controlled school improvement plan that focuses on improved student performance. According to the performance-based alternative standard, schools choosing to participate in PBA must complete five steps over a period of three to five years:

    Rural or urban, rich or poor, culturally diverse or homogeneous, all public schools face the challenge of trying to educate students who for one reason or another don't thrive in the usual school environment. School psychologists or counselors may be called. Conferences with the parents are sought. Behavior management contracts are drawn. All this to no avail the student is at risk of failing. With other options exhausted, this is a common scenario in which the school, parents or students themselves may seek an alternative school. "Alternative school," a term with several definitions, has been an integral part of the way the education system has evolved in the United States. "Early in our history," writes R. Garrison in a resource paper on disruptive youth, "we recognized that the needs of a few often mirror the needs of the many. From the establishment of Harvard College in 1636 [originally intended for the education of Puritan ministers] to the magnet schools of today, American education is the collective result of countless alternative school programs." With our diverse society, options seem essential to the health of our education system. Alternative schools and programs for kids at risk of failure, as well as those who seek specialized schools of various kinds, are a way to help kids who do not flourish in the traditional school setting.

    Program Description OVERVIEW The Montana and High Plains Region Troops-to-Teachers Program, a regional consortium servicing Montana, Idaho, North Dakota, South Dakota and Wyoming, is designed to assist qualified military personnel make the transition from the armed services to service in the classrooms of our schools. The program helps connect individuals with information, institutions and the people that can help participants navigate then meet state certification requirements and ultimately find a teaching position. As of January 2002, over 4,000 Troops-to-Teachers participants have been hired nationally in the public schools through the program. The Troops-to-Teachers (TTT) program was initially established in 1994 to address force restructuring in the military by assisting retiring and separating active duty military personnel transition to new careers in public education. The military drawdown is over and the program has been redefined to address the actual and projected nationwide teacher shortage. According to “Who Will Teach Montana’s Children”, a report published in February 2001 for the Certification Standards and Practices Advisory Council (CSPAC) of the Montana Board of Public Education, Montana will need to hire roughly 909 new teachers each year for the several years. The report also indicates that only about 265 of those annual vacancies can be expected to be filled by recent graduates from the eight institutions within the state offering teacher education programs. In short, many of Montana’s schools can expect to have a difficult time filling their available positions. Other states in the high plains region are experiencing similar situations. Nationally, the situation is quite similar with U.S. Department of Education figures indicating that 2.2 million additional teachers will need to be hired nationally, over the next decade, to keep pace with teacher retirements and the growth in student populations.

    Countering a proposal to include biological origin theories other than evolution in science class, opponents Wednesday will argue to maintain the long-established theory of evolution as the genesis of biology. Sponsored by the Ravalli County Citizens for Science, the public meeting Wednesday at the Darby Junior High gymnasium at 7 p.m. will include a presentation by Allan Gishlick of the National Center for Science Education. With a resolution on the table that would change school policy and possibly thrust Darby into a national spotlight, school board trustees decided to hear a presentation against the policy before making a decision at a special meeting next week. courts have emphatically prohibited the teaching of creationism in public schools , the objective origins curriculum inevitably will include discussions of intelligent design Opponents of the intelligent design idea say that the theory holds little scientific merit and is a round-about way to bring creationism into education. Last month, school officials in Roseville, Calif., decided not to add anti-evolutionist materials to the district science curriculum, according to a report in the Sacramento Bee. Darby is the first school district in Montana to take up such a decision, according to Montana School Board Association officials.

    The automobile has taken American culture a long way, but that ride hasn’t come without costs. The costs we notice the most these days appear in the numbers splayed on gas station marquees, peddling gas at $2 a gallon. But there are other costs, too. The wear and tear on your body, as it sits limp and placid, growing larger by the day. The cost of carbon monoxide spewing into our air, and its implications for the temperature of the planet. The congestion created on city streets, sometimes so thick that it impedes pedestrian traffic, essentially dissecting the city. While automobiles are certainly the vehicles of choice in our mass-consumption economy, other options are beginning to sprout. One of the greenhouses of such emerging alternatives is Lightfoot Cycles, based just out of Conner in the southern Bitterroot Valley. Housed in an old horse barn on a tree farm, the place seems more lost in time than ahead of its time, but here at Lightfoot, a staff of half a dozen diligently works to create a world-wide pedal-powered revolution for Honduran farmers, African agrarians and Manhattan commuters.
