Commercial Printing Legislature approves boost to Missouri school districts Published Wednesday, May 5, 2004 JEFFERSON CITY (AP) - The Missouri General Assembly passed an education budget yesterday that raises basic aid to school districts by more than 5 percent - praised as progress by some lawmakers but criticized by others as inadequate. Facing a Friday deadline to approve the entire $18.8 billion budget for the fiscal year that starts July 1, legislators also sent Gov. Bob Holden the bills that fund higher education, transportation, state employee benefits and the Department of Revenue. House and Senate negotiations on three of the dozen budget bills remained stalled on Medicaid funding, pay raises for the Missouri State Highway Patrol and other issues.

Below is a summary of the bills upon which we spent most of our time tracking and lobbying.
Criminal Justice
HB 1076 (Jolly -D) sought to increase the time a person arrested for a felony could be held without a charge from 20 hours to 32 hours. ACLU/EM successfully worked to prevent passage of this bill, but we expect to see it back in 2003.
Death Penalty
2002 was another busy year for abolitionists. In the Senate, three bills were introduced seeking to place restrictions on the imposition of capital punishment. SB 819 (Bentley-R) (Also, HB 1836 Hosmer-D) sought to raise the minimum age for imposition of the death from sixteen to eighteen. Despite receiving a favorable vote in committee, the bill was never heard for debate. SB 1022 (Rohrbach-R) (Also, HB 1766 Monaco-D) provided that a judge had to declare the punishment at life imprisonment without parole if the jury was unable to decide upon punishment in a trial for murder in the first degree. The bill received favorable committee votes, and eventually was added as an amendment to an omnibus judiciary bill (HB 1962) late in the session. The omnibus bill failed to pass for reasons unrelated to the death penalty provision.

Thousands of new books headed to Missouri libraries from Toys R Us settlement with Attorney General Nixon
Jefferson City, Mo. The new school year will bring thousands of new books to 46 school districts, libraries and organizations in Missouri that are eligible to benefit from a settlement between Attorney General Jay Nixon, Toys R Us and three other major toy makers. Nixon and state Attorneys General nationwide sued the toy manufacturers in 1999, alleging the companies conspired to withhold some popular toys from discount and warehouse chains in a price-fixing scheme. "The actions of the toy makers affected children and their parents, and it is appropriate that the court order directs this money to the benefit of children. I am pleased that the emphasis will be on children's reading programs," Nixon said. "This is an outstanding opportunity to secure new books for libraries and to help instill a lifelong love of reading and learning in our children." Nixon is teaming up with the national Reading is Fundamental program to distribute the books to Missouri libraries selected by RIF to benefit from the $258,830 award to the state. The award will provide for more than 20,000 new books appropriate for grades K-3 and an additional $26,599 in direct grant money, allowing distribution of books for ownership to children in RIF programs in Missouri.

Organization of Student Representatives (OSR)
The Organization of Student Representatives (OSR) is a medical-student organization that was developed by the Association of American Medical Colleges (AAMC) in 1968 to provide a means for student participation in the affairs of AAMC.
Locally the OSR chapter has been instrumental in developing and maintaining the MED careers program and the MSAC Group for Promoting Professionalism. The chapter also nominates on faculty member each year for the national AAMC/Pfizer Humanism in Medicine Award. Aside from these specific duties, OSR is responsible for determining student opinion on various issues of importance and emphasizing them to the groups mentioned above. We also gather information about national issues and upcoming changes within each category and share that information with the MU medical school student body. Holden Supports Suit for Adequate and
Fair School Funding
JEFFERSON CITY –Citing the importance of ensuring that all Missouri school children receive a quality education, Gov. Bob Holden today announced his support for a lawsuit seeking adequate and equitable funding of public education. In a speech to the State Board of Education, Holden also called on board members to help expedite the suit and to help the Legislature understand the gravity of school funding problem. On Tuesday, 243 Missouri school districts sued the State of Missouri for its failure to adequately and equitably fund education. "The districts that filed this suit are right," Holden said. "They are taking the only course of action left to them by a Republican Legislature that has turned its back on our school children." According to Article IX of the Missouri Constitution, it is the duty of the General Assembly to provide adequate and equitable funding for public education. "Nobody wants the Courts in our classrooms," Holden said. "But if it’s a choice between the Courts intervening in school funding or the Legislature starving our schools and robbing us of our future, I know which course I will choose."

Information from the Callaway County Public Library Morris Frederick Bell General M. Fred Bell had a distinguished career as an architect and businessman. He served as adjutant general of the state of Missouri from 1897 to 1901 during the Spanish-American War. He left his mark on Fulton and Callaway County as the architect of Missouri School for the Deaf, Fulton State Hospital, Callaway County Public Library, First Christian Church, Pratt's Theatre, buildings at Westminster and William Woods, plus many homes. General Bell was born near Hagerstown, Maryland, August 18, 1849, son of Frederick and Susan (Tritle) Bell. He was a descendant of Captain Peter Bell, an American officer in the Revolution. Bell grew up on a Maryland farm, was educated in public schools, and in 1869 was graduated from Duff Commercial College at Pittsburgh, where he had specialized in architecture. Bell came to Missouri in 1869, first locating in Mexico. He then spent a short time in Kansas, but returned to Missouri and established a home at Fulton in 1871. On November 26, 1873, he married Miss Marie Dreps. They had two daughters, Beulah and Kathryn. Beulah married George W. Berry, of Berkley, California. Kathryn married Fred T. Montgomery, of Fulton. They named their son Fred Bell Montgomery in honor of General Bell. In 1882, General Bell established a telephone exchange in Fulton. It was the fifth telephone exchange in the state of Missouri. The telephone at that time was still experimental. Only six years had passed since the first successful demonstration of the instrument had occurred at Philadelphia. Bell was manager of the Fulton telephone exchange from 1882 until 1929.

The general assembly recognizes that English is the most common language used in Missouri and recognizes that fluency in English is necessary for full integration into our common American culture. Section 2. 1. The adult basic education programs administered by the department of elementary and secondary education shall include the provision of English language services to non-native speakers who need assistance in learning English. 2. The local entity designated by the department of elementary and secondary education to offer adult basic education shall seek the assistance of local political subdivisions, community-based agencies and organizations, migrant worker groups, refugee resettlement programs, schools, churches and others in making non-native speakers aware of the availability of English language services. 3. English language services provided through the adult basic education programs of the department of elementary and secondary education may include family and home-based curriculum and programs designed to enhance the English fluency of all family members and may include programs whereby family members teach each other the English language. Section 3. 1. Subject to appropriation from general revenue, the department of elementary and secondary education shall provide grants to assist local public school districts, community-based organizations and nonprofit agencies, including resettlement programs, to provide instruction in the English language to individuals residing in the community or district who have language background other than English and who need assistance in learning English. Preference in grants shall be given to communities and districts demonstrating the most need.

Fall 2001 Welcome letter: Greetings! On behalf of the University of Missouri and the University of Missouri Sports Medicine Staff, I thank you for your interest. The mission of the University of Missouri Athletic Health Services is to provide the best possible health care for all University of Missouri student-athletes. Our beautiful Dr. Glenn L. McElroy Sports Medicine Center is, without question, one of the nicest college facilities in the country. Included within the 9,000 square foot athletic medical facility is a Swim-Ex pool, a Biodex isokinetic testing and rehabilitation system, treatment and taping areas, a hydrotherapy room, and a spacious state-of-the-art rehabilitation area. The facility is staffed by six full-time certified athletic trainers, four certified graduate assistant athletic trainers, and in excess of twenty-five well-prepared student athletic trainers. The University of Missouri team physicians, under the direction of Dr. Pat Smith, are nationally renowned and respected. Dr. Smith works directly with the football program, and visits the McElroy Sports Medicine Center on a daily basis, enabling the health care team to aggressively treat any injuries that may occur-thus minimizing their severity.

NUMBER 123 THE NEWSPAPER OF EDUCATION RIGHTS APRIL 1996 Missourians Alarmed by School-to-Work Proposals by Oliver Starr Jr. ST. LOUIS, MO - Missouri Governor Mel Carnahan and his education department have created a 116-page "School-to-Work, Roadways to Success" federal grant proposal calling for the complete restructuring of Missouri schools to meet new federal "career education" performance standards. The Missouri grant proposal will access federal funds authorized by the School-to-Work Act passed by Congress in 1994 and signed by President Clinton. Parents are shocked by the contents of this massive School-to-Work proposal. Steven Boody, head of the Back to Basics organization in the Parkway School District in suburban St. Louis, spent weeks researching its startling provisions and found that, if it is put into effect, "our children will no longer receive a basic education. They will be trained for one of six career paths in the 21st century workforce." This new program was authorized by an executive order of Governor Carnahan and reflects the thinking of Marc Tucker, education consultant to Carnahan. In a letter to Hillary Clinton in November 1992, Tucker expressed his vision that it is "essential that we create a seamless web of opportunities to develop one's skills that literally extends from cradle to grave and is the same system for everyone."

For years the Police Department has kept such proceeds, despite a 1990 ruling by the Missouri Supreme Court requiring the proceeds to be distributed to local school districts. The funds generally must be distributed to the county treasurer, the state treasurer or the schools, depending on the source of the funds. In 1997 police filed a lawsuit asking the Jackson County Circuit Court to determine how the proceeds should be divided. The lawsuit claimed that different and often contradictory laws applied.
