    Laws and regulations exist to protect consumers from a variety of seller and lender abuses. “There’s a sucker born every minute – and two to take him” according to P.T. Barnum. Laws and regulations cannot protect consumers from all abuses but exist to reduce or eliminate any unfair advantage that a seller or lender may enjoy. For example, there are many different ways to calculate the interest on a loan. It can be compounded yearly, monthly, daily, or continuously. Payments may be applied to the interest first, the principal first, or both the interest and principal. Because lenders have an unfair advantage in this respect, state and federal laws require them to disclose the annual percentage rate (A.P.R.) they are charging borrowers. (The APR is the effective interest rate and must be reported along with the advertised interest rate.) Other laws and regulations serve to protect consumers from sellers that withhold crucial information. Consumers have three days to cancel a contract they make with a door to door vendor, for example. Used car dealers and Realtors must disclose any information they have about the car or property being sold.

    Understanding Proficiency
    NCLB asked all states to develop their own plan for measuring proficiency to determine adequate yearly progress. To comply with NCLB, the State Board of Education could have adopted a less-demanding definition for proficiency, but it elected to maintain the standards that are currently used with the MAP tests.
    Adequate Yearly Progress (AYP)
    NCLB calls for all children to be proficient in both reading and math by 2014. In order to reach the goal of 100% student proficiency by 2014, public school districts must show satisfactory, annual improvement towards that goal. To that end, DESE has established specific annual targets by which to measure the AYP of Missouri school districts. The 2003 AYP goal for all schools in communication arts is 19.4 percent of all students being proficient. The AYP goal in math is 9.3 percent of all students being proficient. AYP is measured at three different levels: district-wide scores, school-wide scores, and four specific subgroup scores.
    Subgroups and Participation
    NCLB mandates that at least 95 percent of all students within a subgroup be included in testing. If the 95 percent threshold is not met, then the district, school and subgroup cannot meet AYP, regardless of the scores. For example, if more than five percent of a race subgroup do not speak English well enough to take the communication arts test, that subgroup, its school, and the entire district are listed as having not met AYP in communication arts.

    Missouri Mandates Boater Education
    Missouri has become the 34th state in the nation to mandate boater education. Beginning on Jan. 1, 2005, boater safety course requirements in Missouri apply to anyone who was born after Jan. 1, 1984. The Missouri Water Patrol will issue lifetime boater certification licenses. The bill allows boaters who are licensed by the U. S. Coast Guard to bypass the mandatory Missouri certification. The bill does not change the legal age for operating a boat on any Missouri waterway which remains at 14. Stops for the purpose of checking boaters strictly for proof of certification is prohibited under the provisions of the bill.

    Evaluation shall be conceived as a systematic analysis, on the basis of selected standards, of the progress that is being made by the school system toward pre-established goals, designed to reveal shortcomings in the achievement of goals as well as defects in the methods employed in achieving them.
    This continued evaluation will serve the following purposes:
  • Assess educational needs and provide information for planning in the District. Indicate instructional strengths and weaknesses in the District's educational programs. Evaluate the suitability of programs in terms of Missouri Department of Elementary and Secondary Education regulations, student needs, and community thoughts. Show the relationship between staff and student achievement and the District's stated mission beliefs and objectives. Comply with the legal requirements for state and federally funded programs. Provide data for public information.
  • The Board will rely on its professional staff and/or outside agencies to provide continuous evaluation of the educational programs and instructional processes of the District. Specific measures will be identified to determine program success. Appropriate research studies will be periodically reviewed to determine recent trends and developments in instructional evaluative techniques.
